Councilmen present were: Messrs. Sylvester, Bowden, Cunningham and Simmons. Councilman Long was out of town for his employer. Also present were Robert harp, Village Manager and Clerk and William A. Lord, Village Attorney. The meeting was opened with prayer and the pledge of allegfance to the flag by Councilman Cunningham. The Vi1la,ge Manager recapped the receipts and disbursements for the five (5) month period ending February 28, 1970. Balances on hand Were as follows: First Bank of Jupiter/Tequesta Petty Cash Community Federal Savings and Loan Fidelity Federal Savings and Loan U. S. Treasury Bills $ 47,486.98 25.00 14,204.8? 14,651.90 39326.20 $115,694.95 Account summary: Operating Account Petty Cash Deveoper~s Security .Deposit $110,669.95 25.00 5.000.00 $115.694.95 The Sinking Fund balance for payment of principal and interest on the Village Hall bonds and bonds for the purchase of the land east of the Village Hall was X23.639.24. Councilman Simmons suggested that idle cash be invested. The.. Water Department financial statement for the ,two (2) month period ended February 28, 1970, ,showed total revenues of ,$39,879.21, total expenses of $10,fl14.79 and debt service requirements of $22,750.56. Counci Loan Bowden stated he believed the Writer Department would show a profit of $80,000.00 to $100,000.00 for 1970. The Village Manager presented his report covering activities for the month of February, 1970, which showed 93.3 of the 1969 tax roll had been collected and building statistics. as follows: _3?- 2 - 3-24-70 February 1970- N~ Valuation 32 (5 Houses) $287,128. Police Chief Dusenbery presented the Police Department and Civil Defense Reports for the month of February, 1970. Mayor Sylvester read a letter from William J. Tailor, the Village's representative on the Tri-Community Recreation Commission, requesting the Village Council to immediately begin investigating the acquiring of a minimum of twenty (20) acres of ]and to be set aside as a Village park. Mayor Sylvester suggested that Mr. Taylor submit more specific plans for the project for the consideration of the Village Council. Councilman Bowden stated he thought there were civic minded people in the Village who would be willing to contribute funds to the Village for the purchase of land and would refer some names to Mr. Tailor so they could be contacted in this regard. Mr. Taylor stated the pro- posed recreation program was to include all age groups and not just "kids". Councilman Bowden read a prepared statement reviewing his ser- vice with the Village and expressing his appreciation to the Village employees for their courteousness and kindnesses during his eight (8) • years as a member of the Village Council. He then read a statement expressing his feelings on the Charter Amendment which was defeated and he then read a prepared statement revie~ri.ng the purchase of the Tequesta Water Company by the Village. Counci Lean Suns expressed his hope that the new Village Council would proeeed with work on revision of the Village Charter based. upon the report submitted by the Barter Commission and that this matter, together with the appointment of a finance and planning caem~ittee, have priority for action by-the Counci Luen. He then rebutted to Mr.~Bowden~s statement on the Charter Amendment Referendum and water. The Village Clerk gave second reading by title only to an ordinance of the Village of Tequesta, Florida, amending Ordinance No. 43 and the zoning map thereunder,to zone a parcel of land owned by Os~.ld E. and Alma A. Recroft as annexed by Ordinance No. 163. Bowden moved, second by Cunningham and passed that the second reading of the ordinance be approved. The first reading of the ordinance having-been approved at the February 17, 1970, Council meeting, Ordinance No. 166 was hereby passed and adopted. Attorney Lord read the Oath of Office to Mayor Sylvester and Village Clerk Harp gave the Oath of Office to Councilmen Russell and Barr. They were also given their ideatifica,tion name plate. Mayor Sylvester spoke of roa,rious areas in which he believed the Council should direct their attention such as: 1. Garter Co~i.ttee Report; 2. Planning Comeiittee; 3. Streets, Roads and Drainage;- 4. Sign Ordinance; 5. Sewerage; 6. Annexations. Mayor Sylvester spoke briefly about the North County-First Aid Squads (ambulance service) opposition to a County pla~• to levy a tax for eounty~-ride ambu]ance service. It is the local groups feeling that as lang as any area has adequate volunteer or other .type of ambu- lance service, they should not be taxed until such time as the area de- • sires to avail itself of ,the County~s service to provide ambulance ser- vice. The Village Manager reported that under the teems of the Florida Municipal Police Officers Retirement Trust Fund a Board of Trustees consisting of the Mayor, Police Chief, two police officers and one Village resident must be appointed. He then suggested the following persons for appointment to the Board of Trustees: Mayor - Robert E. Sylvester Police Chief - Henry M. Dusenbery Police Officer - Sgt. John P. Roderick Police Officer - Harold P. Sylvester Resident - Archie McVicker Russell moved, second by Barr and unanimously passed that the above persons be appointed to the Board of Trustees of the Village Municipa 1 Police Officers Retirement Trust Fund. Village Attorney Lord discussed the following items: l.) Water Department Franchises with the Town of Jupiter and Jupiter-Inlet Colony for a period of 30 years in exchange for sche- duled surcharge reductions in those areas. He stated that the Jupiter Town Attorney was suggesting the proposed franchise be amended to pro- vide that there would-be no change in rates and surplus funds would not -40- 5 - 3-24-?0 be used by the Village. The Council indicated they would not approve either of these changes. 2.) Tax Assessing and Tax Collecting by the Palm Beach County Tax Assessor and Tax Collector. He suggested the Mayor and Clerk be authorized to sign agreement for these services at cost of .5~ for each service or total of l~ of tax roll. Cunningham moved, second by Barr. and passed that the Mayor and Clerk be authorized to enter into an agree- ment with the Pa]m Beach County Tax Assessor and Pa]m Beach County Tax Collector for their services at a fee of .5~ or a combined total of 1~. 3.) He stated that the Turtle-Creek Village Subdivision was in the process of preparing a deed to the Village for the water lines they recently installed in the subdivision. 4.) He suggested that Charter ,Revision and the revision of the Trailer Parking Ordinance as relates to self-propelled mobile homes be discussed during future workshop meetings. Attorney Lord ve first reading to an ordinance providing for the annexation of two (2~parcels of land on Point Drive across from Bay Harbor Subdivision, owned by Louise F. Robinson, to the territorial limits of the Village of Tequesta. Cunningham moved, second by Barr and passed that the first reading be approved. Attorney Lord gave first reading to an ordinance providing for the annexation of Lot 10, Block D, Section 1, Jupiter Manors, owned by Walter F. and Janet M. Lathrop, to the territorial limits of the Village. of Tequesta. Cunningham moved, second by Russell and passed that the first reading be approved. The Council was reminded that these annexations were a result of the letters sent to the property owners on Point Drive, Attorney Lord advised the Council it was necessary to advise the State Comptroller and State Treasurer that the Village had adopted a pen- sion plan for its employees, including policemen, so that the Village could participate in receiving the proceeds of a l~ excise tax on the gross amount of receipts of premiums from policyholders on all premiums collected on casualty insurance policies covering property within the corporate limits of the Village of Tequesta. He then read an ordinance of the Village of Tequesta, Florida, amending Ordinance No. 152, setting forth employese pension trust agreement, and assessing and imposing an excise tax upon any insurer in accordance with Section 185.08, Statutes of Florida. Cunningham moved, second by Barr~'and passed that the first reading be approved. It was explained that this tax is already being paid by the insurance companies and this ordinance provides-for its return to the Village. • -41- 6 - 3-24-70 The Village Manager reported on the replies from property owners to whom the Village had sent letters suggesting that they consider annexation to the Village. Five replies have been received with four against annexation and one in favor if rest of Island is annexed. He advised that the Village Council would probably agree to the name of "Ca.rlin Park"; that he had sent a letter to the Florida East Coast Rail- way Company about their traias blocking Tequesta Drive;- Cable TV is moving along awaiting several more permits; and that the Martin County Cois- sion had passed a resolution of intent to join with the Village, Town of Jupiter, Jupiter Inlet Colony and Palm Beach County to forma Council of Local Public Officials. Mayor Sylvester reported on the Jupiter-Tequesta Jaycee Officia.l- For-A-Day project and the Council endorsed it with April 27, the day for the students to be with the Village. The Village Council set a workshop meeting for 7:30 P.M., Tuesday, March 31, 1970, at the Village Hall, There being no further business, the meeting adjourned at 9:52 P.M.
