Councilmen present ~,~ere: Messrs. aylvester, Bowden, Long, Cunninghaa:~ and Simmons. Also present were Pvobert x~a,rp, Village Manager and Clerk and %Jilliam A. Lord, Village Attorney. The meeting was opened with ~'ra;~er and the Pledge of Allegiance to the Flag by Mayor Sylvester. n U Cunningham moved, second by Simons and passed that the reading of tKe Mihutes of the previous meeting be ~raived. Bowden moved, second by Cunningham and passed that the detailed reading of the financia 1 statement for the month of April 1969 be waived. the Village Manager recapped the receipts and disbursements for the seven (?) months period ending April 30, 1969, Cunningham moved, second by Cowden and passed that the financia 1 statement and disbursements for April 1969 be approved. Balances on hand at April 30, 1969, were as follows: First Eank of Jupiter/Tequesta X19,555.33 Petty Cash 25.00 Community Federal Savings and Loan 13,736.06 Fidelity Federal Savings and Loan 14,168.34 U. S. Treasury Bills 29.552.1G x77.046.83 Account balances were as follows: Operating Account X63,286.18 Petty Cash 25.00 Streets, Roads and Drainage Fund 6,880.32 Capital Fund 4,225.33 Developers Security Deposit 3.630.00 x77.04.6.83 The Sinking Fund balance for payment of principal and int Brest on the Village Hall bonds was x19.384.32. The E~7ater Department financial statement for four (4) months shop:-ed total revenues of X71,661.00; total expenses of ~4-2,458.72 and transfers from the P~evenue Fund of X62,582.26. The Village Manager presented his report covering activities during the month of April 1969. The report showed coir-plet~_on of the paving and partial completion of the drainage at the intersection of Tequesta Drive and Seabrook Road; installation of a flashi:~g beacon traffic signal at Tequesta Drive and riverside Drive. Last Vear Councilman Cunningham re~.unded the Councilmen of a COG Meeting May 28th at which the governing bodies of the various municipalities are to discuss the preliminary water and sewerage feasibility report that had beenpY'epared by Mock, Roos, I~ Searcy, Inc, for COG. Councilmen Bowden discussed possible beautification of the re- cently purchased property east of the Village and dialing 911 for a 11 emergency services. He presented an article on the subject which was in a recent issue of the Readers Digest. The use of the number is presently b~efare the State Legislature for their consideration. Councilman Simmons said he had been asked what the Village intended to do about the [dater Department fire hydrant annual charge of $100. and that the Commissioners of the J~.?piter Fire Control District would like to know. The matter as relates to the Village of Tequesta is clear but has not been resolved for the other areas and the Jupiter Fire Con- trol District will be so notified. Mr, Simmons also asked Mr. Lord for a copy of the Pension Trust Agreement to be taken by Gulf Life Insurance Company representative to various bangs for their consideration to be a trustee and invest the required au~.iliary funds . No. Valuation 208 (48 Houses) $1820,109. i The Village Manager read a letter from the Tri-Community Library Association requesting a contribution of $1,080.00 to assist them with a proposed budget of $4,600. for 1969-19?0 for operation of a library in a temporary location in Gallery Square. The Council was adv=.~sed that the r/ amount of $1,000. from the Community Fund was not a firm committment as of this date but very likely would be contributed by them. Simmons moved, second by Cunningham and passed that the Village contribute the sum of $1,080. to the Tri-Community Library Association. Police Chief Dusenbery presented the Police Depa rtment and Civil Defense Reports for the month of April, which were approved upon motion by Bowden, second by Long and passed. Mr. Frank Wright and Mr. J. B. Boynton introduced Doug Storer of the "Amazing But True" column and program. He spoke briefly to the Council and several pictures were talten. Attorney Lord discussed a "Rill of Sale and Conveyance" which the owners of Turtle Creek Village in I~:artin County has ws2zd to be exe- cuted by the Mayor and Clerk upon approval by the Cou^~cil. At~orney Lord stated he did not like the form of the instrument and he ~~~ou3_d discuss the entire matter with Mr. R. L. Jackson to provide a document ~~o meet with the Village Attorney's approval, therefore, no action •~ias taken on the matter. . The Village Manager advised that plans for the wa:.er system distribution of Turtle Creek Village in Martin County had boon re~r_ewed by the InTater Department engineers who recommended approval for cczin.ecting to the Village water system subject to the following protri sos: -~0- 3 - 5-20-69 1. ) Plans and specifications submitted and construction completed s~3a.i-1 be subject to written approval of the Martin Gounty Health Depa rLmer. and the Florida State Board of Health. 2.) Ma,teria 1 and construction specifications for the water system be not less than that required by the Village. Recommended minimum specifications are provided with this letter and attached to the plans which are included herewith. 3.) Inasmuch as the proposed water system extensions ~cwill be located within rights-of way which apparently krill be deeded to Martin County, a letter of approval from the County Engineer should be pro- vided to the Village by the Developer. ~.) The Village be advised by the Developer of the time and date of the required pressure and leakage test so that such tests may be witnessed by the Village's representative. 5.) Following construction completion anc approval by the Village and Palm Beach County Health Department, the water system be deeded to the Village and that an appropriate franchise or license for service be secured by the Village from the Board of Martin County C.,.~4.ussioners. 6.) That service laterals to private property be of sufficient size to convey anticipated water demands. The Village Council discussed a later from the Safety Ceuneil • of Palm Beach, krilliam L. Hawkins, Executive Director, requesting a $125.00 contribution to their program. Chief Dusenbery stated he was not familiar with the organizations program. Long moved, second by Bowden and passed that the request be denied. The Village Council discussed paving and drainage improvements for Country Club Drive north from Tequesta Drive. Proposed improvements as prepared by the engineers were estimated to cost $32,505. with an alternate plan estimated to cost ~~2,135. It was determined that immediate repairs were needed. Mayor Sylvester stated that LCJ Construction had verbally estimated a cost of approxiunately 4,000. for rescrfa~cing Country Club Drive from Tequesta Drive to bes*ond the Country Club Y~'ouse where the poor condition of the existing road ends. Cunnir..gham moved, second by Bowden and passed that an expenditure of w4,000. be authorized for resurfacing Country Club Drive and Mayor is to get written confirmation of price from Linsey Jarrett of L ~ J Co~istr?~cton Company. Attorney Lord read an ordinance assessing and i:siposing an excise tax upon any insurer of the Municipal Police Ofi3_c~~rs Retirement Trust Fund in accordance with Section 185.OS, Statu~:es of Florida. The Council was advised that this would r~,l:e available to the ~'i:~?a,ge Pension Plan an excise tax of 1% of the gross amount of receip,s ax`Ld premiums on casualty insurance policies. Cunningham moved, secon~ kry Bowden that the reading be approved. All Councilmen being present and vo~,in. in favor of the reading, Ordinance No. 152 was thereby passed and adopted on first • ~ reading. Attorney Lord said he would have to look furtnpr into the matter of how the Village could control the lengtch of time a train could block Tequesta Drive. He stated the proposed Charter revisions had beet approved by the Legislative delegation. Yee discussed methods o: providing for Charter revision and also discussed how to control the ;weight limits of _,~, 4 - 5-20-69 trucks as in Chapter 317.761 and 317.771 Florida Statutes. The Tillage Manager reported that costs for rcn,intenance ser- vice contracts for the two ground storage tanks and the elevated storage tank of the Water Department had been received as follows, both for periods of three years: Sieg ~ Ambactsheer, Inc. X5,400. Deland, Florida Odom Tank Company, Inc. X3,675. Marianna, Florida Dowden moved, second by Long and passed 'chat the contract be granted to Odom Tank Company, Inc. at three year cost of $3,675. The Village Manager reported that the following quotations lia.d been received fora two way radio communications for the Water Department: For Base Station, one Mobile Unit and Antenna: Spencer Communications v1, 073.00 (Johnson 7 Watt) Motorola (S ~~att) X1.,150.00 • The Tillage Manager recommended the purchase of the units from Spencer- Cormnunications. Cunningham moved, second by Bowden and passed that the radio equipment for the Water Department be purchased from Spencer Com munications . The Village Manager reported that Joseph T. Iaterza, engineer for Tequesta Gardens, Section A, had provided the Village with written certification that the roads, water distribution system and sanitary sewer collection system had been constructed according to the plans and specifications. Cunningham moved, second by Bo~~den and passed that the improvements be accepted and the developers security deposit be released. The Village Manager read a letter from the County Engineer soliciting any suggested County road projects which the Council feels should be considered by his office for the 1969-1970 fiscal year. It was agreed that all County roads in the Village area were in need of improvement and especially the completion of acquiring of right-of-way and construction of Seabrook Road north to complete the road. Cunningham moved, second by bong and passed that an expenditure of X503.00 from the Renewal and Replacement Fund be approved for cast of replacing flow meter in Well Field Mo. 1. The Tillage Manager also reported that Senator Jerry Thomas had made application to the Corps of T;ngineers fora permit to construct a pier in the Intracoastal traterway; the annual Tax Certificate Saie would be held at noon, June 11 at the Village T~a.ll; the State Road Department will hold Public Hearings at the Tillage :fall on Friday, June 6, in connection with progosed State Road ido. 5 improvements and that a forum would be held Friday, May 23, at I'lorida Atlantic University on "Sewage -42- 5 - 5-20-69 Systems of the East Coast of Florida and their Impact Upon Envirorunental Health and Preservation of Natural Resources". Mr. Paugh spoke of activities of the COG Utilities Committee and reminded that the committee would Wiest Thursday night at Dr. Robert L. Gr©gan~s office. Mr. Norman Cibulka, building his own home on Lot 6, t3lock 36, Jupiter in the Pines, Section D, stated the Police Department had stopped him from working on Sundays in accordance with the terms of Ordinance Pdo. 29 after receiving a complaint, Mr. Cibullca exp]ained that he works everyday except Saturday and Sunday and this is when he is building his home. Cunningham moved, second by Bowden and passed that Mr. Cibulka be permitted .to construct his own home on Sundays. There being no further business, the meeting was adjourned at 11:10 P.M.
