ri~A cF ~~°~ r~~ 'Iii ~ o ~ r ~ cc•~TcI~:~~r OF THE VILE OF T^Q~STA, FLORIDA The regular monthly meeting of the Councilmen of the Village • of Tequesta, Florida, was held Tuesday, February 20, 1968, at 8:00 P.M. at the Village Hall. Councilmen present were: Messrs. Bowden, Sylvester, Valier and Cornelius. Also present were Robert Harp, Village Manager and Clerk and William A. Lord, Village Attorney. Councilman Valier opened the meeting with prayer and led the group in the Pledge of Allegiance to the Flag. Ma,gor Bowden advised that the time for receiving sealed bids for the relocation of a 10-inch subaqueous water main across the Intra- coastal Waterway at State Road 70? and the adjustment of 8-inch water main along State Road ?07 as publicly advertised January 24 and 31, 1968, wa,s closed. The Mayor also advised that the time for receiving sea led bids for-the purchase of $200,000 t.iater Revenue Certificates in connec- tion with the purchase of Tequesta Water Co., Inc., as publicly advertised February 15, 1968, was closed. The Village Clerk opened the bids in the order in which plans and specifications had been obtained from Brockway, Owen a*±d Anderson Engineers, Inc. and Mr. Donald Osha read the bids. Each Counci Lean and any bidders present were provided with bid tabulation sheets prepared by the Village engineer for the project. The bids received were as follows: • Total Base Bid Alternate Bid# Murphy Construction Co. $22,343.50 $24,723.50 C1ea ry Brothers Construction $34,790.50 $31,815,50 Powells Brothers, Inc. $35,750.00 $33,667.50 Foster Marine Construction $37,048.00 -0- ~The alternate bid was for 5.95 l,f. 10~' welded wrought iron subaqueous water main instead of 10" ball joint C.I. subaqueous water main. All bids included bid bond of 5~ and Addendum No. 1. Mr. Osha checked all the bids far accuracy and recommended to the Village Council that the contract for the construction be awarded to Murphy Construction Company on their base bid of $22,343.50. Cornelius moved, second by Sylvester and passed that the contract for-the relocation of the 10-inch subaqueous water main across .the Intracoastal Waterway at State Road 707 and the adjustment of 8-inch water main along State Road ?0? be awarded to the Murphy Construction Company on their low base bid of $22,343.50 and that the Mayor and Village Clerk be and are. hereby authorized to sign contract for this work, The cost of the relocation will be shared aqua Ily by Mr. George W. Offutt, III, and the Village of Tequesta under the terms of an agreement between Mr, Offutt and the Village dated August 14, 1967. The Village Clerk opened the one (1) sealed bid which had been received for the purchase of $200,000. Water Revenue Certificates as publicly advertised February 15, 1968, A joint proposal from Thomas M. Cook ~ Company and Sullivan, Nelson ~ Goss, Inc. offered to purchase said Water Revenue Certificates for the principal sum of $200,000. plus a -28- 2 - 2-ZO-68 premium in the amount of $100. together with accrued interest from January 1, 1968, to the date of delivery. Cornelius moved, second by Va Tier and passed that the above proposal of Thomas M. Cook and Company and Sullivan, Nelson ~ Goss, Inc. be accepted and Resolution No. 2-6? was thereby passed and adopted to accept the proposal. Cornelius moved, second by Sylvester that, since each Coun- ci Lean had received copies of the Minutes of the Public Hearing held January 16, 1968; Minutes of the regular Counci 1 Meeting held January 16, 1968, and Minutes of the Special Council Meeting held January 30, T968, and that the agenda is quite long for this meeting, the reading of the above Minutes be waived unless anyone in attendance desired to have them read. No one indicated a desire to have the Minutes read and the motion was unanimously passed. Sylvester moved, second by Valier and passed that the detailed reading of the financia 1 statement for January 3958 ~? waived. The Vi1L~,ge Manager recapped the receipts and disbursements for the four (4) month period ended January 31, 1968, and upon motion by Cornelius, second by Sylvester and passed, the financial statement and disburs~nents for the month of 3anuary 1968 were approved. Balances on hand at Janu- ary 31, 1968, were as follows: First Bank of Jupiter/Tequesta $11,693.89 Petty Cash 25,00 Community Federal Savings and Loan 30,986.34 Fidelity Federal Savings and Loan 13,397.62 U. S. Treasury Bills 14,?43.?5 70 846 60 Account ba]ances were as follows: Operating Account $57,715.95 Petty Cash 25.00 Capita 1 Fund 7,226.33 Streets, Roads and Drainage Fund 5.880.32 70 8~•6~ The Sinking Fund balance was $16,038.10. The Village Manager read his report of Village activities for the month of January, 1968. The report showed that 93.5 ($34,286.34) of the 1967 Tax Roll had been collected at January 3I, 1968; that a tots 1 of 290 1966 Village of Tequesta Occupational Licenses had been issued. Building Permits were: Janua rv 1968 No. Valuation 33 (7 Houses) $416,273. Year to Date ~4 Months) No. Valuation 113 (25 Houses) $985,460. Mayor Bowden read his final report as Mayor. Isis report covered the following items: 1. Proposod resolution of the Village Council in support of plans for restoration and protection of beaches of Florida's eleven At]antic Coast Counties through the Florida Department -29- 3 - 2-20-68 of Conservation and the U. S. Corps of Engineers with financing by the Florida Inland Navigation District. • 2. Suggesting that the Village Council might want to recom- mend to the Jupiter-Teouesta Community Fund Board of Directors that the Heart, Cancer and March of Dimes join the Community Fund. 3. Suggesting a feasibi lity study for the purchase of the existing sewerage plant. 4. Continuation of work to obtain a CATV system for the Village . 5. Suggesting the Council contir_ue to work toward the annexa- tion of Anchorage Point. MA. Sohn Ia.w termed very interested in annexation. 6. Suggestion that the police car lettering be revised with Police Chief recommending his preference to the Council. 7. Suggestion to make the private property east of the Village Hall into a parlc area by seeding, shell paths, plantiz~xgs, benches, etc. YIe also called Council's atten- tion to lack of action on the Beautification Committees recoasnendations of September 19, 195?. 8. Statement that he is not running for another term as • Mayor-Counci]man even though he has had many requests to do so. He further stated he has filed as a candidate for Counci]man-First Ward and also stated he is not returning to Bogota, Columbia April 1st. Councilman Cornelius stated he believed he should have equs,l time be- cause of the political aspects of Item 8 and stated he was also running for the office of Counci]man-~`irst Ward. Police Chief Dusenbery read the Police 7)epart~aent and Civil Defense Reports for the month of January, 1968 and both were accegted. Mr. Collins, a member of the Jupiter--Tequesta Chamber of Commerce Development Committee, spoke to the Council abo~.xt the Chamber of Commerce's concern about proper area planning and urging the loe~ 1 governments to produce a carefully designed master plan for development and growth. The Chamber also strongly urges tlae organi~a,tion of a Council of Government for the local community encompassing all the area in the Northeastern Section of Palm Beach County, He further explained the idea of the Council of Government corunonly referred to as "COG". The Council expressed their thanks to Mr. Collins for his presentation and indicated their support in this matter. The Village Clerk gave second reading by title only to an ordinance amending Ordinance No. 6 to adopt and incorporate by refer- ence as its traffic code any amendments or additions to the Florida Hlodel Traffic Ordinance. Valier moved, second by Sylvester and passed that the second reading be approved. The first reading of the ordinance having been approved January 16, 1968, Ordinance No. 141 was thereby passed and adopted on second reading. -30- ~ - 2-20-68 The Village Attorney read a resolution designating the Manu- facturers Hanover Trust Company, Pdew fork City, New York, the paying agent for $1,700,Q00. Water Revenue Certificates of the Village of • Tequesta, Florida. Valier moved, second by Sylvester and passed that the Manufacturers Hanover Trust Compaq, New York City, New York, be authorized to act as paying agent for the $1,700,000. Water Revenue Certificates of the Village of Tequesta and Resolution No. 3-67 was thereby passed and adopted. The Village Attorney read a resolution designating the Bank of Palm Beach and Trust Company, Palm Beach, Florida, as depository for the following Water Department funds: 1. Sinking Rind 2. Reserve Account 3. Renewal and Replacement Ftmd 4. Certificate Redemption Fund ~. Capital Improvement Reserve Fund Cornelius moved, second by Valier and passed that the resolution be ap- proved and the authorized signatures be two (2) as follows: Village Manager and/or Village Treasurer and one (1) CounciLnan and Resolution No. 4-67 and signature requirements were approved. The Village Attorney advised of the Escrow Agreement which had been prepared for approval of the Village Council designating the Bank of Pa]m Beach and Trust Company as Escrow Agent for the $637,000. Village of Tequesta, Florida, Water Pevenue Certificates, dated July 1, • I96?, numbered 1064 to 1700, inclusive, in denomination of $1,000. each, to be delivered to the Tequesta Water Company under the terms and con- ditions as spelled out in the agreement. Valier moved, second by Sylvester and passed that the Mayor and Village Clerk be and they are hereby authorized to sign the Escrow Agreement for the Village of Tequesta, I7.orida . The Village Attorney read a resolution naming tiJ. C. Goss Finan- cial Advisor to the Village of Tequesta, Florida as required by Section 4.12 of Ordinance No. 138 and authorizing the Mayor and tl^e Village Clerk to execute an agreement with W. C. Goss for this purpose. Valier moved, second by Cornelius and passed that the resolution be approved. Resolu~- Lion No. 5-6? was hereby passed and adopted. The agreement provides for an annual sum of $1,200. to be paid to W. C. Goss at the rate of $100. per month payable on the 31st day of March, 1968 and the last day of each month during the term thereof and other terms and condi- tions. The Village Attorney gave first reading to an ordinance regu- lating the parking, occupation and use of trailers, house cars, camp cars or campers on public and private property within the Village. The ordinance would make it unlawful for any such vehicle to park on any of the public streets or any Village property and provides a maximum of four (4) hours parking on private property. Cornelius moved that the first reading be approved. Valier seconded the motion. Mr. John Kiernan, 75 Yacht Club Pla+oe, Tequesta Country Club Community, objected to the stringent restriction of four (4) hours maximum parking time on private property and stated it takes approximately 24-30 hours for loading and unloading. Councilman Cornelius stated trailers were unsightly for the -31- 5 - 2-20-68 Villstge and did not want to see trailers all over the Village. He stated the. parking of trailers on public or private property for any length of time is not good for the Village. Mr.. Kiernan read a news- paper article that Boynton Beach allows trailers and campers to be parked on private property. Mr. Frank D. Cunningham, 360 Saturn Avenue, also ob3ected to the stringent Barking regulations especially when residents of the Village might have guests come to visit them and have to park their trailer outside the Village during their visit. He stated his father visits him and parks his camper on his property while visiting but does not live in it. Councilman Cornelius said it would benefit the entire Village to keep them out. Councilman Va lier said they did not want trailers parked in the Village. Mr. A. W, Butterfield., 165 Golf View Drive, Tequesta, questioned the restrictions if applicable to fold down campers since they could easily be screpnpd fra~m view by plants or fences, Mr. Tedeschi, 20 Tradewinds Circle, Country Club Point, questioned where guests would put their trailers while visiting. IL was suggested that perhaps the ordinance could provide for the parking of trailers in the area of the Village lying between the railroad right of-way and the west line of the Intra coasts 1 Waterway.. Valier moved, second by Sylvester and passed that action en the trailer ordinance be tabled for further discussion. The Village Attorney gave first reading to an ordinance to change the off-street parking regulations relating to C-1 and G2 Districts as approved by the Village Council at a Public Hearing held • January 16, 1968. Cornelius moved, second by Sylvester and passed that the first reading of the ordinance be approved. The Village Attorney advised that Attorney Amadeo Meitin, Attorney for Adele R. Schlusemeyer, Trustee, owner of Parcel "C" and Lots 6 and 15, Block 30, Jupiter in the Pines, Section B, had contacted him requesting that the Village Council abandon a 12 foot utility ease- ment, being the east 6 feet of Parcel C and the west 6 feet of Lots 6 and 15, Block 30, 3upiter in the Pines, Section B and to accept a new easement deed covering the west 12 feet of Lots 6 and 15, Block 30, Jupiter in the Pines, Section B. He explained that this ~,•ould move the present easement 6 feet to the east and permit the use of the east 6 feet of Parcel C. The Village Attorney read a resolution providing for the abandonment of the present 12 foot easement and providing a new easement. Valier moved, second b9' Cornelius and passed that the resolution be approved and Resolution No. 6-6? was thereby passed and adopted. Attorney Lord also discussed the change in the easements in tell Field No, 3 with the Village getting a deed to three pieces of property 25 feet in width running approximately east and west and including the three (3) wells near the F.E,C, Railroad. The Village Manager advised that Brockway, Owen ~ Anderson Engineers, inc. had submitted a written proposal to act as the Dillage~s Consulting Engineer for the Water Department as required by Ordinance No. 138, including the services to be performed.. They proposed to perform the services on a per diem basis with the services to be per- formed only at the direction of the Village at a total annual cost not -32- G - 2-20-68 to exceed $1200. Cornelius moved, second by Cornelius and passed that Brockway, Owen ~ Anderson Engineers, Inc. be retained as the Village Water Department Consulting Engineers pursuant to the ternts and condi- tions as outlined in their letter proposal and the Mayor and Village Clerk be and are hereby authorized to enter into such an agreement. The Village Attorney advised that the Council would probably have to hold a Special Meeting to conclude the Water Company purchase and he would advise the Village Manager when the meeting is to be held. The Village Manager stated he had arranged for the First Bank of Jupiter/Tequesta to be the designated depository for the following Water Department funds: 1. Working Capita 1 Fund 2. Water Revenue Fund 3. Operation and Maintenance Fund Talier moved, second by Sylvester and. passed that the First Bank of Jupiter/Tequesta be designated the depository for the above Water Department funds and that the authorized signatures for the accounts be the Village Manager and/or Village Treasurer and one (1) Councilman. Mr. Irving Schlusemeyer, representing Pilot Homes, Inc., introduced Mr. Joseph J. Laterza, Registered Civil Engineer No. 6506, to discuss with the Councilmen the use of monolithic slabs in the Tillage. Mr. Ia.terza explained monolithic pours and emphasized that he would only approve the use of such slabs providing undisturbed soil • of suitable bearing capacity is present at the footing elevation. He also stated the footing or thickened slab section should have the same dimensions and reinforcing steel as would be used in a normal spread footing for the same structure. He further advised the Council that he would sign and seal a letter approving this method of construction for each individual lot on which such a slab was to be constructed following an on-site inspection of the Iot. It was the general feeling of the Council that such a slab, properly designed by a registered engineer and with suitable undistrubed soil at the footing elevation and class inspection while being formed and poured, would not bean inferior type of construction. Cornelius moved, second by Sylvester and passed that the use of monolithic slabs, as designed and sealed by a registered engineer and with written approval of a registered engineer for each individual lot on which it is to be constructed, be approved. Mr. Laterza also stated that he is in the process of preparing plans and specifications for the construction of Beacon Street, Church Road and Fra.nk2in Road in Blocks 31, 32 and 14, Jupiter in the Pines, Section 4 and D, together with drainage, water and se~aerage. Mr. William E. Schlusemeyer intends to start construction of residences in this area. Mr. Laterza asked for and was granted permission to adjust the sidewalk elevation on Tequesta Drive at the west side of Venus Avenue. A proposed plan fora 6~ x 12~ Developers Sign which Tequesta Sales Corporation would like to have erected on U. S. Highway No. 1 was'.shown to the Councilmen. Cornelius moved, second by Sylvester • and passed that Tequesta Sales Corporation be granted a six (6) months Developers Sign Permit for the sign subject to submission of proper application and fee for the permit. -33- 7 - 2-20-68 The Village Manager advised that Lowell E. Jarrett, owner of Lot 9, Block D, Jupiter Manors, on which he is presently constructing his residence, had expressed a desire to have this property annexed to the Village. Each Counci]man had received a plat shodring the location of this property across Point Drive near the north entrance to Bay Harbor. The Council expressed agreement t~rith such an annexation and Mr. Jarrett mill be advised of the steps necessary to have his property annexed to the Village. Councilman Sylvester suggested that the local Izaak Vdalton League needed a place to hold one meeting and had asked if the Village Hall could be used since it ~rould be fora community project. The Council agreed that the present policy of non-municipal use should not be changed but believed this to be a meeting that could be properly authorized. Sylvester moved, second by Valier and passed that the Izaak `~alton League be authorized to use the Viila.ge Hall for one meeting. On motion by Sylvester, second by Cornelius and passed, Resolution No. ?-6? eras passed by which the Village supports and ap- proves the plan for restoration and protection of the beaches of Florida's Atlantic Coast Counties Frith the possible solution to be found through the Florida Department of Conservation and the U. S. Corps of Engineers and to be financed by the Florida Inland Navigation District. The Village Council's attention was called to the letter from the Country Club Point Property Owners Association, which each Council- rna.n had received a copy of. rir. Schnedl, President of the Association, • discussed a letter he had received from Mr. George Bailey, Assistant County Attorney, in regards to the canals in Country Club Point. The dredging of the canals was again discussed. Cornelius moved, second by Sylvester and passed that if the Village Attorney gives the Village Council his written opinion that such dredging is the responsibility of the Village, that the Village proceed i~rith such ~*ork as needed and re- quired. The Village Manager stated that he and a representative of the Florida Power £~ Light Company had made a survey for several new street lights and several persons still had to be contacted about them. The Chamber of Commerce Annual Deport was given to each Coun- cilman. The meeting was reminded that 5:00 P.M., Thursday, February 29, 1968, ~~a.s the deadline for candidates to file for the General Election to be held March 19, 1968. Mr. Paugh stated that work had been commenced on study of the possible formation of a Sewerage District in northern Palm Beach County area. There being no further business, the meeting was adjourned at 10:50 P.M.
