Councilmen present were: Messrs. Sylvester, Bowden and Cunningham. Also present was Robert Harp, Vi11Gge Clerk and ~~illiam A. Lord, Village Attorney. The Clerk readthe published notice of the Public Hearing and advised that it had been published in the Beacon News issue of September 25, 1969, and all property owners within 500 feet of the areas for which zoning classifications ~;~ere to 'oe determined had received letters advising thers of the hearing. The Clerk read a letter from S.S. ~ R,, Incorporated, requesting that their t`,~o (2) parcels of land be zoned tr:-3 Multiple Famil;~ (Nigh Rise) Dwelling District, the same as adjoining ].ands in the Village of Tequesta. Mrs. E. A, White, owner of Jupiter Island Apartments, stated she had no objection to an R-3 zoning classification for the parcel of land lying between the Atlantic Ocean and the east right-of-way line of .Mate Load 707. She stated that she would object to a zoning cla,ssifica.tion , for the parcel of Land lying west of the west right-of-way line of State Road ?0? and east of the east right-of-`:~,y line of the Intracoastal Water- vrap that would permit a building that might obstruct the view from her .buildings directly to the north of the subject property or interfere with • the breezes from the south. Mr, C. D. Lafferty, 325 Beach ?goad, suggested that the ovrner be required to submit blue prints of the 'ouilding they intend to build to the Village Council before the zoning classification for the land is deternuned. Mr. t;'. D. Robertson, secretary-Treasurer of S. 5, ~ R., Incorporated, stated they had not determined the structure they intended to place on the land as yet. Bowden moved, second by Cunninghami that the parcel of land ovrned by S. S. ~ R., Incorporated, lying betdaecn the Atlantic Ocean and the east right-of-way line, of State Road 707 in Lot 197, Gomez Grant and Jupiter Island, be zoned R-3 Multiple Family (High Rise) Dwelling District. The vote on the motion wa.s: Cunningham - For the Notion Bo~~den - For the Motion Sylvester - For the Motion The motion eras passed. Bowden moved, second by Cunnyn~;hari, that the Council defer action to determine a zoning classification for the parcel of Ia.nd. otmed by v. 5, f~ R., Incorporated, lying ~~rest of the west right-of-way line of Mate Road ?07 and east of the east right-of-way lire of the Intracoastal t°:Tatenray in Lot 197, Gomez Grant and Jupiter Island, until another Fublic Hearing is held. The vote on the motion eras: Bowden - For the Motion Cunningham - For the Motion Sylvester - For the Motion The motion eras passed. -7- 2 - 10-21--69 Mayor Sylvester stated the next item for consideration was to consider a zoning classification for Lot 13, Block D, Jupiter Manors, Section One, t~hich is adjacent to ~.T~itehall Condominium Apartments on the south side. Mr. Willard C. '.'heeler, Jr., Trustee for the otiuners of the parcel of land, appeared before the Council and requested that the property be zoned R-2 Multiple Family Dwelling District the same as the ~dhitehall property and Carriage Houses to the north. He identified the owners of the property as Mr. ~~'asson, I~ir. Christian, Mr. Boyce and Mr. Arbet, all residents of Whitehall Condominium Apartments. Mr. ti'aheeler advised the Council that any building the owners would construct would be generally esth~ticaliy compatible with the existing thitehall Condominium Apartments and that the owners would be willing to agree to submit the plans to the Tillage Council for their approval prior to the start of construction. The Clerk read a letter from t~~illiam M. Clark, Jr. and Bet*y M. Clark, owners of a Carriage House apartment, registering their ourosition '~ to re-zoning of the land or the construction of a condo.*niniu-n o.± thQ site. The fcllowing persons, alI residents of Whitehall Condominium Apartments, personally objected to an Z-2 zc_iing classification for the subject property: Arthur J. Abbott Jacqueline Morgan Florence C. Bo~-m~a,n Mr. ?Jheeler stated his clients =could Like to make the best use of this parcel of land and believed that an R-2 Multiple Family Dwelling classification E~ould permit them to do this. Cunningham moved, second by Bo`~~den, that the Council defer action to determine a zoning classification for Lot 13, Block D, Jupiter Manors, ,Section One, until another public hearing is held. The vote on the motion was Cunningham - For the notion Bowden - For the Nlotion Sylvester - For the Motion The motion was passed. The Council Eras advised that all lands annexed to the Tillage of Tequesta are autcma,tically zoned R-1 Single Famil~r Dwelling District c].a.ssi- fication and that the Tillage Council must hold a public hearing ;within 120 days from the date of annexation to determine the initial zoning c]assifica.tion for the land.
