• OF THE VILLAGE OF TEQUESTA, FLORIDA
The regular monthly meeting of the Councilmen of the Village of
Tequesta,, Florida was held at 8:00 P.M., Tuesday, August 19, 1969 at the
Village Hall,. 35~ Tequesta Drive. Cotizicilmen present were: Messrs.
Sylvester, Long, Cunningham and Simanon§. Also present Here Robert Harp,
Village Manager and; Clerk and William A. Lord, Village Attorney. Council-
man Bowden wad abse~it due to his being out of the country.
The meeting i,~,s opened with prayer and the Pledge of Allegiance
to the Flag by Councilman Long.
Mayor Sylvester advised that bids for raw water supply additions
and improvements for "hells No 11 and 12, in the Well Field. on 01d Dixie
High~~,y were due in by 8:00 P.M. The Clerk reported two bids had been
received and Mr Donald Osha, hater Department Consulting Engineer from
the firm of Brockv~~,y, Owen and Anderson Engineers, Inc. read the bids for
tallying by interested parties. The bids received were as follows:

Mr. Osha advised he and the Village Manager i~aould tabulate the
bids Wednesday prior to his giving a recommendation on the bids to the
Village Council.
Upon motion by Long, second by Cunningham and passed, the reading
of the Minutes of the previous meeting ~~as waived.
Long moved, second by Sitarnons and passed that the detailed reading
of the Financial Statement for the month of July be waived. The Village
Manager recapped the receipts and disbursements for the ten (IO) month
period ending July 31, 1969. The Financial Statement and Disbursements for
July 1969 were approved Ba,laaces on hand were as follo~~s:

The Sinking Fund balance for payment of princi~Zl and interest on
the Village Hall Bonds was $23.1?3.05,
Councilman Simmons referred to water negotiations with Jupiter
and Jupiter Inlet Colony and was advised any praposed changes would have to
have the approval of the Village Council.
Upon motion by Cunningham, second by Simmons and passed the
• 1969 Tax Roll was approved as follows:
Total Rea 1 Estate Valuation $ 26,687,780.
Railroad Valuation 41,980.
Tangible Personal Property Valuation 1.316,600,
$ 28,046,360.
Loss Homestead Exemptions 2.360,500.

Mr Frank Johnson, staff member of the Area Planning Board of
Palm Beach County, presented a set of its overa lI Planning Program Reports
to the Village and answered questions about the activities of the Planning
Board.
Police Chief Dusenbery Presented the Police Department and Civil
Defens® Reports for the month of July 1969.
Mr. Grover C, Herring, Attorney for Tele~,mpter appeared before
the Council to discuss a CATV franchise for the company he represents in
the Yilla,ge of Tequesta. He reviewed the proposed franchise, rate structure
and franchise fee. Mr. Leslie Read, a Vice president of Teleprarnpter i~~~.u
Port Washington, New York discussed the company and its activities in the
field of CATV.

Mr. Thomas Gilchrest, Vice President of Palm Beach Cable TV also
spoke to the Council about his company and advised that they had recently
purchased the Martin County Cable Company.
Counci]ams•n Cunningham stated he believed the Village should be
prepared to name a company to which they 1•ri.ll grant a CATV franchise, if
they decide to do so, by the September Council Meeting. The Council set
7:30 P.M., Tuesday, August 26, 19b9 as the time fora meeting to discuss
the various CATV pt~oposals which have been made to the Village and the
governing bodies of Jupiter and Jupiter Inlet Colony are to be invited to
attend this meeting,
Attorney Lord read an Ordinance annexing Lot 13, Block D, Jupiter
Manors, Section One to the Village of Tequesta. This is a lot on Point
Drive immediately south and abutting the Whitehal]. Condominium property
Cunningham moved, second bq Simmons and passed that the first reading of
the Ordinance be approved.
A letter petition from Carriage House Management, Inc. requesting
that the Village post the bridge on Tequesta Drive across the north fork
of the Loxahatchee River to indicate "No Diving or Jumping From The Bridge"
and "No Fishing" signs posted at the center span of the bridge was discussed.
• Attorney Lord advised that Palm Eeach County has advised him that
the bridge belonged to the State Road Department and. that it was his
opinion it could not be posted without the State Road Departments permission
and consent. No action was taken on the matter and it will be given
additional study.
Mr James Wfnters, from the fixm of Winters, Brackett and Lord,
discuased tha Pension Trust Agreements which had been written after con-
aultation e.d.th C-ulf Life Insurance Company regal representatives. He
stated that the Pension Trust Agreement for the Police Department personell
~,-as before the State Insurance Commission for his approval and such app..,~~1
was expected shortly. Mr. Winters discussed the matter of a Trustee for
the Pension Trust and submitted a letter from the Atlantic National Bank of
West Palm Beach indicating their interest and method of charging for the
services as the Trustee of such a p1a•n. Mr. I•Jintera answered questions
explained different items in the Agreement. Cunningham moved, second by
Long and passed that the Pension Trust Agreements for regular employees
and Police personell be approved and that the Atlantic National Bank of
West Palm Beach, Florida be appointed Trustee for the trusts subject to a
meeting between Mr. Simmons, Mr. hinters and Mr. Morris of the Atlantic
National Bank to obtain their concurrance and approval of the terms of the
Trust Agreements.

''Att~rne~ Lend advised that the tt~o bills which the Village had
before the State Legislature had now become la.w. He reminded the Council-
men that the bill providing that in the event the Village shall issue
General Obligation Bonds for municipal purposes, taxes shall be levied
upon all taxable prioperty within the Village without limit as to rate or
amount necessary to pay all principal of and interest on and reserves
therefore of General Obligation Bonds; shall only become effective upon
its approval by majority vote of the Freehold Electors of the Village of
Tequesta. No date was set for such referendum.
Attorney Lord advised that a petition had been received from
U. S. £~ R, Incorporated requesting that tti.*o parcels of land they own on
Jupiter Island, immediately south of and abutting the Jupiter Island
Apartments and the Regency Condo.;nium property be annexed to the territorial
limits of the Villa ge of Tequesta. He read an Ordinance providing for the
annexation of this property to theVillagc of Tequesta. Cunningham moved,
second by Long and passed that the first reading of the Ordinance be passed.
The Council discussed a letter from Lionel M. Sutherland, owner
of Lot 53, Tequesta requesting the Village to install a ~2" Diameter
drainpipe to replace an existing 2~" Diameter drainpipe between Lots No.
52 and 53, Tequesta, now, if this is part of the proposed ultimate drainage
plan for the Country Club Community, ~•~hile there are no houses on those
• lots or correct the existing discharge so erosion is stopped or replace the
soil lost by erosion His letter indicated replacement of the existing pipe
with a larger one ~;-as estimated to cost X30-35,000. and the Council agreed
this was not possible due to lae~C of funds. The Village Manager and
Counci Lean Cunningham will make another on-site inspection of the area.
Mayor Sylvester reported that he had appointed Mr. William J.
Taylor as the Villa.ge~s representative to the COG Recreation Committee
which is to make a more comprehensive study of area recreationa 1 needs.
The Village Manager reviet•red a letter from the Village Attorney
expressing his opinion on the liabilities that would be incurred with the
formation of zn Auxiliary Police Force for the Village bath to the Auxiliary
Police Officer and liability for his fictions.
Mr. Paugh reported that there had been no further activitiy of
the COG utilities committee. He also introduced, Captain Stebbins, U. S.
Navy retired, a new resident of the Village.
In response to a question, the Council said they would look into
a possible Ordinance to provide that all growth on lots be cut if it exceeds
eighteen inches in heigth.
There being no further business, the meeting was adjourned at
10:50 P.M.
