OF THE VILLAGE OF TEQUESTA, FLORIDA
The regular monthly meeting of the Councilmen of the Vil]age
of Tequesta, Florida, was held at 8:00 P.M., Tuesday, June 16, 1970,
at the Village Hall.
Councilmen present were: Messrs. Sylvester, Long, Cunningham,
Russell and Barr. Also present were Robert Harp, Village Manager and
Clerk and ~Jillia,m A. Lord, Village Attorney.
The meeting was opened with prayer and the Pledge of Allegiance
to the Flag by May~o~°Sylv~$ter.
The Village Manager recapped the receipts and disbursements
for the eight (8) month period ending May 31, 1970, which were approved.
Balances on hand were as follows:

on the Village Ha 11 bonds and bonds for the purchase of the land east
of the Village Hall. was $26.263.95.

The Water Department statement for five (5) months ended May 31,
1970, showed total revenues of $108,478.43; total operating expenses of
$26,367.79 and debt service requirements of $56,965.66. It was recommended
that $15,000.00 of the operating account be invested.
The Village Manager presented his report for the month of
May, 1970. Building statistics were:

Police Chief Dusenbery presented the Police Department and
Civil Defense Reports for the month of May, 1970.

The Vi].]age Manager reported on the radio antenna tower being
blown down in a strong wind and that Spencer Communications had submitted
a proposal to erect a 100 foot guyed tower on top-of the center section
of the Village Ha 11, with a new high gain antenna. and new coaxial cable
for $1,100.00. Cunningham moved, second by Long and passed that Spencer
Comnunica,tions, Inc. be authorized to insta 11 new tower and antenna.
at cost of $1,100.00.
A discussion ensued on possibility of deputizing Police Officers
to police areas on Jupiter Island which lie outside the Village limits.
Residents of the area complained of drag racing and obscene language,
etc. written on the seawalls. Police Chief Dusenbery recited possible
problems for the. Police Department if members should be made Deputy
Sheriffs of Palm Beach County. The subject of lia bility was also
discussed. Chief Dusenbery was asked to meet with residents of the
area and discuss the matter and report to Council.
Mayor Sylvester expressed his thanks to the Counci Lnen and
staff for their extra work and attendance at many extra meetings.
Councilman Long reported that the Recreation Committee was
studying the Kiwanis Park proposal. Mr. William J. Taylor is Chairman
of the Committee.
The Village Manager reported the following bids had been

The Village Manager stated the engineers had reviewed the bids and
recommended that the Village accept the bid of Larry. Jarrell Construction,
Inc. Cunningham moved, second by Russell and unanimously passed that
Ia rry Jarrell Construction, Inc. be awarded contract to install drainage
at Dover Road on their bid of $1,760.28. Counci Lnan Cunningham advised
we were still waiting for drawings from engineers for installation of
new 24" drain pipe across Country Club Drive.
CounciLna,n Barr advised that the following persons had agreed
to serve on the Sign Committee as established in Ordinance No. 171:

Paul Thomson
Barr moved, second by Cunningham and unanimously passed that
these persons be approved as the Sign Committee.
The Village Clerk read an Ordinance establishing an R-lA Zoning
Classification for two (2) parcels of land owned by Louise F. Robinson
which were recently annexed to the Village. Cunningham moved, second by
• .r Long and unanimously passed that the reading be approved. All Councilmen
being present and approving the reading, Ordinance No. 173 was hereby passed
and adopted on first reading.

The Village Attorney read an ordinance establishing an R-1A
Zoning Cla,ssifica,tion fora parcel of land owned by Thomas P. Robinson
which was recently annexed to the Village. Cunningham moved, second by
Barr and unanimously passed that the reading.be approved. All Council-
men being present and approving the reading, Ordinance No. 174 was hereby
passed and adopted on first reading.
The Village Clerk read an ordinance establishing an R-lA
Zoning Classification for a parcel of land owned by Walter F. and Janet M.
Lathrop which was recently annexed to the Village. .Russell moved, second
by Cunningham and unanimously passed that the reading be approved. All
Councilmen being present and. approving the reading, Ordinance No. 175
was hereby passed and adopted on first reading.
The Councilmen discussed the application of Mr. Richard
Kreusler, owner of the Minit Ma.n Car Wash, on Cypress Drive, to sell
gasoline only from pumps at the rear of the ca,r wash.- The Village Zoning
Ordinance provides that gasoline service stations ca,n only be allowed
on U. S. Highway No. 1. Mr. Kreusler explained that this would not be
a complete service station facility, but only gasoline sales. Cunningham
moved that Mr. Kreusler be permitted to sell gasoline at the Minit Man
Car Wash at 364 Cypress Drive. The motion died for lack of a second.
Barr moved, second by Russell that the request be turned down and the
Vila ge abide by the existing zoning regulations and that the request
be reviewed by a Village planner when one is hired. The vote on the
motion was:

The motion was passed 3-2 and the request was denied.
The Council discussed the meetings that-had been held with
various professional planners to discuss planning for the Village of
Tequesta. The firms that had been talked to were:

Kendree and Shepherd
Adley Associates
Milo Smith and Associates
Barr moved, second by Cunningham and unanimously passed that Barr, Dunlop
and Associates be hired to do the Village planning as set forth in their
proposal June 5, 1970, at a minimum fee of $6,500. and a maximum amount
of $8,500. depending upon additional services to be provided. The
completed project is to include: A reconnaissance survey, designed to
acquaint the community with a positive identification of local problems,
especially those concerned with land development; a statement of pro-
perl.y formulated and pertinent local goals and policies; an existing

land use survey and analysis; a future land use plan; and.a review of
plan implementation regulations (with appropriate recommendations)
specifically the present Zoning Ordinance and subdivision regulations
at cost of $6,500. (a copy of the proposal is attached to these
Minutes). Councilman Russell and Village Manager Harp were delegated
to work out final agreement for work to be done and total cost.
A discussion ensued on the appointment of a financial planning
committee and it was the general feeling of the Councilmen that the
committee should not be appointed until the planning report has been
received. Mr. Ellis A. Simmons stated he would submit the names of
recommended members of a Village Financial Planning Committee by the
next Council meeting.
Village Attorney Lord reported on the necessity of the Water
Revenue Certificate holders to approve the franchise which Jupiter Inlet
Colony has submitted to the Village; the proposed Charter revision.
Mr. Lord said he would prepare a report on the report of the Charter
Committee.
The Council acknowledged. the. receipt of a Certificate of
Appreciation from the Jaycees.
A letter from Mr. George D. Georgopoulos, owner of the Village
Restaurant and Cocktail Lounge in Village Square Shopping Center, was
read requesting that Section 11, Village Ordinance No. 10 be amended
• to allow a lcholic beverages to be sold in the Village on the days of
Special Elections to conform to the State law. The Village Attorney
was asked to review Ordinance No. 10 for the Council.
The Village Manager reported he would be on vacation from
June 22 to July 13; a letter from Palm Beach Cable Television Company
advised they hoped to start service about mid-July;' that the cost. of
assessing and collecting taxes for 1970 had been reduced to a total of
.60 by the Palm Beach County Tax Assessor and Collector; that the plans
.for relocation of water lines in State Road No. 5 (U. S. Highway No. 1)
had been approved by the State Department of Health and Rehabilitative
Services.
The Water Department engineers annual report for 1969 had been
given to each Village Councilman.
The Village Council stated they will obtain bids for garbage
and trash disposal for the Village on a franchise basis.
Mr. Paugh reported on a recent article he had seen and read
about a total destruct waste disposal incinerator. Mr. Zielenski com-
mented on the pre-cut homes being constructed in Jupiter in the Pines
at the present time and it was stated they do conform to the codes.

Dear Mr. Harp:
As requested during our meeting Wednesday evening, we are pleased to submit the
attached proposal for a planning program designed specifically for the Village of
Tequesta.
The work program outlined in this proposal has been designed to provide-your com-
munity with an analysis of the existing land use and those factors which might be
stimulating or restricting development. Further, a review of the influences contribu-
ting to ,future development will be made so as to acquaint the community with the
growth potential of the study area.
The completed project will include: A Reconnaissance Survey, designed to acquaint
the community with a positive identification of local problems, especially those con-
cerned with land development; a statement of properly formulated and pertinent
local Goals and Policies; an Existing Land Use Survey and Analysis; a Future Land
Use Plan; and a review of Plan Implementation regulations (with appropriate recom-
mendations) specifically the present Zoning Ordinance and Subdivision Regulations.
As we have enjoyed working with communities in the Palm Beach County area for
many years, we appreciate the opportunity to present our proposal for your con-
sideration.

PROPOSAL
for
Planning Consulting Services
for the
Village of Tequesta, Florida
PROGRAM OF COMPREHENSIVE PLANNING
The firm of Barr, Dunlop & Associates, Inc., proposes to provide the Village of Tequesta,
Florida, with certain professional services as described below. The material within this pro-
posal is concerned with all the land area of Tequesta, and .such adjacent, areas as may be con-
sidered for annexation during the course of the project's completion, acknowledging that all
adjacent land use development will be investigated to the degree necessary for the proper
completion of the planning program.

SERVICES AND PROCEDURE
The general purpose of the program described in this proposal will be to provide the
Village of Tequesta with an inventory and analysis of the "study area" and its potential for
appropriately controlled development or redevelopment. All of the individual work ele-
ments which are described on the following pages have been devised to contribute to the
achievement of this general purpose through a logical sequence of investigations, analyses,
and planning performance.
COMPREHENSIVE PLANNING ELEMENTS
Reconnaissance Survey
This is the recommended initial work phase and is designed to provide both the Village
of Tequesta and the Consultant with a positive and definitive statement as to the nature of
local problems. Although problems directly related to land development in the study area
will be of primary concern, other local problems which might be ameliorated through the
application of the planning process will also be identified and analyzed.
• It is felt that this type of beginning endeavor can be of great benefit to Village officials
a11d interested citizens alike, as well as provide the Consultant with knowledge essential to a
meaningful performance of the remaining work elements.

Goals and Policies

Based on the results of the previously-described work element, as well as close contact
and meetings between the Consultant and the Tequesta Planning and Zoning Board, a state-
ment of goals for future development and the policies which can bring them about will be
prepared. These goals and policies, arrived at through the efforts of both the Consultant
and the community, would also serve as guidelines for the Consultant's further work and
should, at the same time, stimulate the interest of the community.
Survey and Analysis of Existing Land Use
This study element will be concerned with the investigation, description and analysis
of Tequesta's physical development and is a necessary prerequisite to planning for the future
land use of the Village. The Consultant will prepare a map showing existing land use on a
lot-by-lot basis for all land development such as residential, commercial, industrial, and
public uses including parks, schools, municipal buildings, etc. Factors restricting the use of
land due to poor soils or lack of drainage will also be identified. This map will depict cur-
rent development trends, aiding both the community and the Consultant in arriving at re-
quirements for the Future Land Use Plan.
Land Use Plan
Drawing from the research and analyses of the previously-described comprehensive
planning elements and embodying the local objectives of the Village of Tequesta, the Land
Use Plan will reflect a carefully prepared projection of future land requirements for expan-
Sion, development, or redevelopment witlun the study area. Because the relationship be-
tween various land uses is extremely important to the community's overall development,
the Land Use PIan will show the proposed location, extent, and intensity of the future de-
velopment of land to be used for residential, commercial, industrial, public, and other uses.
It will, at the same time, provide standards which will help assure sound and aesthetically
pleasing development.
Plan Implementation
Effective plan implementation requires the coordinated efforts of community leaders
and local citizens. In addition to achieving a meeting of minds in the adoption of a plan
for the .future, the proper tools must be available to effectively carry it out. The basic tools
for implementation include:
1. zoning ordinance
2 subdivision regulations
The Consultant will review and evaluate the existing zoning ordinance and subdivision
regulations as they relate to development in the study area to determine if changes should
be recommended for consideration. This review will be accomplished in the light of the
then newly-developed Land Use Plan, with an emphasis upon recommendations aimed at
furthering effective plan implementation.

MEETINGS

The Consultant will meet with Village officials and the Tequesta Planning and Zoning
Board four (4) times during the progress of the proposed planning elements, the exact
schedule of these to be arranged by mutual consent of the Consultant and the Village. The
first meeting, however, should be for presentation of the proposed planning program, in-
cluding aninformative discussion of comprehensive planning. Other meetings will be sched-
uled for such purposes as data collection, goal-policy formulation, reviewing the research
and analysis material during the various phases of the plan, and presenting the final plan.
Ease of communication between the client and the Consultant will be greatly facilitated
by the fact that the firm maintains a permanent office in the South Florida area (located in
the City of Hollywood), in addition to the office in Tallahassee. The South Florida office
will provide a closer working relationship and can further serve to expedite Consultant
services.
REPORTS
The Consultant will prepare and submit thirty-five (35) copies of the finalized Plan
Report to the Village officials, along with one hundred (100) copies of a large foldout
public information sheet illustrating the Land Use Plan. The scope of the report will en-
eornpass all elements of the complete plan -from the previously-described analyses of
existing conditions and problems, through the completed plan for whatever target year is
mutually decided upon. This report will also include the goals and policies which were
used in arriving at the final plan. Text material will also describe the analyses of all per-
tinent factors which may stimulate, control, or deter future development. If additional
copies of the report are desired, they will be provided at cost.
PROJECT STAFF
The responsible planner for the proposed study will be Mr. Frank W. Brutt, Vice
President-Planning -Barr; Dunlop & Associates, Inc. Mr. Brutt's education includes the
Bachelor of Science and the Master of Urban Planning Degrees. His experience includes
ten years of professional planning; during which time he was responsible for the Comprehen-
sive Plan for Hot Springs-Garland County, Arkansas; the physical design for the Little Rock
Metropolitan Area Comprehensive Plan; and the .supervision of the Knoxville-Knox County
Projected Land Use and Master Street Plan. Mr. Brutt also has been and is the responsible
planner for a number of successful comprehensive planning projects within the State of
Florida.
The Project Planner for the proposed study will be Mr. Patrick J. Nardi, the planner
• who is the Resident Manager of the firm's South Florida office in Hollywood. Mr. Nardi's
professional experience includes employment as Assistant Director for the City of Dekalb;
Illinois, Department of Community Development as well as experience gained as Planner III

Administration.
Parks, recreation, beautification, and landscape considerations will be the responsibility
of Mr. Robert A. Williams. Mr. Williams' education includes the Associates Degree in Build-
ing Construction Technology, the Bachelor's Degree in Architecture, and the Master's Degree
in Urban Planning.
Additional information on the above staff members may be obtained from the firm's
brochure.
In addition, as they may be needed in this study, the Consultant will call upon other
staff specialists, including a well .qualified drafting section, and other support personnel.
SCHEDULE
If, during the course of the project, it appears to either party that an increase in scope
or amount of services will be desirable, or that work not presently contemplated will be
necessary to complete this project, this will immediately be brought to the attention of the
other party, and, if desired, negotiations will be undertaken for the additional work.
SPECIAL PROJECTS
Discussion between the Village officials and the Consultant has indicated the possible
need for special consultant activities beyond the scope of the Planning Program, such as the
review of zoning petitions, the acquisition and development of recreations sites, etc.
with the Tennessee State Planning Commission. His educational background includes the
Bachelor of Science Degree in Urban Planning and the Master of Arts Degree in Public
The Consultant agrees to begin the study within ten (10) days after being awarded a
contract and to complete the study within approximately five (5) months. The schedule is
based on the condition that the Planning and Zoning Board and Village officials can pro-
vide timely review of the various work phases. However, in the event that there is an un-
avoidable delay on the part of the Village to review the necessary support data, a reasonable
extension of contract time shall be granted.
The Consultant will be available to perform special projects as desired and authorized
by the Village. Payment for such services will include out-of-pocket expenses and a per
diem rate as indicated below:

FEES
The Consultant's fee for the above-described services shall consist of the lump sum
amount of $6,500.
If, during the course of the project, it appears to either party that an increase in scope
or amount of services will be desirable, or that work not now contemplated will be necessary
to complete this project, this will immediately be brought to the attention of the other party,
and, if desired, negotiations will be undertaken for the additional work..
The fees shall be paid upon receipt of monthly progress billings from the Consultant
upon approval by the Planning and Zoning Board. Such billings shall be .supported by
monthly progress reports.
ADDITIONAL SERVICES
If the Village of Tequesta desires to expand the scope of services, we would suggest the
following work items:
Annexation Policies

Because of the proposed comprehensive planning program for the Village of Tequesta
includes a concern for not only the land area of the Village itself but also such adjacent
areas as may be considered for possible annexation, the Consultant will develop a set of
specific annexation policies related to these areas at the same time that the plan for the
future land use of the study area is being developed. Such an arrangement of simultaneous
performance activities would profit from the definite advantage of intimate Consultant
familiarity with the areas being considered for annexation. The annexation policies devel-
oped by the Consultant would include the establishment of acceptable guidelines such as
annexation for positive reasons only, equitableness of annexation moves, utility services to
annexed areas, annexation of territory of adequate size for efficient planning and installation
of public utilities, and maintenance of regular municipal boundaries.
Improvement Program
The purpose of this item is to relate municipal finances to community improvements by
setting forth a method for scheduling and financing those public improvements which should
be realized in the next five years.

• With the expanded scope of services, the Consultant would plan for an additional
meeting with the Village officials.

The Consultant's fee for the additional services stated above shall be $1,500. Payment
of this fee would be in a similar manner to the main work program.
If the above-described Consultant services and schedule are found agreeable, the Village may
achnowledge its acceptance in the space provided below.

ADDENDUM TO PROPOSAL

1. As part of the proposed ,Planning Program, the Consultant's traffic engineer
will review, analyze and make recommendations to assist in alleviating any traffic .
problems.
2. As part of the Land Use Plan, the Consultant will review the existing Com-
munity Facilities (Parks, fire service, etc.)- and make recommendations for sug-

3. The Consultant will, as part of the Survey ,and Analysis of Existing Land Use,
identify: sanitary and .surface drainage problems and how they ,restrict develop-
ment; conflicts between various land-uses, i.e. the industrial .strip-adjacent to the
railroad and other land development.
4. _ ~ The Consultant will also briefly review, the new, Village charter as well as
Village personnel as they ,relate to community facility. and code administration
and enforcement.
5. The Consultant will prepare. sixty-five (65) copies of the finalized .plan report.
