The regular monthly meeting of the Councilmen of the Village of
Tequesta, Florida, was held at 8:00 P.NI., Tuesday, October 15, 1968, at the
Village Hall. Councilmen present were: P~desars. Sylvester, Valier, Long
and Cunningham. Also present were Robert Harp, Village Manager and Village
Clerk and Village Attorney tJil7ia~~ A. Lord.
The meeting was opened with prayer and the Pledge of Allegiance
to the Flag by Councilman Long.
The Minutes of the regular r::eeting of September 17, 1968, and
the Special Meeting of September 30, 1968, were read and approved.
Counci]man Cunningham moved, second by Valier aad passed that
the detailed reading of the financia 1 report for September, 1968, be
~~aived. The Villa a Manager reca,paed the receipts and disbursement
x"or the twelve (12~ months period ending September 30, 1968;-and upon
motion by Long, second by Yalier and. passed, the financial statement and

Mayor Sylvester presented his report for the month of September
itientioning the proposed franchise for .~upiter Inlet Colony; advising that
a group from Jupiter Inlet Colony had approached him about purchasing bulk
water from the Water flepartment. =-ie discussed the proposed liurary for the

area and appointed Thomas L. Clea~:lons, :parry INT. Gifford, Jr. and l~lrs.
~:elen G. Schull as the Village ~ s representatives on a Citizens Con~nittee
to study the library proposal i°urther and report back to the Council.
~-ie mentioned that Pdichols Sanitation eras trying out a new piece of equip-
ment and open trucks for the pick-up o~ yard trash.
Councilman Long stated he had been receiving complaints about
the yard trash pick--up and would like to see the service be improved.
ise reported on beautification of the railroad right-of-way at Tequesta
Drive and the Mayor and Village t=anager here authorized to work on a plan
not to exceed $500. for this work. Councilman Long stated that he be-
lieved a group of :idgewood property o~mers should be formed and the
Village should assist in the beauti~ication of Ridgewood street entrances.
Councilman Cunningham reported on CCG and that an attorney and
engineer had been retained to do pre].inunary work on the formation of
a water and sewer district.
CounciL~naan Valier reported on progress for an area library anti
the COG Utilities Committee.
Mayor Sylvester advised that representatives of Tri-Southern
Utilities would like to meet with the iTilla.ge Council at a workshop meeting.
Chief Dusenbery presented the ?olice Department and Civil Defense
deports for the month of September and also presented the annual reports
for these Departments and was comr:~ended for them.
• Earl Owen and Samuel Darker, of ~ roclcway, Owen and Anderson
Engineers, Inc., appeared before the Council with a drainage study they
had been authorized to make to alleviate the very bad drainage condition
that exists at the intersection o-i Tequesta Drive and Seabrook :load. It
ti~as their opinion that the only proper way to provide for this drainage
would be basically according to the Man as presented in their May, 1967
Comprehensive Engineering Report for Drainage Improvements Program for
the Village. They proposed four (~) catch basins, one on each corner
of the intersection; a drainage pipe and. catch basins on Tequesta Drive
west of Seabrook Road to pick up sorie of the v~a.ter that collects along
Tequesta Drive; running a line north along Seabrook :toad, then west in an
open drainage ditch to Riverside Drive then in pipe under diverside Drive
and out to the Loxahatchee River. They estimated this project would cost
a total of $113,802. without easements. Cther methods to accomplish this
drainage at considerable lesser cost were suggested 'oy persons in the
audience and Councilmen but the engineers stated these would be only very
temporary stop-gap measures and would not do the proper job. The Village
Council decided to look into methods of financing this immediately needed
improvement and to consider a bond. issue to complete the balance of the
proposed drainage for the entire Village and other necessary capital
improvements. Discussion was also directed to other areas in the Vi1la,ge
where drainage problems exist.
The Village Cleric gave second. reading to an ordinance by title
only amending the Zoning Ordinance to provide for the construction of
australian pine hedges on property.zonec' C-1 and C-2, that lie adjacent
to residential property; providing rot the size, location and time of
planting; and providing pane lties nor the violation thereof. Valier

moved, second by Cunningham and passed that the second reading of the
ordinance be approved. The first reading of the ordinance having been
approved at the September 17, 1968, meeting, Ordinance ho. 149 was hereby
passed and adopted on second reading.
Attorney Lord discussed the ordinance he had been directed to
write to regulate the parking of boats, boat trailers and fold-down tent
trailers on public and private property within the Village. He discussed
that a developer of property could set restrictions on the use of his
property which a purchaser would have to adhere to. He further stated
that a regulatory ordinance could 'De written if the health, safety and.
welfare were involved but to just control the parking because the boats
do not look nice parked in residential areas might not fall under the
police powers of the municipality. Attorney Lord, Councilman Cunningham
and Village Manager Harp will give the natter further study and present
their findings to the Council.
The Village Attorney discussed the proposed purchase of 15 acres
of ]end lying south of County Line Load and east of Old 7ixie Ftighway from
Thomas H. Simmons and wife, to be used as future well field sites for the
t~Jater Department. He stated the proposed agreement covers a five year
period at a tots 1 proposed cost of x71,250. for the 15 acres. Upon pay-
ment of $13,750. and a non-interest 'Dearing note in the amount of $10,000.,
payable in one year, the Village will receive a deed to the south five (5)
acres of the plot and option to buy four (4•) additional parcels of t~~o
and one-half (2 1/2) acres each upon payment of a total of $11,875. for
each additiona 1 2 1/2 acres. The proposed agreement provides that pre-
• payment can be made at a discount.- 's'he agreement also gives the Village
permission to sink wells for the purpose of testing the quality of the
water and the supply of water.
Valier moved, second by Cunningham and passed that the Village
purchase a 15 acre tract of land from Thon~a.s :i. ain~nlons and his wife,
i~elen Louise Simmons, at a total purchase price of $71,250. under an
option agreement covering a five year period. The purchase is to be
subject to the tit'ater Departments engineers, Brockway, Owen ~ Anderson
engineers, Inc., certification that water is available in the 15 acre
tract and that the water is potable and the H:ayor and Village Manager
are hereby authorized to enter into said agreer.~ent with the sellers.
The Village Nfanager reported that specifications fora 1969
police car had been sent to John i~~a.tthews :+ord; Bev Smith, Inc.; Florida
Chrysler-Plymouth and roger Dean Chevrolet requesting bids for the car
on which the 196? Plymouth is to be trade. The only bid received was
from roger Dean Chevrolet at a net price of $1,762.58. Valier moved,
second by Cunningham and passed that the Village Manager be authorized
to purchase a 1969 Chevrolet Biscayne ~~ door sedan for the Police Depart-
r^~ent at a net price of $1,762.58 from roger Dean Chevrolet.
The matter of revision of the Village ~ s plur.-~bing code to perr~.t
the use of PVC was further discussed. ~, letter from Donald Osha, ErockE~ay,
Owen F~ Anderson Engineers, Inc., was read on their preliminary findings on
the subject. Councilman Cunningham, Councilrca n Long, Village Manager %arp,
and Euilding Inspector Lou Laliberte are to meet with a committee of
plumbers to study other municipal plumbing codes and prepare a plumbing
code to be presented to the Village Council for their consideration.

Mr. Paugh reported that the COG Utilities Comruttee was tr~*ing
to arrange a meeting ~,rith their attorney to discuss the proposed ws.ter and
sewerage district,
The Council were advised that the Health Department had denied
the application of the Water .Department to drill a new well in Well Field
Flo. 1 because it could not be located at least 100 feet from possible
future septic tanks. He stated that Mr. Ostia had asked if there was some
way that the Village could control the location of future septic tanks
in that area and the Village Attorney was of the opinion that the only
way the Village could control this would be to provide a main sewerage
line for the affected properties.
No further progress was reported on the proposed purchase of
the Jugiter-Tequesta Junior Citizens property as a possible 'Village re-
creation area .
There being no further business, the meeting was adjourned at
10:40 P.M,
