MINUTES OF THE MEETING OF THE COUNCILI~:AT OF THE VILLAGE OF TEQUESTA, FIARIDA The regular monthly meeting of the Councilmen of the Village of Tequesta, Florida, was held at 8:04 P.M., Tuesday, April 21, 1970, at the Village Hall. Councilmen present were: Messrs. Sylvester, Long, Barr and Russell. Councilman Cunningham was out of town for his employer. Also present were Robert Harp, Village Manager and Clerk and William A. Lord, Vi1la,ge Attorney. The meeting was opened with prayer and the pledge of allegiance to the flag by Councilman Long. The Village Manager recapped the receipts and disbursements for the six (6) month period ending March 31, 1970, which were approved. Balances on hand were as follows: First Bank of Jupiter/Tequesta $ 25,374.61 Petty Gash 25.00 Community Federal Savings and Loan 27,380.68 Fidelity Federal Sayings and Loan 14,824.51 U. S. Treasury-Bills 39.326.20 $106,931.00 Account Sumsrary: Operating Account $101,906..00 Petty Cash 25.00 Developers Security Deposit 5.000.00 x,106 , 931.00 The Sinking Fund balance for payment of pri~cipa 1 and interest on the Village Hall bonds and bonds for the purchase of the land east of the Village Ha 11 was $22,899.65. The Water Depa rtraent statement for three (3) months ended March 31, 19?O, showed total revenues of $59,089.65; total operating expenses of $16,171.99 and debt service requirements of $34,125.84. The Village Ma~aager presented his report for the month of March, 1970, which showed 98.7 of the 1969 Tax Roll had been collected and building statistics were: A,l~rch 1970 Year To Date No. Valuation No. Valuation 33 (? Zielinski who presented the Village Council with a petition containing the signatures of 82 resi- dents and property owners residing in the area south of Beacon Street, east of Evergreen Avenue and west of Seabrook Road requesting the Village Council to take immediate action to alleviate the flooding and potential health hazard caused by inadequate drainage in this area. Various members of the audience in attendance d'ro discuss this matter with the Village Council, strongly urged that action be taken to correct the condition. Pictures of conditions that existed following a recent short heaTy rain were shown to the Village Council. Some of the residents advised that they could not use their sanitary facilities for considerable lengths of time. Various methods of solving the problem were suggested both as temporary and permanent solutions. Mayor Sylvester advised the group of the comprehensive drainage plan for the entire Pil]age that had been pre- pared in 1967 by Brockway, Owen ~ Anderson Engineers, Inc. Mayor Sylvester then advised the meeting that the Yillage~s engineers, Brockway, Owen and Anderson Engineers, Inc., had prepared a plan for drainage on Dover Road and the circle which they estimated would cost approximately $20,000.00 Mr. J. W. Blizzard suggested that temporary relief of the situation should be able to be accomplished fora cost of about $2,500.00. Mayor Sylvester suggested that a committee of-the residents meet with the Village Council to discuss solutions for the problem. Councilman Long stated he believed the engineers had over-engineered the plan and would like to discuss the plan with them to get a solution at a lesser cost. Councilman Russell suggested Mr. Blizzard present his plan for the Councilmen's attention. • It was mutually agreed ,that a committee of the residents would meet with the Village Council and the engineer oa Sa.turday morning to further dis- cuss the problem. Police Chief Dusesbery presented the Police Depa rtaaent and Civil Defense reports for the month of March, 1970. The Pillage Clerk gave second reading by title only to an ordinance annexing two (2) parcels of land on Point Drive, owned by Louise F. Robinson, to the territorial limits of the Pillage of Tequesta. Russell moved, second by Long and passed that the second reading by approved..,~The first reading of the ordinance having been approved at the March 24,-1970, meeting, Ordinance No. T6? was hereby passed and adopted on second reading. The Village Clerk gave second reading by title only to an ordinance annexing a parcel of land on Point Drive, owned by Thomas P. Robinson, to the territoria 1 limits of the Village of Tequesta. Russell moved, second by Barr and passed that the secorul reading be approved. The first reading of the ordinance having bees approved at the March 24, 1970, meeting, Ordinance No. 168 was hereby passed and adopted on second reading. The Village Clerk, gave second reading by title only to an ordinance annexing Lot 10, Block D, Jupiter Manors, Section One, os Point Drive, owned by Walter F. and Janet M. Lathrop, to the territorial • limits of the Village of Tequesta. Russell moved, second by Long and passed that the secorul reading be approved. The first reading of the -44- 3 - 4-21-70 ordinance having been approved at the March 24, 1970, meeting, Ordiga,nee No, 169 was hereby passed and adopted on second reading. The Village Clerk gave second reading by title only to an ordi- nance amending Ordinance No. 152 setting forth esaployee pension trust agreement and assessing and imposing as e$cise tax upon any insurer in accordance with Section 185.08, Statutes of Florida. Russell. moved, second by Barr and passed that the second reading of the ordinance be approved. The first reading of the ordinance having been approved on March 24, 1970, Ordinance No. 170 was hereby passed aad adopted on second reading. Russell moved, second. by Long and passed that the Mayor and Village Clerk be authorized to sign Resolution No. 4-69/?0 resting to the formation of a Council of Local Governments together with the Town of Jupiter, Jupiter Inlet Colony, Pa]m Beach County and Martin County. Mrs. William Dogger, representing the Women~s Club spoke: to the Village Council expressing that groups opposition to ec~nercial and high- rise residential development of Peanut Island in Iake Worth. She stated they had no objection to the use of the Island as an oceanographic center and believed the Island-should be used as a recreational site for Pali Beach County. The Village Manager read a resolution of the Village Council expressing the opposition of the Village Council to commercia 1 and high- rise residential development of Peanut Island. Long moved, second by • Barr and passed that the Resolution No. 3-69/70 be adopted aad the Mayor and Village- Clerk be authorized to sign the resolution. Village Attorney Lord reviewed the status of the Water Department franchises proposed to be granted the Village by Jupiter Inlet Colony and the Town of Jupiter. He advised that. the Colony would approve the fran- chise as originally written-but the Town of Jupiter Attorney was proposing that the wording as to rates include, "and sha 11 be reasonable', and a provision that all revenues received by the Water Department under the terms of the proposed franchise are to be applied to funds and accounts for the operation, maintenance and improvement of the water system and for the protection of the holders of the water revenue certificates, aad that the revenues shall not be, under any circumstances, transferred to the general funds of the Village. The Councilmen objected to both pro- visions and the Village Manager was instructed to ca 11 the Jupiter Town Attorney at the Jupiter Town. Commission ffieetiag to advise him of the feelings of the Village Council is this matter so the Jupiter Town C©maission could consider this if they had not gives the franchise .first reading. The call was made aad the Jupiter Town Attorney so advised.. Attorney Lord then discussed the Palm Beach Cable Television bond as required under the terms of the franchise. He stated they desired to make a cash bond under an agreement between Palm Beach Cable Television Company, the First Bank of Jupiter/Tequesta and the Village of Tequesta u -45- 4 - 4-21-70 • but the Bank was not agreeable to the agreement as prepared and, therefore, Palm Beach Cable Television Company advised they could obtain such an agreement with the Bank of Pa].~a Beach and Trost Company, Palm Beech, which fine the Water Department also uses. Sylvester moved, second by Barr and passed that the Mayor and Clerk be authorized to sign an agreement between Palm Beach Cable Tele- vision Company, Bank of Palm Beach and Trust Company and the Village of Tequesta providing for a cash bond to conform to the bond. as required under the terms of the franchise which has been granted to Palm Beach Cable Television Company for a cable television system for the Village of Tequesta. Upon motion by Barr, second by Russell and passed, the Village Council accepted the resignation of John T. Prince, M.-., as the Village's representative from the Palm Beach County Areawide Health Planning Council, Inc. The Vil]age Manager explained that the proposed plan-for the new Baptist Church Sanctuary on Tequesta Drive had a proposed height of 35 feet from the ground to the highest tip of the pitched roof. He explained that the side walls were Daly twenty feet (20') high. He further explained that the Village Zoning Ordinance provides fora maxi- mum height of thirty feet (30') but does not give a definition of height. The Southern Standard Building Code's description of height would make this structure fall within the Village's maximum height requirements. • To clarify the matter, Russell moved, second by Barr and passed that the th~i"ty-five feet (35') height of the proposed Baptist Church Sanctuary to be constructed on Tequesta Drive be approved. The Village Manager advised the Council of a letter from County Commissioner Culpepper advising the County would provide for signalization of the intersection of State Road No. 5 (U. S. Highway No. 1), State Road 707 and Alt. ~-1-A; that the Village office now had a xerox copying machine; two letters from the Corps of Engineers per- taining to matters in the Intracoastal Waterway south of the Village; a letter from Charles Nilson making application for a Village 4-COP beverage License. He also presented a written report to each Council- man on a meeting last night concerning solid waste disposal for northern Palm Beach County at which time the group present was advised the Jupiter dump was being closed June 1, 1970, by order of the Health Department. The Village Manager advised the Council that the owner of Lot No. 68, Tequesta, had requested a refund of $20.96 on the 19b9 taxes due town .rerror of $5,240.00 in the assessment of the property. He advised the assessment was in error. Barr moved, second by Russell and passed that the refund in the amount of $20.9b be made. ,The Village Council set 7:45 P.M., Tuesday, May 19, 1970, as the date and time for a Public Hearing to determine zoning classifica- tions for those pe~rcels of land annexed to the territorial limits of the Village of Tequesta earlier is the meeting. -46- The Village Manager advised that the Water Department engineer had completed work on the plans for the relocation of the water lines in the right-of-wa,y of State Road No. 5 (U. S. Highway No. 1), which will be made necessary due to Department of Transportation improvements to be made to the highway. Application is being made to the State Health Department for approva 1 of the relocations. The Village Manager advised of the receipt of a resolution from the Village of North Palm Beach expressing their opposition to a proposed bill providing fora single county-wide occupational license. He also mentioned the letter the Council had received from the Jupiter- Tequesta Kiwanis Club suggesting the Village take over the Kiwanis Park on County Line Road in Martin County. Mr. Robert Sattley, a resident of Tequesta Garden Apartments, suggested the Village Council consider the installation of a "stop and go" traffic signal at the intersection of Tequesta Drive and Seabrook Road. Mrs. Baker, Willow Road, questioned who was responsible for the enforce- ment of Village ordinances but would not indicate any specific instances. Mr. James B. Boynton introduced Mr. Frank Wright and asked that the Village appoint them as community relations consultants for the Village. Mayor Sylvester suggested that this matter be discussed at a workshop meeting. There being no further business, the meeting was adjourned at 10:05 P.M.
