OF THE VILyAGE OF TEQLIFSTA, FLORIDA
The regular monthly meeting of the Councilmen of the Village of
Tequesta was held commencing at 8:25 P,M., Tuesday, February 17, 1970, at
the Vi1la,ge Hall. Councilmen present were: Messrs. Sylvester, Bowden,
Long and Simmors. Also present were Robert Harp, Village Manager and'
Clerk and William A, Lord, Village Attorney.
The meeting was opened with prayer and the pledge of allegiance
to the flag by Councilman Bowden.
The"Village Manager recapped the receipts and disbursements for
the four (4) month period ending January 31, 1970, which were approved.

The Sinking Fund balance for payment of principal and interest
on the Village Hall bonds and bonds ror the purchase of the land east of
the Village Hall was 21 951.33,
The Water Department financial statement for one (1) month
ended January 31, 1970, showed total revenues of $20,24.71; total expenses
of $4,.781.46 and debt service requirements of $11,37 5 284 Councilman
Bowden mentioned the larger amount of ad valorem taxes still unpaid at this
date over prior years and that Water Department was ootirati.ng at a nice
profit. Councilman Simmons stated that a public owned utility was not
usually operated for profit but to provide the best posw~ible service at
the lowest possible cost to the custoarers,
The Village Manager presented his report for the month of
January, 1970, which shoed 91.2 of the tax roll had been collected and
building statistics were:

Police Chief Dusenbery presented the Police Department and Civil
Defense Reports for the month of January, 1970.

• Mayor Sylvester reported the Post office Department is to again
look at possible sites; problem of having name of Tequesta on the cover
of the telephone drectory,• Monday nights meting on sewerage for the
North County area. Mayor Sylvester asked the Village Manager to read a
resolution that provides for the Village of Tequesta to enter into an
agreement with the Town of Jupiter, Jupiter Inlet Colony, Palm Beach
County and Martin County to establish a Council of Local Public Officials
pursuant to the provisions of Chapter 69-69, Florida Statutes, as the first
step to further study the provision of sewerage facilities for the area.
Mr. Simmons questioned how much the resolution involved ~e Village and
if such planning would duplicate the work of the planner the Village
intended to retain for the zoning study. It was the opinion of the other
members of the Council that it would not be, Bowden moved, second by
Simmons that the resolution be approved, The motion was unanimously
approved and resolution No. 1 - 69/?0 was thereby passed and adopted.
Councilman Long reported that his committee was deligently working
approaching owners of narrow strips of Iand on the east side of the
Intracoastal Waterway to obtain the owners permission to .have the right
to clean up the area. Mr. Bill Taylor reported the area recreation com-
mittee was in the hands of the attorneys and suggested that perhaps the
Council of Local Public Officials would be an agency through which the
committee could proceed.
Councilman Bowden reported on a recent newspaper article that
various ,Police Departments were wearing a small American flag on their
• uniforms and suggest the Police Chief consider such a program for the
Villages Police Department. Councilman Lowden also discussed the parking
of self-propelled mobile homes in the Village. Bowden moved, second by
Long and passed that the Village Attorney prepare ordinance to amend
existing trailer parking ordinance to prohibit lengthy parking of self-
ppopelled mo~i.le homes. Counci]r~an Bowden discussed the proposed Charter
amendment and suggested the Village Attorney review an explanation pre-
pared by the Village ria.nager to fully apprise the electors of -the question.
Bowden moved that we include the recommendation of the ^ha?~ter Committee
in vote on the amendment. The Village attorney explained the act of the
Legislature and need for vote to approve or disap~+rove the amendment.
Councilman Bowden discussed dogs still running at large,
The Council then discussed the proposed Sign Ordinance as sub-
. n-itted by the Sign Committee. The following owners of businesses in the
Village spoke of various stiff restrictions in the ordinance relating to
their business and other businesses:

Councila~,n Long stated the provisions for the commercial area east of the
railroad were too strict; the three years to remove existing signs and
prohibition of use of temporary signs could hurt merchants. Councilman
Bowden suggested two ordinances, one for east of the railroad and one for
west of the railroad. He mentioned the flashing Publi.x sign was a hazard

because it attracted attention of motorists and could cause traffic acci-
dents. Mayor Sylvester stated the businesses provided the Village with a
lot of tax dollars income and wanted to be sure each business would have
recourse for possible hardships. Councilman Long stated he thought the
merchants should have a say in the ordinance and suggested the Chamber of
Commerce give an opinion on the ordinance. The Council thanked the Sign
Committee for their diligent efforts on the project and the Village
Attorney was instructed to review the proposed ordinance and advise the
Council for their consideration for later action.
The Village Manager reported on the letter of resignation fror,~
Attorney William S. Wood as Judge ad litum. Long moved, second by Bowden
and passed that the resignation be accepted with regret and that a letter
of appreciation for his servi~es to the Village in that capacity be sent
to Mr. Wood.
The Village Manager reported that a new Village resident,
Gilbert T. Brophy, attorney, who resides at 332 Leigh Road, had made
application for the position of Judge ad litum. He meets all the necessary
qualifications and the fact that his residence is in the Village makes
him readily available. Bowden moved, second by bong and unanimously
passed that Gilbert T. Brophy be appointed Judge ad litum.
A petition from DiVosta Construction Company requesting annexa-
tion of a tract of land was tabled to a later date after a land use plan
• for areas outside the Village has been developed.
Upon motion by Bowden, second by Simmons and unanimously passed,
the March Council Meeting was changed to Tuesday, March 24, 1970, because
the Villages General Election falls on the usual Council meeting date.
Upon motion by Bowden, second by long, Resolution 2-69/70 was
passed authorizing delivery of $15,000. Water Revenue Certificates dated
July 1, 1967, to the Offutt Trust from the custody account at the Bank
of Palm Beach and Trust Company.
Attorney Lord reported that the recent suit in which the Village
was a party against the Palm Beach Couaity Tax Assessor and Palm Beach County
Tax Collector had been heard. The judge had ruled the State law to be
constitutional. Attorney Lord recommended to the Council that they do
not proceed with any further court action in the matters Simmons moved,
second by Bowden and passed that tiZe Village Manager be authorized to
negotiate with the Palm Beach County Tax Assessor and Tax Collector for
a fee not exceeding 1/2 of I% for each service.
The Village Attorney gave first reading to an ordinance esta-
blish;an R-1 zoning classification for Lot 12, Block B, Jupiter Manors.
Long moved, second by Bowden and passed that the first reading be approved.
Attorney Lord then spoke of the proposed surcharge revisions
in Jupiter and Jupiter Inlet Colony in exchange for thirty (d0) year
• franchises. He stated that the holders of 2/3 of the outstanding water
revenue certificates had given their approval to the proposed reductions
and agreement would have to be dr~.fted to revue the original agreement
and the rate ordinance would have to be revised.

• The Village Manager reported that the Tequesta Country Club
Community Association had given their written approval for the Village
to take over the "VOT" sticker programs Upon motion by Bowden, second
by I•ong and passed, the Village ~,nager was authorized to pay the Asso-
ciation the sum- of X154.00 for 550 stickers.
The Village Manager advised that a Mr. ~. ~i. Osterhol~ had sent
a letter requesting a liquar license in the Village and had been advised
by letter that his application would be plat in the file with the other
applications.
The Village Manager advised that the contract for the installation
of ~r7ater Departments wells No. 11 and 12 in the-well field on Old Dixie
Highway had been signed and construction should start this week.
The meeting was advised that personnel from the Pa]m Beach County
Tax Assessors office would by at the Village FIa.11 from 9:00 A,M. to
4:30 P.M., Thursday, February 19, 1970, to accept applications for home-
stead exemptions.
It was noted that the deadline far candidates to file for office
for the March 1?, 1970, General Election will be 5:00 P,M. February 27,
1970.
The meeting was advised that a 10' x 10' temporary holding dog
• pound had been constructed at the rear of the Village Mall property.
The Village Manager advised of resolutions, etc. received from
Take v;lorth, ~a.ngonia Park, a letter from the Animal Rescue 1-League and
letter from Representative Bill Jaraes,.
There being no further business, the meeting was adjourned at
10:45 P.M.
