Councilmen present were: •~iessrs. Sylvester, Bowden, Long and Simmons. Councilman Cunningham was absent due to illness. Also present were F~obert Harp, Village l~ianager and Clerk and William A. Lord, Village Attorney. The meeting was opened with prayer and the pledge of allegiance to the flag by Councilman Long. The Village Manager recapped the receipts and dis- bursements for the two (2) month period ending November 30, 1969, which were approved upon motion by Bowden, second by Long and passed. Balances on hand were as follows: First Bank of Jupiter~Tequesta Petty Cash Community Federal Savings and Loan Fidelity Federal Savings and Loan U. The Sinking I~'vnd balance for ,payment of principal and interest on the Village Hall bonds was ~;>17,50$,$;. The ti;Tater Department financial statement for the ele- ven (11) months ended November 30,,1869, showed total revenues of X19$, 60$.92; total expenses of .;:~,.$, 69$, $3 and debt service requirements of ~~123,12$,65, Bovrc'en moved, second by Simmons and passed that the ti~dater Departrrient statement be approved. Councilman Bowden stated it appears that the Water Department will have a ~;~1~0,000,00 profit for the year ending December 31, 1969. ~i'he Village Z•~ianager presented his report for the month of Tovember 1969 which shotr~ed 7$, 6;~ of the 1969 tax roll had been collected and building statistics were: November 1968 Year to Date No. Valuation No. ~ Valuation 33 (9 Houses) ~27;~.g0, ~2 (17 Houses)~~~~ 537,5,5. Last Year 25 (7 Houses) ;1,016,752. ~5 (11 Houses)~;s1,526,b03, -17- 2 - 12-16-69 Police Chief Dusenbery presented the Police Departrr~exl-~ and Civil Defense Reports for the-month of November 1969. Mayor Sylvester reported on Water and Sewage; a meeting called by the Department of Air and Vdater Pollution and the carnival at the Tequesta Plaza. Councilman Long advised that h~ had appointed a com- mittee of William Magrogan, Pat J. Snow, Jr. and Dr. F~udolph Steinhauser to investigate the possible purchase of the narrow strip of land lying between the vest right of way line of State Road 707 and the east right or" way line of the Intracoastal Waterway for use as a recreational area. County Commissioner Robert Culpepper was also contacted by Councilman Long in this matter . Councilman Bowden moved, second by Long and passed that the usual employee Christmas gifts amounting to `;s1~.1,.~ . 00 for Village employees and °100.00 for Water Department employees be approved. Funds for this purpose are provided for in the budgets . Councilman Bowden and the Councilmen agreed that the letter pertaining to annexation be sent to property owners on Point Drive but not those in Anchorage Point. • Councilman Bowden discussed the possible reduction of water surcharges and asked the Village :Manager vahy a proposal to be made to the Tovan of Jupiter and Jupiter Inlet Colony was different than the proposal approved at the last Vorkshop P~~Teeting. He Was advised that the i~~ayor had advised him to send out the proposal to the Councilmen. Councilman Long stated he was pro-. bably the cause of the change since he had called P~iayor Sylvester the morning after the workshop meeting and advised that after thinking the matter over, he was in favor of the original pro- posal and not the one finally decided upon at the workshop meeting. Councilman Simmons read a propcsed re garding the reduction in water surcharges. The had some questions regarding the wording in tr.e of the proposed rESOlution. Jacob J, Blair be authorized to present the following proposal to-the governing bodies of the TOV~ri o~' Jupiter and Jupiter Lnlet Colony pertaining to an adjustment in V~ater sur- charge rates: A, The ~1'own of Jupiter and the Jupiter inlet Colony shall fur- Wish the Village of Tequesta a 30 year franchise without franchise tax or fee effective January 1, 1970. -1~- 3 - 12-1~-6g B. A reduction in surcharge rates to start January 1, 1971, sc~ . that such surcharge rates will 'oe as follows: 1. The present rate of 25;~ in 1970, 2 . A rat e ox" 15~ in 1971, 3. A rate of 10~ in 1972. 4. A rate of 5; in 1973 5. 1974 and thereafter at the same base rate as is appli- cable in the Village of Tequesta, provided, however: That in any year in which the surplus available after rleetin~ all the requirements of the bond orc,inance falls below ~;~12,000. the scheduled reduction in surcharge rates as set forth above shall be moved f orTraard one year as to effective date. 6. However, such action shall not be taken mare than two times, so that the same base rate applicable in the Village of Tequesta shall not be postponed beyond January 1, 1976. Long seconded the motion. Councilman howden urged the Council to delay a vote on the motion until the full Council is present since Councilman Cunningham was absent. ~~ayor Sylvester called for the vote on the motion, v~hich was: Simmons - For the Motion Long - For the Aiotion Sylvester - For the I~~~otion Bowden - Against the T~iotion Mr. Robert Fitzgerald appeared before the Council in behalf of the Sage Corporation and the `y~ Cor1~oration to re- quest a six (6~ montths developers sign perrlit to be l~laeed on their property at 197 7.'equesta Drive. ~i'he proposed sign is ~t x 12P. Bowden moved, second by Lonb that a six (6) months developers sign permit be approved if the proposed sign falls ;within the new sign regulations which the Sign Committee rnight have in mind. T~lr. Charles VJanslcer, President of the Tequesta Country Club Community Association advised the Council of the progress with their V,O.T. emblem project and thanked the Village for its assistance in the project. For his special ef~orts in behalf of the project, 1~~'. VJansker presented Chief Dusenbery a copy of a book entitled '"How to Defend Yourself', Your Family and Your Home". Councilman Bowden stated he believed the V.0.7.'. emblem project should be a Village project and moved that the Village reimburse the ~1'equesta Cour_try Club Community l~ssociation for the net expense of the emblem project. I~lr. Wansker stated the Association appreciated the gesture but that such action was not necessary since there traould be only a few hundred dollars expense -1;- 4 - 12-16-6~ to the project to be borne by the Association and they would 'oe i glad to underwrite this expense themselves. The Village Clerk gave second reading by title to an ordinance of the Village of Tequesta, Florida, amending Ordi- nance No. 43 and the zoning map thereunder to change the zoning classification of a parcel of land owned by S. S. ~ R., Inc. Bowden moved, second by Simmons and passed that the second reading of the ordinance be approved. The first reading of the ordinance having been approved November lo, 1969, Ordinance No. 160 was hereby passed and adopted on second reading. Attorney Lord stated the Village P~ianager had requested an opinion on vahether or not the Village could pay the contribu- tion to the Tri-Community Library for which funds had been pro- vided in the current fiscal year 'oudget. It was his opinion it could not be done since the Village residents were assessed a library tax by Palm Leach County for the library. Attorney Lord reminded the Council that the State Legislature had approved a Charter amendment permitting the assessing of taxes in excess of 5 mills for special capital irnprovement projects providing such millage is approved by a referendum of the freeholders and providing the Charter amendment is approved by a referendum of the Village freeholders. He suggested that the approving referendum could be held at the time of the 1c70 General Election. The Council then discussed the formation of a Village Financial Planning Committee and Councilman Simmons read a reso- lution pertaining to sarne. There were some questior_s about the resolution and action on the matter was tabled. Bot~aden then moved, second by Sylvester and unanimously passed tl~iat the Village Council establish a Village Financial Planning Committee consisting of a Chairman; -two (2 ) members from the first vaard and two (2) members from the second ward and i~~1r. Simmons to be Chariman of the Committee and resolved, further, that said Committee, be, and the same is hereby, ~:uthari2ed to e:camine and investiga:tc the financial reouirements of" the village to provide funds that may be neces~Gry for the construc~i.on of such capital improvements of the Village as may be deterr~7.ned by the Planning Committee. Bowden moved, second by Long and passed tr.at the Village become a n1en~'oer of the Palm Beach County l~luricipal League. Bowden moved, second by Long and passed that John A. Good and Donald G. uVebster, Sr., be appointed to three (3) year terms on the Zoning Loard of Adjustment effective January 1, 1970. Lowden moved, second by Long and passed that tYle annual audit report for the fiscal year ended wepteinber 30, lg6g, as prepared by Nowlen, Lynch ~c Ste~rlart, C . i'. A. , the Village Auditor, . be accepted. Councilman Bov~~den suggested that -the Village ijana- ger discuss the scope of the audit for both the Village and the ti°dater Department to see ii the annual fee could be reduced since the C.P.A. Certificate and Balance Sheet and Statement of Profit and Loss is all that is necessary. -20- 5 - 12-16-69 The Operation and Maintenance Expense budget for tho T~Jater Department for the fiscalyear commencing January 1, 1970, was discussed. The Council was advised that the consulting engineer, Donald L. Osha of Brockway, Owen & Anderson Engineers, Inc., had approved the budget as required by the Bond Ordinance. Bowden moved, second by Long and passed that the 1970 ti°later Department Operating and 1~~7aintenance Expense 'oudget in the amount of X67,500.00 be approved. A copy of the budget is at- tached to and made a part of these Minutes. Upon motion by Sylvester, second by Long and passed Jacob J. Blair was appointed to represent the Village in negotia- tions pertaining to amendment to water rates tr~ith the Town of Jupiter and Jupiter Inlet Colony. The Village Manager reminded the Councilmon of the Public Hearing to be held December 30, 1969, to determine a zoning classification for Lot 13, block D, Jupiter :Manors and January 13, 1970, for S. S. ~, P~., Inc. property on Jupiter Island. `i'he Village l~lanager read a letter from Attorney William S. Wood in behalf of his clients, ~~r. U Mrs. George Georgopoulis, ov~aners of the Village P~estaurant, Village Square Shopping Center, requesting an extension of closing hours from 3:00 A.~~1• to 5:00 A.M., New Yearts morning January 1, 1970. Bovaden moved, second by Long and passed that such extension of hours be approved. The Village i~ianager advised that he had requested two bids for improvements to Lridge Road and the intersection of Seabrook P~oad and Dover Road north of ~hequesta Drive to provide for resurfacing of Bridge 'oad and raising the Swale at Seabrook P~oad and Dover Road. East Coast Landscape and Paving 'oic? was ;2,4.95.00. There being no further business, the meeting was ad- j ourned at 10:00 P. P.~.
