MINUTES Ota Tl'dE M13~:~1'ldv OF THE COUNCILMEN OF THE VILLlaGE OF TEQUESTA, FLORIDA L.J The regular monthly meeting of the Councilmen of the Village a~ Tequesta, Florida, was held at 8:00 P.M., Tuesday, January 20, 1970, at the Village Hall, 357 Tequesta Drive. Councilmen present were Messrs: Sylvester, Bowden, Cunningham, Long and Simmons.. Also present were Robert Harp, Village Manager and Cleric and ~dilliam A. Lord, Village Attorney. Mayor Sylvester opened the meeting with a moment of silent prayer in respect for the Honorable Ilerary ~~. Jewett, Judge of the Village Court, who passed away December 29, 1969. Mayor Sylvester then gave the opening prayer and the Pledge of Allegiance to the Flag, Mrs. Henry ~tT. Jewett and family were present and Mayor Sylvester presented them with the late Judge's name plate; gavel with engra-red sterling silver band denoting his judgeship from Ma,y 14, 1963 and a framed certificate from the Council aclazoe~ledging his service to the Village of Tequesta. The Village Manager recapped the receipts and disbursements for the three (3) month period ending Decer~~ber 31, 1969, which were ap- proved. Councilman Bowden spoke of a cor~iparison between the budget for the Village of Tequesta and the Tot•4n of Jupiter in a recent issue of the • Courier Highlights. He also again mentioned the 100 increase in ad valorem taxes for the 1969-1970 fiscal year. The [dater Department financial statement for the twelve (12) months ended December 3I, 1969, shoved total revenues of $223,385,50; total expenses of $51,224.63 and debt service requirements of $134,311.33. Councilman Bowden discussed providing an inventory of materials and supplies for the end of the year and the allocation of the balance in the sinking fund at the end of the year, Councilman Simm©ns discussed the percentages of earnings allowed by the Public Service Commission for water plants under their jurisdiction„ ..2Qr~ 2 - 1-20-70 Cunningham moved, second by Bowden and unanimously passed tha'c Allan V. Everard be appointed Municipal Judge of the Village of Tequesta The Village Clerk ac~ninistered the Oath of Office to Zwlr. Everard. Police Chief Dusenbery presented the Police Department and Civil Defense Reports for the mc,=_7th of Decer:~ber, 1~6°. Mro i:ramer, a Village resident stated the speed limits need more ,~rforcemo;at and noise from motorcycles needs to be more proper_y c;~:~trolle:~ and Cou.-~cilma:~ Simmons concurred. Mayor Sylvester moved, second by Fo=;aden and passed that the Village underwrite the "VOT" stacker project on an annum ioa,sis providing the Tequesta Cour_try Club Cor.~.nu:~ity Association, Inc, gives their approval. ~Ie stated the Post Office D°partment is looking for sites in the area; cable TV is prog?••essing; complt.iizts on new telephone wervice being slow • to obtain; and the need for a ne~a east-west la.tcral highway to relieve the potentia:~ traffic congestion on Tequesta Dr~_ve as the surrounding area develops. Cunningham moved, second by Uowden and passed that the Mayor send a letter to the Board of County Commissioners of Palm Beach County and the Area Planning Board of Palri Beach County to apprise them of this impending need and to inquire if they have any plans torrard this end. Councilman Long reported that his committee is wrking on the project of investigating the possinle purchase of lams '`yang between State Road No, 707 and the Intracoastal ~-laterway_ s.s re~.:_^c;a~.o~^.al sites. Mrs Williard C~ '.'heeler, Jro, trustee for the owners of Lot 13, L'lock D, Jupiter Manors, asked tha Council to reconsider their action in not zoning this property R-2 following a Public Hearing held December 30, 1969, He asked that the principal owners of the lot be given another opportunity to express their views vn the matter to the Village Council at another Public. Hearing, He further discussed the Public Hearing that was held December 30, Cun..-L;.ngham moves, second by Simmons that the request fora re-hearing be denied. Mxo Robert Boyce, a resinent of Whitehall and one of the owners of the property reviewed the history of the groups purchase of the lot and asked f'o~~ another hearing, Cunningham moved, second by Long to vote on the rnation on the floor. MrQ Donald Ostia, Brockway, Owen ~ Anderson engineers, Inco, ~~Jater Department engineers, read his letter to the Vil~.ge Council recommending that they s,vard a contract to Allay Drillir_, Inc, for a lump sum price of $75,500, for constructing two additiors,l raw water supply wells and interconnecting piping and other *:ecessary facilities and appurtenances in accordance with the modifies: plans. He further stated plan preparation would amount :o approxim~,t~;ly X2,500„00 and engineering inspection approximately $3-, 5f)^.OOa C;a°~~ i~~~;~~a,m ~n~n-r~c~, second by Bowden and unaryimously passed that the cart:~~,ct be awarded to Allay Drilling, Inc. for ltunp spun price of X75,500. arLd the Mayor and Village Clerk be authorized to sign contracts Mr. Allan B, Wright, Chairra.n of the C?~m.rter P~.anni ng Committee, presented the Committees report to the Mayor and Council and it was received by them. Mr, Wright expressed his appreciation for the work done by all the members of the Committee and suggested that after the Councilmen have studied the report, the Committee would be glad to discuss any of the items with the Councilmen, Mr. Wright and the members of the Charter P;.anning Committee were thanked far heir efforts on the report. Attorney Lord advised the Council that it was importarit to the Village employees that the Village pension plan details be filed with the Internal Revenue Service for their approval. Cunningham moved, -~ti_ 4 - 1-2f1-70 second by Bowden and unanimously passed that William A. Lord, Village Attorney, be granted power-of-,attorney to file the details of the plan with the Internal Revenue Service. Mayor Sylvester turned the gavel over to Vice Mayor Bowden. Mr, Sylvester requested permission for Dorner Developers, Inc. to erect a three (3) story, six (6) unit addition to the south building of Waterway Beach Condominium Apartments which had been approved earlier. Cunningham moved, second by Long and unanimously passed that the request be approved. Upon motion by Bowden, second by Long and unanimously passed, Tuesday, March 17, 1970, was set as the date of the General Election ~+rlth the polls to be in the Village Hall to be open from 7:00 AoM. to ?:00 P.M, for the election of the following Village officers: Mayor-Councilman - Two (2) Year Term Councilman-:first Ward - Two (2) Year Term Councilma,n~econd Ward - T±,~o (2) Year Term Councilman-First Ward - 0 e (1) Year Term Cunningham moved, second by Long and passed by a vote of 4 .to 1, with Simmons against, that there be included on the ballot a freeholders election to vote on an amendment to the Village C~'ha,rter, Chapter 69-1686, Laws of Florida, which provides that in the event the Village shall issue general obligation bonds for municipal purposes, tars sha Il be levied upon all taxable property within the tillage without limit as to rate or amount • to the full. extent necessary to pay all principal of and interest on and reserves therefore of said general obligation bonds. Upon motion by Bowden, second by Cunningham and unanimously passed, the following were appointed Inspectors of Election for the March 17, 1970, General Election: Mary W. Attorney Lord discussed the de ding of the water mains etc. to the Village by Turtle Creek Subdivision. He also stated that he could not find where a Councilman could abstai from voting or reserve his vote. This would amount to not exercisi g the duties of the office. He further stated that under rules of pa liamen~a,ry procedure, an ab- staining vote would be recorded as a vot "for". Cunningham moved, second by Bowden and unanimously passed that the reading be approved. Attorney Lord read an ordinance annexing a parcel of Viand in the Southeast q'~.rter of the noeast quarter of Section 25, Township 40 South, Range 42 Fast, Pa?m Beach County, Florida, to the territorial limits of the Village of Tequesta. The parcel of land is o~,rned by Florida Realty Sales, Inc. Cunningham moved, second by bong and unani- mously passed that the reading of the ordinance be approved. Bowden moved, second by Cunningham and unanimously passed that the reading of the ordinance be approved. All Councilmen being present and voting for the adoption, Ordinance No. 163 was hereby passed and adopted on first reading, The Village Attorney read an ordinance zoning :.ot 13, Block -, • Jupiter Manors, R-I zoning cla.ssificatioiz under Ordinance No, 43, the Gfficial Village Zoning Ordinance. Sirrnnons moved, second by Long and unanimously passed that the reading of the ordinance be approved. The Council,-nen set ?:30 P,M., Tuesday, FebrA~ ry 17, 1970, as the time fora public hearing to determine a zoni g classific~.tion for properties annexed. The Village Manager advised the Councilmen that the March meeting falls on the Genera 1 Election day and it will be necessary to set another time for the March meeting. The Village Manager advised that the Votpr laogistra.tion Books are open from 9:00 A.M. to 4:30 P.1~Y,, rionday through Friday. The Village office will also be open from 7:00 1'.M, to 8:00 PkM,, February 5, 1970, and from ?:CO P,M. to 8:00 P.M., Friday, February 13, 1973, ±he deadline for registration after which the books trill be closed, Candidates for office can file during the last ten (10`y days of February, -28- b - 1-20-70 The Village Manager advised that representatives of the County Tax Assessor's office will be in the Vil.la,ge Hall from 9:00 A,M, to 4:30 P,M,, Thursday, February I9, 1970, to accept applics,tions for new Homestead Exemptions. He further advised that the I?epartment of Trans- portation would hold a Public Hdra,ring in the Village Hall at 7:00 P,Mb, February 9, 1970. The report of the Jupiter Fire District for the calendar year 1969 was given to each Counci',man. ~~~ Bill spoke to the Co~zncil about work he had been doing to get legislation passed to provide for the forma.ticn of a special district for water and sewerage and the Coun^iL-nen said they were in favor of such a district.
