MINUTES OF THE I~ETIT~ 0~' Tt~.~ COUAICILP~IETa OF THE VILLAGE OF TEQUa+.3TA, FLO~.IDA ~~ L The regular monthly meeting of the Councilmen of the Village of Tequesta was held at 8:00 P.M., Tuesday, February 18, 1969, at the Village Mall. Councilmen present were: Messrs: Sylvester, Valier, Bowden and Cunningham. Councilman Long was absent. ~:lso present were P..obert Harp, Village Manager and Clerk and William A. Bord, Village Attorney. The meeting was opened with prayer and the Pledge of Allegiance to the Flag by Councilman Eowden. Cunningham moved, second by BoE~den and passed that the reading of the Minutes of the previous meeting 'oe tvaived. Valier moved, second by Cunningham and passed that the detailed reading of the financial statement for .anuary, 1969 be waived. The Village Manager recapped the receipts and disbursements for the four (~) month period ended January 3I, 1969 and upon motion by T~owden, second by Valier and passed, the financial statements and disbursements for January were approved. Balances on hand at January 31, 1969 were as follows: First Bank of JupiterfTequesta Petty Cash Community Federal Savings and loan Association Fidelity Federal Savings and Loan Association U. S. Treasury Bills Account Balances were as follows: Operating Account Petty Cash Streets, Roads and Drainage ~aund Capital Fund Developers Security Deposit $28,617.23 25.00 13,583.25 14,010.73 34,397.01 $90.63322 $73,872.57 25.00 5,880.32 7,225e33 _ 3.630.00 $90.633.22 The Sinking Fund balance for payment of principal and interest on the Village Nall Bonds was X18.180,81. The Water Department financial statement for one (1) month showed total revenues, of $15,878.63 and total expenses and required fund transfers of $14,106.54. The Village Manager presented his report covering activities during the month of January, 1969. The resort showed (1) final payment made for test well in new well field on Old Dixie; (2) fir~a,l payment made to contractor for completion of i-~ork in connection with relocation of ETater line under Intracoasta 1 Waterway; (3) annua 1 contribution of $500 made to Jupiter-Tequesta Chamber of Comeierce; (4) order far 1969 4-door Plymouth station wagon for Water .Department Superintendent placed with Florida Chrysler-Plymouth; (5) letter written to engineers on water line relocation project to see if FIND would reimburse Village for cost of the relocation. -23- 2 -- 2-18-69 ~:uilding statistics for January, 1959, were: Januarv 1969 Xear to Date X10. Upon motion by Bowden, second '~y Cunningham and passed, the Council approved Brockway, Owen ~ ~:nderson Engineers, Inc. to prepare a formal request to the Florida Inland i?avigational District for re-iriburse-- ment of the cost of the relocation of the waterline across the Intracoastal ~'Jaterway. It was reported that the Village had paid $78.75 to Attorney George Bailey for work on the COG water and sewer feasibility report. Mayor Sylvester reported on progress toward obtaining a post office for Tequesta and urged all residents to write to Congressman Paul Rogers urging the location of a post office in the Vil]~.ge. A petition was suggested but it was the Councils feelings that individual letters juould be more effective. Attorney Lord is to work out a sample resolu- tion or letter that could be used by the residents to shoF~ their desire for a new post office in the Village. j Councilman Cunningham reported that COG had referred CATV and communications back to committee for further study. Bowden moved, second by Valier, that this Council thought a third ward located east of U. S. 1-:ighway Tdo. 1 should be established. The motion was passed with Sylvester, Bowden and Valier voting for and Cunningham against. Attorney Lord stated the Village Charter would have to be revised to provide fora third ward and that it was too late to present the proposed revision to the Palm Beach County Legislative Delegation for action during the 1969 Session of the Legislature. ire advised that since the Legislature will now meet annually, the revision could be presented to be considered by the 1970 Session of the State Legislature. Councilman Bowden read a letter addressed to the Village Cotaricil discussing water rates and the meeting the Councilmen had on February 8, 1959, ~,rith Mr. George W. Offutt, III. Several members of the audience spoke about the water situation repeating discussions and statements made at prior meetings. Mr. Eckes was advised that a person officially authorized, in writing, by the Commissioners of the "i'o~;rn of 3upiter would be permitted to examine the records of the Dater Department as pertain to the amount of 6~ utility tax collected and reiaitted to the Town of Jupiter under Ordinance No. 163. Mr. Eckes advised it was his understanding that Plantreat, Inc. eras not registered with the Florida ~'ublic Service Commission and suggested that the Village Council take steps to see that they do register and cone under the supervision of the Public Service Commission. -24- 3 - 2-18-69 Police Chief Dusenbery presented the Police Iepartment and Civ?1 Defense Reports for January, 1969. Attorney Lord advised that he did not have copies of the revised trailer parking ordinance and revised plumbing code ready for second reading. The Village Manager read a resolution which expressed the Village Councils opposition to the Governmental Study Commission proposal to abolish the Jupiter Inlet District and to include its functions within a proposed County-wide transportation authority. Valier moved, second by Cowden and passed that the resolution be adopted. The Council was advised that the Tri-ConIInunity Library Association had requested the Village to appoint three members to represent the Village of Tequesta to the Board of the Association. Upon motion by Cunningham, second by Valier and passed, the following were appointed as Village of Tequesta representatives: Thomas E. Clemons -One (1) year Until RTOVeriber 1969 Nirs. Helen G. SChull - Two (2) Vears until November 1970 Harry N. Gifford, Jr. - Three (3) years Until November 1971 Village Attorney Lord. advised the Council that the proposed Charter amendments were scheduled to be presented to the State Legislature in N1a.y. • The Village Attorney read a letter to Nir. Offutt providing for the delivery of additional Water revenue Certificates based upon earnings of the eater Department for the 10-month period ending December 31, 1968, dividing by 10 and multiplying by 12. This would provide a method of deter- mining a method of determining the number of Revenue Certificates which would have been delivered as of Janua ry 1, 1969, had 12 months experience existed. The letter further states that as of N;a.rch 1, 1969, an actual history of 12 months gross revenues will have elapsed and the number deliverd will be adjusted at that time. Cunningham moved, second by fsowden and passed that the Mayor be authorized to sign the letter. Attorney Lord advised that the closing for the purchase of the land east of the Village Hall from the Offutt Trust would probably take place within the next several days and he read a Ta-; Anticipation Certifi- cate in the amount of $27,000. to be issued to the Offutt Trust together with $3,000. in cash at time of closing, said certificate due 5epternber 30, 1969, with provision that if the Village is unable to pa,y the Certificate on said date that the Village would issue Revenue Certificates previously approved and validated, derived 3rom uti 1ity, franchise and cigarette taxes and assessed by the Village payable 9-30-1970 $5,350. 9-30-1971 5,150. 9-30-1972 x',,950. ~ 9-30-1973 5,750. 9-30-1974 5,500. 9-30-1975 5,250. Cunningham moved, second b9' Valier and passed that the Mayor and Village Clerk be and are hereby authorized to sign the Tax Anticipation Certificate for delivery to the Offutt Trust. Attorney Lord stated he had not attempted to provide a Charter amendment to provide for different annexations Since it was anticipated that the Florida League of Municipalities was working to have the State Legislature adopt a general act which could be ,used by the municipalities. Attorney Lord advised that he had prepared forms to provide for a utility easement between Lots 10G and 107 and Lots 133 and 134, Tequesta Subdivision. A water line is located at this place which was formerly a road right-of--way. Valier moved, second by Bowden and passed that the easement forms be presented to the owners of the lots for their signatures. The Village Manager stated that Designed Traffic Installation Co. had proposed to install a flashing beacon traffic signal at the intersection of Tequesta Drive and Riverside Drive for total cost of $1,469. using concrete poles and new equipment; of $1,254. using used equipment, both with one (1) year warranty. Bowden moved, second by Cunningham and passed that Designed Traffic Installation Co. be authorized to make the installa lion with used equipment at a total cost of $1,264. and that the budget be amended to allow for this purchase and payment to be made from the Capital Fund. The Council was advised that Brockway, Owen ~ Anderson Engineers, Inc. are preparing a sketch for proposed drainage at Tequesta Drive and Seabrook Road. The Council wa.s advised of a proposed meeting of the Village Council, Tequesta Country Club Golf Course drainage Committee, Tequesta Country Club C~,.r..,.zxiity Association, Inc. representatives and representatives of Brockway, Owen and Anderson Engineers, inc. to discuss possible special assessment program to provide drainage for Syster~l 4 as described in engineers report of Ma,y, 196?. - The Council i~as advised that the estate ltioad Department had been requested to rrn,ke a study of the intersection of State :load 5 (U. ~. Pdo. 1 and .bridge Road) for the installation of a "stop and go" signal; that the Voter ?egistration Books closed at 13:00 ~'.3~a., Friday, February 14; tP~at candidates for election at the March 18 General Election can file until 5:00 P.pi., February 28; that two Street lights had been ordered for Golf Vier Drive, one for diver Drive and one for Fiesta and Daly Goad and that Palm Beach County Tax Assessors office personnel would be at the Village :tall, Monday, Mardi 10, 1469, to accept a,~plica,tion for homestead exemptions. The Council was also advised that the next regular Council meeting would be Tuesday, March 25 instead of March 18, erhich is Election Day. H1r. Paugh reported on COG AJtilities Committee activities. Mr. Middleton requested the status of CPTV and was advised COG had referred it back to committee. There being no further business, the meeting was adjourned at 3(3:25 PM.
