HomeMy WebLinkAboutMinutes_Regular_11/18/1969MINUTES OF THE MEETIRTG Oi~ Thy COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA The regular monthly meeting of the Councilmen of the Village of Tequesta, Florida, was held at 8:00 P.Aq., Tuesday, November 18, 1969, at the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmen pre- sent were: Messrs. Sylvester, Boy,=den, Cunningham and Long. Councilmen Simmons had advised he ~rould not be present. Also present were Robert Harp, Village Manager and Clerk and ''illiam A. Lord, Village Attorney. The meeting was opened with prayer and the pledge of allegiance to the flag by Councilman Cunningham. Upon motion by Cunningham, second by Long and passed, the reading of the Minutes of the previous meeting was waived. Counci]ma,n Bowden ques- tioned the advisability of contesting the suit filed by the Palm Beach County Tax Assessor and Palm Beach County Tax Collector against the Village in reference to Chapter 69-54 Laws of Florida. Upon motion by Bowden, second by Cunningham and passed, the reading of the Minutes of the Public Hearirzg of October 2i, 19i,9, and of the Special Council Meeting of October 31, 1G69, wa.s waived. Cunningham moved, second by Long and passed that the detailed reading of the financia 1 statement for the month of October be waived. The Village Manager recapped the receipts and disbursements for the one (1) month period ending October 31, 1969. The financial statement • and disbursements .for October, 1969 were approved. Balances on hand were as follows: First Bank of Jupiter/Tequesta $23,754.10 Petty Cash 25.00 Community Federal Savings and Loan 14,046.86 Fidelity Federal Savings and Loan 14.488.91 52,314.8? Account balances were as follows: Operating Account $47,289.87 Petty Cash 25.00 Developers Security Deposit _ 5,,000.00 ~2~314.8? The Sinking Fund balance for payment of principal and interest on the Village Hall bonds was $16,35!.27. Cunningham moved, second by Bet;Tden and unanimously passed that it be the policy of the Village Council to read Minutes of meetings only upon request and to read financial statements by totals only. Councilman Bowden stated the statement indicated that the 100% increase in Ad Valorem Taxes for 1969-1970 was entirely unjustified and predicted the Village will end the fiscal year with a minimum surplus of $50,000.00. -The Eater Department financial statement for the ten (10) months ended October 31, 1969, shored total revenues of $1?9,457.85; total expenses of $45,514 63 and debt service requirements of $111,946.17. Counci Lean Bowden had a question concerning the amount of the sinking fund and the -11- 2 - 11-18-69 Village Manager reviewed the transactions into this account. Cunningham moved, second by Long and passed that the financial statements be approved. The Village Manager presented his report covering activities during the month of October, 1969. Building statistics for October 1969 were: ~O°' Val tion 29 (8 Houses) $210,055. Last rear 40 (5 Houses) $509,851. Police Chief Dusenbery presented the Police Department and Civil Defense Reports for the month of October, 1969. Councilman Bowden questioned ~rhy a recent robbery was not incluc~.ed in thA report and was advised it oc- curred in November and the report covered the month of October, 1969, The new V.O.T, stickers were discussed and a fact sheet of "Do's and Don'ts For Home Safety" was also discussed. Councilman Bot:~d.en spoke of possibl usin vigilante to curtail robberies. Mr. T~,r. E. D;~,~;1am, representing the Tequesga Country Club Community Association, Inc. spoke about their V.O.T, car bumper sticker project. Mr. Robert Dewey wanted to know what was being done to have persons from outside the community to get stickers ~:r_d was advised it ~.~.s only a voluntary program, Councilmen questioned the lack of marking on trucks in the Village and ta?s advised that most of these were probably not commercially registered vehicles and marking is not required f'or trucks nor private use. • Mayor Sylvester welcomed Miss Jer er from and reported on the newly formed Palm BeachgCounty MunicipaltLeagueh theool recent heavy rains and drainage problems and street repairs. He also reported on the Sign Committee with 1~=rs. Helen Ge Schull as acting Chair- man. Mr. L. J. Zielinski, owner of Lot 23, Block l5, .3upiter in the Pines, Section B, (430 Dover Road) cempla.ined about the very bad drainage condition that exists on south Dover Road in the area of his residence. Councilman Cunningham said he was gong to look into the situation to see what could be done to help to alleviate the existing condition. Village beautify theelotseastdof thenVillage Hallofor a~-amassed that the • money. nimum amount of Councilman Bowden spoke of anne~:ations and sugges~ed that we try to have the big developers annex their lands to the Village now before the; develop them. -12- 3 - 31-18-69 Bowden moved, second by Long that the Village send a copy of the "Advantages and Disadvantages of Anne;cation" to all the property owners on Point Drive south to the north line of Anchorage Point Subdivision sug- gesting they consider annexation to the Village of Tequesta and to Developers who own property adjacent to the Village. Councilman Cunningham stated he was in favor of soliciting annexation of commercial areas and acreage only and not residential areas. The vote on the motion was: ~~ - For the Motion Sylvester - For the Motion Bowden - For the Iwiotion Cunningham - Against the Motion and was passed 3-1. Councilman Bowden then spoke of reduction of ~,~,ter rates and reviewed his previous attempts to have such a reduction made. He suggested that a reduction be made in the surcharge in the outside areas and a nominal reduction of monthly demand (service) charges for all areas. He further suggested that the Council request the '~Tater Department fiscal agent, con- sulting engineer and revenue certificate holders to pexmit such a reduction in water rates. Counci Lean Cunningham stated that Mr. Goss had said the rates could be reduced by 5% but the Council had agreed this ~~,s not enough to even be considered. He questioned whether or not the rate of return on the i~-ater Department investment in the Town of Jz~piter and Jupiter Inlet • Colony was adequate under the existing rates, He further proposed that the Council once again go over the rate situation with the Water Department fiscal agent and consulting engineer and agreed to discuss the matter at 8:15; Tuesday ev~ming, November 25, 1969, at the Village Hall. Attorney Lord discussed the fee to be charged by the Atlantic National Bank as trustee for the Village Pension Trust. Eowden moved, second by Cunningham and passed that the fee - 5% of income - 1/5th of ]~ corpus value of the trust, plus X3.00 ner participant for insurance con- tracts and a minimum annual fee of x150.00 be accepted. Attorney Lord then discussed the revenge certificates that are to be issued for purchase of land east of the Village ~a.li. Bo~,rden moved, second by Cunningham and passed that the,rlayor and C'erk 'oe authorized to es;ecute and deliver six revenue certificates to the Offutt Tri,;st as con- templated by the Tax Anticipation Certificate of February, 1969. Attorney Lord read an Ordinance amending Ordinance No. 43 and the zoning map thereunder and changing the zoning classification of a • parcel of land owned by S. S. ~ P,, Inc,, lying between State Hoad 70? and the Atlantic Ocean, from R-1 to Ii-3 Multiple Family (High Rise) classi- fica,tion. Cunningham moved, second by '~O~Jderi and ~al'limously passed that the first reading of the ordinance be approved. The Village Manager reported on the sale of the well field site to Palm Beach Cable Television Company; a meeting to be held i:~ the Village iIall tomorrow night by the Cornn-issioners of the Jupiter Inlet District to present the engineering report on the Inlet; a letter from I~w~s. C. D. Holm urging four la.ning of Alt. A-1-P. before F~,~idening of P.G.A. Boulevard; -13- 4 - 11-18-69 reminder to the Council of a Public Pea ring to be held at 7:~5 P.M., Tuesday, November 25, 1969, to be followed immediately by a Special Council Meeting; a letter from the Better Business Bureau referring to the appli- cation and control of the application of textured coating. The Village Manager discussed that the auditors had requested that budget amendments for the fiscal year ended September 30, 1969, for vari- ous over expenditures of line items in the 1968-1969 budget be approved by transfers, a copy of the proposed transfers and amendments being given to each Councilman. Cunningham moved, second by Long that the budget a-nend- ments,as presented, be approved. The vote on the motion was: Cunningham - For the Motion Long - For the Motion Sylvester - For the I~lotion Bowden - .gains;, the Motion and the motion passed 3-1. A copy of the amendment is attached to and made a part of these Minutes. The Village rlanager advised of the receipt of the Test Palm Beach Urban Area Transportation Study - ~ummaxy Report from the Area Planning Board of Palm Beach County. Mayor Sylvester advised the Council that he had proclaimed November 22, 1969, as Florida Atlantic University Appreciation Day. Councilman Lon su g ggested that the Village look into the possi- bility of purchasing the narrow strips of land lying bet~Teen State Road 707 and the Intracoastal LJaterwag* on Jupiter Island for recreational purposes. Pe stated he would talk with County Commissioner I'.obert Culpepper to see if this could be included in the County's plan to purchase recreational facilities and lands. The Village Manager is to obtain costs for the resurfacing of Bridge Road and repair of swale at north Dover Load and S~.brook Road.
