OF THE VILL~~ OF TLQU~STA, FIAi~IDA The regular monthly meeting of the Councilmen of the Village of lequesta, Florida, was held at 8:00 P.Ni,, Tuesday, April 15, 1969, at the Village Hall. Councilmen present were: i~essrs. Sylvester, Bowden, Cunningham and Simmons. CounciLna,n Long had advised that he would be working. Also present was Robert Harp, Village Njanager and Clerk. Village Attorney Lord was absent. The meeting was opened with prayer and the pledge of allegiance to the flag by the Village Manager. Cunningham moved, second by ~otaden and passed that the reading; of the Minutes of the last meeting be waived. Cunningham moved, second by ~:owden and passed that the detailed reading of the financial statement for the month of March 1969 be waived. The Village Manager recapped the receipts and disbursements for the six (6) months period ending Nla,rch 31, 1969. The Village Manager is to discuss the matter of the payment for water line relocation with the Village auditor. Bowden moved, second by Cunningham and passed that the financial statement and disbursements for March 1969 oe approved. Balances on Hand at March 31, 1969 were as follows: First Bank of Jupiter/Tequesta $29,794.82 Petty Cash 25.00 Community Federal Savings and g.oan 13,736.06 Fidelity Federal Savings and ioaiz 14,168.34 U, S. Treasury Bills 29.552.10 $87.276.32 Account balances were as follows: Operating Account $73,515.67 Petty Cash 25.00 Streets, Roads and Drainage gaund 5,880.32 Capital Fund 4,225,33 Developers Security Deposit 3,634.00 $87 . `1,76.32 The Sinking Fund balance for payment of nrincipa 1 and interest on the Village Hall Bonds was $18.121.41. The Plater Department financial statement for three (3) months showed total revenues of $51,882.05 and total expenses of $29,115.23 and transfers from the revenue fund of $46,165.31 (these are revised figures). There was discussion as to the form of the statement and accrual of interest on treasury bills and notes. The Village A~Ia,nager krill revise the form of the statement. Mayor Sylvester reported on worl~ of the area Library Committee; recreation program and area recreation facilities; dogs; citizens partici- pation in Village activities; charter revision and citizens group for Village planning. Councilman Simmons discussed Charter revision and suggested various areas of Village suggest members for such a conmiittee. Simmons moved, second by Bowden and passed that the Mayor write a letter to the ?resident of the Tequesta Country Club Conu~mnity Association, the Presi- dent of the Country Club Point Property Owners 1~.ssociation and to Nir. ~Iutchinson, representing [^~hitehall, and Carriage ~~ouse Co:~dorainiums requesting them to suggest the names of five (5) persons and two (2) alter- nates to serve on a Charter Revision Con~aittee and to serve on a planning committee for the Village. Other areas in trard t~ao are to be asked for the names of the same nur..ber of persons who might serve in this capacity. Councilman Cunningham reported that an apparent lack of interest by a 11 could lead to the abandonment of the COG organization. He further reported that only one (1) bid had been received for drainage improvements at Tequesta Drive and Seabrook Road. The lone bid was from 3ubin Construc- tion Company with total of $6,056.25 or an alternate bid of $6,506.25 if the swales would be solid sod. The low amount was about 40~ over the engineers estimate for the work. I3ot~rden moved, second by Cunningham and passed that the Rubin Construction Co. be authorized to do the drainage improvements at Tequesta Drive and Seabrook Road at their bid of $6,056.25. Councilman Bowden reported on a letter received from the Florida Inland Alavigational District which states they could not reimburse the Village for the cost of the relocation of the water line across the Intra- coastal ti~daterway made necessary by the construction of the new bridge at State Road 707. He suggested that the raatter of re~_:na:~rsement be further pursued with the State Road Department since a formal, written refusal had not been received from that agency. Bowde~z moved, sECOnd by Simmons and passed, that the Village Attorney contact the Florida State Road Department for the full cost of relocating the water line across the Intracoastal r'laterway at State Road 707. N.r. Lo~~~den then discussed a newspaper article concerning the Water Department and statements attribu~ed to the Mayor. .se further discussed the gaater Departnien~c and advised tha-~ the fiscal agent had approved the transfer of el:cess balance in the Sinking Fund to the Capital Improvements Reserve ~~und. ~Ie referred to the engineers annual report covering the operation of the ~Sater Department iron March 1, 196a to December 31, 1968. He further questioned what would happen if we should let the t~~ater Department go by default. Police Chief Henry M. 7usenbery presented the Police Department and Civil Dsfense Reports for the month of March, 1969, -3~`f- 3 - 4-16-69 Counci Lnan Simmons is to discuss the investment of the auxiliar;; ~~~ for the employee pension plan with Mr. Hobert C. Valier and to consider S trustees for the pension plan. Cunningham moved, second by Lowden and passed that William S. ~Jo~d be appointed Village Judge Ad Litut,t. Lowden moved, second by Cunningham and passed that Mr. Carl G. Triest and Village Attorney t=~illiam A. Lord be appointed to represent the Village of Tequesta in Washington, -.C. at a hearing commencing on or about May 1, 1969, to be held by the ?~'. C. C. in reference to CATV regu- lations which presently restrict our general area to two (2) channels that. could be received via, CATV. Cunningham moved, second by Eo~~den and passed, that an additional police officer be hired at a sa]ary of v~~50.00 and the 1968-1969 budget be ~~ amended to include this addition. The Village Clerk read a resolution requesting the Eoard of County Commissioners of F~a Ln Beach County to urge the Sate Road Depart- ment to install a traffic signs 1 at the intersection of State Road 5 (U. S. Highway No. 1) and State Road 7u7. Cunningham moved, second by Loerden and passed that the resolution be adopted. The Village Manager advised the Council that Zoning Board member, Ralph 0. Cabaniss, had submitted his verbal resignation due to his moving • from the Village. Cunningham moved, second by Sinunoa.s and passed that Mr. Donald G. Webster, Sr., be appointed to fill B`ir. Cabaniss~ term on the honing Board of Adjustment through December 31, 1969. Mayor Sylvester advised that tiie area recreation group had been authorized the use of the Village 'stall for a meeting at 8:00 P.Ni., ~=pr9.l 16, at which time NIr. Jim Sayes o£ the State ~~oard of Parlcs and recreation would discuss area recreation frith the group. The Village Manager rerunded the Council of a tentative Public P-Bearing to be held at 7:15 P.M., Tuesday, 'r=ia,y 20, 1969, to consider the request of Thurman and Helen Arla.ne :nor a change in zoning classification of their property from '-1 to R-2, providing they deisre to have the Biea ring . The Village Manager advised that the fiscal agents fee for deliJer-,~ of additional tilater Revenue Certificates had been overloo'red in the pre- paration of the 1969 Operation and P~Ba,intenance Budget of the eater Department. This amounts to $3,465.00 for delivery of x231,000. cartif'icates and is ;er the terms of July 27, 1966, agreement. Lowden moved, second by Siruaons and passed that the fee of x3,465.00 for the delivery of ~23I,000. Water revenue Certificates be paid to the fiscal agent and that tre 1969 budget be amended accordingly. The Village Manager advised that a notice had been received from . the Corps of Engineers referring to the application of the Florida Power and Light Co, for a permit to install an additional cable south of their existing cable across the Intracoastal idaterway, south of the State Road ?07 bridge. The Village Manager stated he could see no reason to object to the application. -35- ~. - 4-15-69 The Village Manager advised the Council that Lot Pdo . 104, t~.i' dg~:•~~ wood Homes, Section 3, the Eaptist Church minister's residence as of December 29, 1967, had been placed upon the 1968 Tax Pvoll in error with tares assessed in the amount of $x•8.80. It was explained that January 1 each year is the control date. Cunningham moved, second by Bowden and passed that the Tax Collector be authorized to delete taxes in the amount of $48.80 which were assessed against Lot 104, Ridgewood ~Iomes, Section 3, from the 1968 Tax Moll. The Village Manager reported that the contractor expected to have all the fill removed from Country Club Point within about 30 days. =n estimated 8000 square yards of 'fill will be sold and the Villages net cost for the canal dredging and cleaning will amount to approximately $1,400.00. Cunningham moved, second by Eowden and passed that the Village write to the Board of County Corn:d.ssioners of Palm Beach County to inquire of the present status of the County water a:~d sewerage study for the north county area. The Village Manager reported that another resident of Willor,T P.oad had complained that the ficus trees had stopped up her sewer line. --~e also reported that the roots had also caused a water line to burst and that it seemed the situation could only get worse wis:,h the proba'ole best solution to be removal of the trees. Cunningham moved, second by Bowden and passed that the ficus trees be removed from the road right-of-•way o~ • t~illow Road, the holes filled and resodded as previously discussed. The Village Manager reported that 8~ Barker of Brockway, Owen and Anderson Engineers, lnc, had inspected Country Club Drive and was to prepare his recommendations for necessary improvements. Tae recommendations had not been received as yet. The Village Manager reported a delay in the installation of the flashing beacon signal at Tequesta Drive and Riverside Drive due to the necessity of obtaining a permit frorz the County engineers ofgice since P~iverside Drive is a County road. The area had been inspected and the per- mit was expected within the next few da~rs so that insta lla•tion could be made. The Village Manager reported that tiie I'lorida Po~~rer ~ Light Company had completed the installation of fo~.xr (4~ a,dditioYal street lights, two on Golf View Drive, one on River Drive and one on Mesta Avenus. Mr. Paugh reported that the engineers -fea:~ibili•~y aeport for waiter and sewerage for COG for the area was e:~rpected to be xc;csived at any tinge now.
