The regular monthly meeting of the Counci]men of the Village of Tequesta, Florida. was held Thursday, March 28, 1968, at 8:00 P.M. at the Village Hall. Councilmen present were: Messrs. Bowden, Sylvester and Valier. Councilmen Cornelius and Bledsoe were absent. Also present were Robert Harp, Village Manager and Clerk and William A. Lord, Village Attorney. Mayor Bowden opened the Meeting v~ith prayer and the Pledge of Allegiance to the Flag. The Inspectors of Election Certificate far the General Election held March 19, 1968, was presented to the Council by the Village Clerk. Valier moved, second by Sylvester and passed that the Certificate be ac- cepted showing the election of Robert E. Sylvester as Mayor-Counci]ma,a, George E. Bowden, Councilman-First Ward and Carl L. Long, Counci]man- Second,Ward. The Village Clerk gave the Oaths of Office to the newly elected officers. Lang moved, second by Valier and passed that Frank D. Cunningham be appointed to the Village Council until the 1969 General Election as Councilman-Second Ward to fill the vacancy created by the election of Mr. Sylvester as Mayor. The Oath of Office was given to Councilman Cunningham by the Village Clerk. Bowden moved, second iry Valier and passed that the following Village officers be elected for the coming year: Vice Mayor Robert C. Valier Treasurer Carl L. Long Tax Assessor George E. Bot,rden Tax Collector Frank D. Cunningham The Village Clerk gave the Oaths of Office to the newly elected officers. Bowden moved, second by Cunningham and passed that the following Village officials be appointed for the coming year: Village Manager and Clerk Police Chief Assistant Village Clerk Village Judge Village Judge Ad Litem Civil Defense Director Water Department Superintendent Robert Harp Henry M. Dusenbery Betty G. Cox Henry W. Jewett William S. Wood Henry M. Dusenbery James Worth Oaths of Office were given to the newly appointed officials present. The fins of Winters, Brackett and Lord was appointed as Village Attorneys with William A. Lord, to act for them. Retiring Mayor Bowden presented the Mayors gavel to newly elected Mayor Robert E. Sylvester. -36- 2 - 3-28-68 Mayor Sylvester presented out-going Mayor Bowden with his gavel with an engraved sterling silver bond showing his service as Mayor of the Village. Certificates of Appreciation were presented to I~ir. Bowden and to former Councilmen Cornelius and Bledsoe. Mayor Sylvester spoke to the Council and asked them to consider the following projects during his term of office: 1. Total beautification of the Village. 2. Recreation Parks and Ocean Front. 3. Library and cultural grot,rth for the Village. 4. Continue work to obtain a post office for the Village. 5. Work toward annexation of nearby areas. 6. Formation of a third Voting Ward east of U. S. No. 1. 7, Formation of a Village Planning Board. Bowden moved, second by Cunningham and passed that the reading of the Minutes of the February 20, 1968, Council meeting be waived. Va liar moved, second by Cunningham and passed that the Minut®s of the Special Meeting held March 1, 1968, be waived. Bowden moved, second by Valier and passed that the detailed reading of the financial statement for February 1968 be waived. The Village Manager recapped the receipts and disbursements for the five (5) month period ended February 29, 1968, and upon motion by Bowden, second by Valier and passed, the financial statement and disbursements for the • month of February 1968 were approved. Balances on hand at February 29, 1968, were as follows: First Bank of Jupiter/Tequesta $ 9,175.39 Petty Cash 25.00 Community Faders 1 Savings and Loan 30,986.34 Fidelity Federal Savings and Loan 13,397.62 U. S. Treasury Bills 14.?43.?5 ~.$.s 3~Q Account balances were: Operating Account $55,197.45 Petty Cash 25.00 Capital Fund 7,225.33 Streets, Roads and Drainage Fund 5.880.32 68 328.10 The Sinking Fund Ba]ance is $17,284.35. LAST V~~li 21 (7 Houses) $188,605. 92 (32 Houses) $1,396,746. -37- 3 - ~-28-68 Police Chief Dusenberp presented the Police Department and Civil Defense Reports for the month of February. Chief Dusenbery also '. presented a mc-~aorandum on new police ca.r lettering but no action was taken on the matter. Councilman fiowden discussed the purchase of the property lying east of the Village Hall by the ~Jater Department for possible future ex- pansion of .Village facilities. He stated the owner, Mr. George W. Offutt, III, had proposed to seiZ it to the Village for $30,000. Bowden moved, second by Valier and passed that an appraisal be made of the property and that the purchase be discussed with the Villages Fiscal Agent to purchase it with Water 7epartment funds. Councilman Bowden also suggested the Council look into the feasibility of purchasing the Plantreat, Inv, sewerage plant. Bowden moved, second by Cunningham and passed that the Ca~cwl ask the Village fiscal agents to make a feasibility study of the possible purchase of Pla,ntreat, Inc. by the Village. CounciLna,n Valier stated he was against the purchase at the present time since he believed other things were more important to the Village at the present time. Councilman Long asked if sewerage committee was active. Mayor Sylvester stated that this was and is a part of his future program and suggested more time for dis- cussion and further study. Councilman Bowden withdrew the motion and Counci]man Cnnning~ withdrew the second of the motion and no action was taken. Councilman Bowden presented an anonymous letter from a resident • of Gamelia Circle concerning the raising of dogs in that area. Mayor Sylvester said he would look into the matter. Councilman Valier voiced his disapproval of anonymous letters. The Village Clerk gave second reading by title only to an ordinance amending the off-street parking regulations in C-1 and C-2 Districts of the Village under Ordinance YJo. 43, Official Village Zoning Ordinance. Bowden moved, second by Valier and passed that the second reading be approved. The first reading have been approved February 20, 1968, Ordinance No, 144, was hereby pissed and adopted on second reading. Attorney Lord gave first reading to an ordinance to provide for an increase in cigarette tax to the Village from the increase in tax as approved by the State Legislature with an effective date of April 1, 1968. Bowden moved, second by Valier and unanimously passed that the ordinance be approved. All Councilmen being present and voting for the adoption, Ordinance No. 142 was hereby passed and adopted on first reading. Attorney Lord stated a petition for annexation had been received from Lowell E. and Carole J. Jarrett requesting the annexation of their property, Lot 9, Block D, Jupiter Manors, to the Village of Tequesta. Attorney Lord read an ordinance to provide for this annexation. Bowden moved, second by Long and unanimously passed that the ordinance be adopted. X11 Councilmen being present and voting for the adoption, Ordinance No. 143 was hereby passed and adopted oa first reading. The Village Council will hold a Public Hearing to adopt the zoning classification for this property on May 21, 1968. -38- 4 - 3-28-68 Attorney Lord presented a letter concerning the Country Club Point subdivision waterways and the Councilmen asked that it be consi- dered at a later date. A copy of the letter was given to a representa- tive of the property owners association from that area. The following residents spoke about the situation: Harry Finlay, Floyd Hopkins, Robert Calhoun, Robert Ludwig, Mrs. Raker, and Paul Engles. Most indicated they were not fully aware of the ultimate use to which this property could be used when they purchased their properties. Mayor Sylvester advised the delegation that he would discuss the situation with the owner, Mr. George W. Offutt, III, to see what, if any, protective measures could be worked out for the mutual benefit of all parties concerned. The Village Manager reported that starting January 1, 1968, the Village must assess and collect personal property and inventory tauea on orders from the office of the State Comptroller or be subject to possible loss of revenues (cigarette taxes) as remitted from the Comptrollers Office. The Village Manager reported on a meeting is Orlando on March I2, 1968, on this matter. -39- 5 - 3-28-68 The Councilmen were advised of a letter from Blair House East concerning cars parking and driving on the grass swale on Tequesta Drive at this location. Mr. Hopkins, President of B1a,ir House I~,st, was ad- vised "No Parking~~ signs could be erected by the Village if they wanted them. Bowden moved, second by Valier and passed that the North County First Aid Squad, inc, be pernu.tted to purchase gasoline from the Village for their ambulance. The matter of the Jupiter-Tequeata Community Fund~aluiual meeting which saamehow had been advertised for April 11, 1868, in the Village Hall was discussed and the Council were advised approval had not been give~i fc~r thi~t use of the Ha~.l. The Councilmen denied the use of this Hall for the meeting. The Councilmen set-7:00 P.M., Tuesday, May 21, 1968, as the time fora Public Hearing to act upon the application of Eastern Sales, Znc. to rezone their property lying west of Seabrook Road and north of the Junior Citizens Building from R-1 to $-2 zoning classification. A letter from Jahn C. Kiernan stating some suggestions he would like the Council to consider fora trailer ordinance was brought to the Council~a attention and no further action was taken on the proposed trailer ordinance at `,his time. Mr. John Stead complained to the Councilmen about the trash that • contractors allow to clutter up the areas where they are building and then its blowing around the area. The Village Manager advised that the Euilding Inspector had been asked to check out all builders on this matter and he could be asked again to keep a close scrutimy on aLl contractors and sub-contractors to see that they keep their building areas properly policed of trash and debris. A possible ordinance for the control of this matter will be looked into further. Mr. Paugh advised that the Sewerage Comtittee meets the first Monday of each month and either he or Mr. St~a,llow would like to report on the progress and work of the Committee at each Council meeting and they will be placed on the agenda for each meeting. There being no further business, the meeting was adjourned at 10:22 P.M.
