The regular monthly meeting of the Councilmen of the Village of
Tequesta was held at 8:00 P.M., Tuesday, December 1T, 1968, at the `.Tilla.ge
::all. Councilmen present were: Messrs. Sylvester, Bowden, Long and
Cunningham. Councilman Valier was absent. Also present were T'•obert Harp,
Village Manager and Clerk and Mr. James t-Jinters from la,w firm of 4linters,
Brackett and Lord in attendance for Attorney T-;ti.lliam A. Lord, who was ill.
The meeting was opened with prayer and the Pledge of Allegiance
to the Flag by Mayor Sylvester.
Mayor Sylvester advised that NIr. 'vJinters had other commitments and
therefore the Council would first consider any items he might have so he
could leave as early as possible.
Attorney Jinters reviewed the r::a,tter of a possible amendment
t° the Village Charter that would permit additiona 1 nu lla,ge beyond the
five (5) mill limitation in the e-:fisting Charter. The Councilmen had
been given a letter from Mr, John T. Trimble, Counsel for the firnl of
Fdinon, Mudge, hose, Guthrie, Alexander r,~ Mitchell, Flew York, New York,
which gave his opinion that the Village could only assess a maximum of
five (5) mills for all purposes under the existing provisions of the
Charter and proposed that the Village present amendatory and supplemental
legislation to the 1969 session of the State Legislature to more clearly
spell out the financial procedures for the Village to follow. The Village
Attorney and Fiscal Agent were in agreeiuent and it was their opinion that
the amendatory language should be prepared by Mr. Trimble. The proposed.
amendment would be subject to a referendum of Village of Tequesta voters ~~
• prior to final approval. Bowden moved, second by Cunningham and passed
that the Village Attorney be authorized to have Mr. John T. Trimble
prepare necessary amendatory document to provide for financial procedures
for the Village and for same to be submitted to the 1969 session of the
State Legislature for approval.
Councilman Boirden suggested that perhaps now was the time to
submit legislation to amend the Village Charter to provide for a third
voting ward east of U. S. Highway Flo. 1. owden moved that the Village
Charter be amended to establish a i,hird voting ward lying east of U. ~i.
lfighway No. 1. The motion died for lack of a second and it was the
general opinion of the Council that a population study of the areas
should be made prior to such a change.
Attorney [-Jinters advised that it is a mays a good policy to
have each session of the State Legislature approve a re-definition of
the Village boundaries to include any annelca.tions which had been made
since the boundaries here last defined. oi•~den moved, second by Long
and passed that the Village Attorney be authorized to have the necessary
legislation prepared to present to the 1969 session of the State Legis-
l~.ttare to re-define the Village boundaries.
The Village Manager advised that he would consult ~,~ith
~-ttorney Lord to see if there are any other Charter ar~~endments which
should be made.

private property ~::-ithin the Village. The Ordinance describes various types
o~ trailers and provides that travel trailers, camper trailers, boat
trailers not in excess of ttaenty-si.~ (26) feet i~ length and cargo trailers
not in excess of fourteen (l~;•) feet in length shall be permitted to par?~
on private property provided they are: (1) located behind the front
building line, its most fors:~a.rd projection not less than twenty-fire (25)
Beet from the front line and in the case of corner lots, the setbabk shall
be t~~enty-five (25) feet from the front line and twenty (20) feet from the
site street line; or, (2) located in a carport or garage. The Ordinance
also provides that no trailer or miobile home shall be parked upon any
public street, part; or other public property r:~ithi n the corporate limits
of the Village for more than taro (2) hours and shall not be used for
sleeping, housekeeping or living quarters while so parked. Construction
trailers shall be permitted during the period of construction only after
a pen~it for the construction job has been issued. Several minor changes
~~ere made in the language of the Ordinance. Cunningham moved, second by
i~o~.~den and passed that the first reading of the Ordinance be approved.
Attorney T'inters read an Ordinance providing for the adoption
of the Plumbing Code for Palm Beach County,I~lorida, as adopted October 29,
1968, as the Village of Tequesta Plumbing Code with several amendments
that had been approved by a coimnittee consisting of Councilmen Long and
Curmi.ngham, Building Inspector Ls,la.berte and several plumbers. The code
~~ill permit the use of PVC under certain conditions. Cunningham moved,
second by Long and passed that the first reading of the Ordinance be
approved.

ase had been approved by the Council at the Alovera-
ber meeting. Each Councilmia,n had received a letter dated December 6
1958, from Attorney Lord detailing the proposed method of purchasing the
property. The Village Hla.nager read the letter which stated that after
a doz~m payment of $3,000.00 a Ta~c ~.nticipation Certificate in the arlount

~~rould be issued to the seller. The balance tirould hoefully be included
in the Capital Improvements prograrm and could be paid, together erith
accrued interest, on or before the c,ue date. If these funds are not
available, the seller would accent vatic' obligations of the Village payable
in December of succeeding years in accordance with the following schedule:

Bowden moved, second by Long and passed that the reading of
the Minutes of the November, 1968, A~Ieeting be waived.
Cunningham moved, second '~y vo~~,*den and passed that the detailed
reading of the financial report for Tdover~'~er, 1968, be iaaived. The
Village Manager recapped the receipts and disbursements for the tE:*o (2)
month period ending November 30, 1968, and upon motion by Eowden, second
by Cunningham and passed, the financial statement and disbursements-for
the month of November were approved. Balances on hand at November 30,

The tiaater Department financial s~.atement for nine (9) months
through November 30, 1968, sho~,~ed total revenues of $150,084.13 and total
e:~sjenses of $93,92•.09.
The Village A~ia,nager presented his report covering activities
for the month of November, 1968. The report shop<red that approximately
80~ of the 1968 Tax Roll had been collected. Building statistics for

Mayor Sylvester presented his report for Rlovember, 1968,
spearing of a movement for a post office i_a the Tequesta area. The
local post office estimates 70% of the ]ikl.il usage is by Tequesta. I-Ie
rlerltioned the 6Jorkshop Meeting a'c ~>>hich ~rard trash pick-up eras discussed
and the problems ~,~ith this based upon various wants of various residents
or groups of residents in this regard anc? that the only feasible method
of keeping the trash piles to a minircun'ri ~rotald be through more pick-ups
at additional cost. He also raentiozed the desires of some of the resi-
dents of ~~ratert~ray Village to be anne.,ed into the Village of Tequesta.
Councilrra,n Cnnni ngha,m re,~ortec that CCG had not met since their
l.s.st meeting.
Councilr:~an Borden stated he would like to discuss the possibility
of a water rate reduction or adjustment based upon figures ~rhich he has
cor::piled with the Water Department Fiscal Agent, Engineers and Village
Attorney and the Council decided to hold such discussion at the January 1~,
1969, L~orkshop Meeting. He asked some further questions of the Village
~~,nager concerning the financial statements.
Police Chief Dusenbery.presented the Police Department and
Civil Defense Reports for Alovember, 1968.
The Village Manager presented a letter and dra~ying of a Deve-
lopers Sign for which Resort Properties, lnc. ~~~as requesting a permit for
erecting the sign on roof of their model apartment located at corner of
Tequesta Drive and Seabrook oad. Cunningham moved, second by Bo~Jden
• and passed that a Developers Sign ~'ermit be issued for a period of three (3)
months upon receipt of proper application and fee.
The Village Manager advised that Ivr. Isarry ld. Gifford, Jr. and
Mr. nay D, Shiplett had agreed to serve on the coning Board of Adjustment
if re-appointed. Eowden moved, second by Cunninghar.~ and passed that
Ia~r. Gifford and Mr. Shiplett be appointed to the Village of Tequesta
coning Board of ~:d.justment for terr_ of three (3~ years corc~~encing
January 1, 1969.
The Village Manager was authorized to obtain bids fora 1969
station ~~,gon for the :rater Depart:~ent lkperintendent to replace the
1966 Falcon Ranchero truck.
The Village Manager advised that the annual audit report for
the Village of Tequesta General I4,~nd, Sinl~ing Fund and I~escrve Account
for the fiscal year ended eptem'oer 30, 19c8, as prepared by P~lowlen, Lynch ~:
Ste~~~art, had been received and distributed to each Councilman. Bowden
rnoved, second by Long and passed that the audit report be accepted.

The Council eras advised the t'~Tater De~~artr~~ent Engineers had concurred in
this budget and were reminded that the proposed new well for Udell Field
T?o. 1 had been turned do~~n by the lealth Department and that another net~r
Zell ~;~,s needed at the present tune. long n.oved, second by Bowden and
passed that the capital budget for the Mater Department for 1969 in the
amount of $67,875.00 be approved and that the Village Manager be authorized
to have the [:rater Department Engineers g~roceed with getting .dell No. 11
connected into the ~~~ater system.
The Village Manager advised that the test ~:~ell had been drilled
at the new well field site and preliminary reports indicated a very good
quality of j:~a,ter. The well was being tested for GPM today to determine
the adequacy of the supply. 11:00 ~i.M., rriday, December 20, 1968, has
• been tentatively set as the tiyne for closing for the purchase of the well
field site from Simmons- subject to favorable engineers report on the
test well.
The Village Manager advised that the final report of the
Ooverz~mental Study Cornnission of ~'aln~ Reach County, Florida, had been
received.
Mr. Paugh reported that them had not been any recent COG
meetings and a preliminary report for eater and sec.~erage district iras
expected to be received sometime in Janl~ary, 1969.
Mr. Joe Elizzard requested that the plumbing contractor for the
l~,tneral Home under construction on mequesta Drive at Cypress Drive be
permitted to do the plumbing t~rork Luzder the terms of the new plumbing
code which the Village intends to adopt. Cunningham moved, second by
Botaden and passed that this action be approved.
Members of the audience and the Council discussed the frequent
blocking of Tequesta Drive by the Florida East Coast Railway Co, trains
and the effect such blocking could have on the health, welfare and safety
of the citizens of the Village. The Village Manager is to contact the
Village Attorney about an Ordinance to control such blocking.
There being no further business, the meeting ~,~as adjourned with
best ~:~ishes for the holiday season conveyed to all residents of the Village.
