HomeMy WebLinkAboutMinutes_Regular_06/18/1968I~TUTF,S OF THE + + TI~s OF TGIF COUATCILM~A1 OF TIC VII~IAGB OF T~C~~STA, FIORIDA The regular monthly meeting of the Counci7n~en of the Village of Tequesta, Florida, was held Tuesday, June 18, 1968, at 8x00 P.M. at the Village Hall. Councilmen present were: Messrs: Sylvester, Valier, Bowden, Fong and Cunningham. Also present were ~iobert Harp, Village A~1a,nager and C1erIt and Ir~ill;am ~. Lord, Village Attorney. The meeting was opened with prayer and the Pledge of Allegiance to the Flag by Mayor Sylvester. Mayor Sylvester advised the audience in attendance that the water situation would be discussed first since that was apparently aahat most of the audience was in attendance for. He further stated that the remarks and questions were to be recorded and answers would be provided, if necessary, following a review of the tape. Mr. Bowden advised the meeting that he had met for about two hours with Mr. B. C. Sharpe in person on a Sunday afternoon discussing the contents of the letter of January 2, 1968, which Mr. Sharpe had sent to him concerning die purchase of the Water Company by the Vil]age. Mr. Bowden also read and had distributed to the audience, a statement explaining the purchase price paid and future commitment to the Tequesta, 4later Co., Inc. (see copy attached to these Minutes). The Village Attorney, William A. I;ord, spoke about the Villa,ge~s purchase of the Tequesta Water Co., Inc. ~:e stated that he acted solely in beha 1f of the Village of Tequesta in the negotiations for the purchase and did not act as attorney for or represent the seller in the negotiations. He further discussed the following: 1. Why did the Village purchase the water company? 2. Was the water company worth the price paid ? 3. ~dhy have the rates increased? ~. What is the purpose o~ the demand charge? 5. taThy is there a 25~ charge on users outside the Village limits? The Village Manager read a letter from the mater Department engineers, Brockway, Owen £~ Anderson Engineers, Inc., signed by Charles ~'. ~inderson, recommending that no revision in rates be effected at this time and that a rate evaluation be delayed until at least a six months operating record is obtained under conditions which would more nearly reflect anti- cipated average water sales and operating expenses. Various members' of the audience asked questions concerning dif- ferent items relative to the purchase oi° the water company and answers were given by the Village Attorney, Vi1la,ge Engineer or Councilmen. The water discussion was c®ncluded at 9:07 P.M. Boerden moved, second by Cunningham and passed that the reading of the Minutes of the May meeting be waived. Valier moved, second by Long and passed that the detailed reading of the financial statement for N1ay 1968 be waived. The Village Manager -52- 2 - 6-18-68 recapped the receipts and disbursements for the eight (8) months period ended Map 31, 1968, and upon motion by Bowden, second by Cunningham and passed, the financial statement and disbursements for-the month of 1'~a.y were approved. Mayor Sylvester reported on the recent decision of Solitron Devices, Inc. to locate a new plant on Indiantown Road. The Village Mana- ger read a Resolution welcoming Solitron Devices, Inc. to the Jupiter- Tequesta area. Bowden moved, second by Long and unanimously passed tha'c the Resolution be passed and adopted and a copy be spread upon the Minutes of the meeting (copy attached). Mayor Sylvester suggested that 'che Village contact the Florida mast Coast 1Ba,ilway Company asking their permission for the pillage to pro- vide beautification of their right-of way on the north and south side of Tequesta Drive. The Mayor further suggested that the Village start to consider implementing the drainage plan where necessary. Sergeant John Rodericlc presented the Police Department and Civil Dei°ense Reports for the month of May, 1968, in the absence of Police Chiei Dusenbery who is on vacation. ° Councilman Cunningham presented his ideas pertaining to require- ments to provide adequate screening for commercial areas which abut resi- -53- 3 - 6-18-68 dential areas. The Council will consider and study the proposal and a • ~'ublic Hearing on the subject will be held at 7:30 P.M., Tuesday, August 20, 1968, for the purpose of amending the Zoning Ordinance to provide for such screening. Counci Lean Cunningham also presented the Council with proposed rules and regu]a,tions for use of the Village I~1a11 by various organizations as follows: 1. Available to service type (not social) organizations having SOib or more members who reside i.n or own property in Tequesta on a first come, first serve basis. 2. Hall to be available on Tuesday and ~Tednesday nights only expept the third Tuesday of each month which is the regula r Council meeting night. 3. Ito food or drink to be served in tho building. 4. Must reserve meeting night wi th the Tillage P~1a,na,ger at least one week in advance. The Council was advised there would be a matter of security for the rest of the building since the rest rooms are located on the Administrative side and TrJater Department side of the ®i1la,ge Hall. The matter was tabled for further study. Gounci]ma.n Bowden suggested that the Vil].a.ge consider changing the Village Charter to provide for a third ward which would probably en- • compass all that area of the 9illa,ge which would lie east of U. S. High- way No. 1. He also advised that the Tillage residents and taxpayers be advised of the drainage report as compiled and presented by Brockway, Owen and Anderson Engineers, Inc. He further stated he had been in contact with persons in several areas about annexation to the Village. He also advised that the Villages letter to the Jupiter Fire Control District about fire hydrant rental fees was not a demand but a suggestion that the District consider this matter for their 1968-1969 budget. :-fie stated he believed the Village should accept ~.re Chief Baird~s proposal to meter the amount of water the Fire Department might use from hydrants for the prevention and extinguishment of fires and that the Fire Department would pay for the water so used at the prevailsng rate per 1,000 gallons. Howden moved, second by Valier and unanimously passed that the Village accept Chief Baird~s offer for the Fire Department to pay for water used to fight fires at the prevailing rate per 1,000 gallons but the Jupiter Fire Control District is to be further advised that this does not affect the i-,atter of fire hydrant rental charges as provided for in Ordinance No. 13~, which has not b~nresolved but is being carefully studied by the Village Council and its 1ega,1, fiscal and engineering consultants. Mr. Joseph La.terza, consulting engineer for Mr. ~:~il.].iam E. Schlusemeyer and Irving Schlusemeyer, ~;ppeared before the Council to a~btain prel.ima.nary approval o~" the proposed condominium plat for the west side of Seabrook Hoad, north of the Junior Citizens Building. The question of drainage for the proposed subdivision ~ra,s discussed with Mr. Laterza stating that the natural contour of the ground was from west to east to Seabrook toad. A letter from Hobert L. OtiTen, Brockway, Owen €~ Anderson Engineers, Inc. re]ative to drainage in this area had been foru~rarded to each CounciLnan. This letter recommended that no additional surface run- off be permitted to drain toward the intersection of Seabrook 14oad and -5~,- ~'. - 6-1S~6S Tequesta Drive. All parties concerned were aware of the existing drainage problem at this intersection. The ,letter also presented proposed costs for providing a drainage system from Tequesta Drive west to the north fork of the Loxahatchee River as proposed i.n the over-all Village Draima.ge ~°lan for the Village, showing estimated cos'cs for various sections of the system. The Council were in general agreement that something should be done to alleviate the existing condition at Seabrook Road and Tequesta Drive. They were also in general agreement that the proposed plat should not be held up because of the existing conditions but should provide some relief of these conditions. Eastern Sales, Inc. offered the sum of $1,000. to be used to help defray the cost oz" construction of a drainage pipe under Tequesta Drive at Seabrook Road. The Councilmen noted that Seabrook Road is a County road and there could be a possibility that the Eoard of County Conuuissioners of Palm Eeach County would share the cost of construction to relieve the condition at this intersection. A tentative meeting was scheduled for 3:30 P,M,, Friday, June 21, 1965, with representatives of the Village, Air. Laterza and County Comau.ssioner E. F. Van I~essel to discuss what could be done at the intersection ~;~ith an~r proposals to be presented to the Villages engineer for his consideration and recommendations. Cunningham moved, second bg Eowden that the Village accept the $1,000. from Eastern Sales, Inc. to be used toward the cost of the solution of the drainage problem at Seabrook ~doad and Tequesta Drive, that the Village proceed to find a solution to this drainage problem, and that the preli- rniraa,ry plat be approved. Eowden, Cunningham and Sylvester voted for the motion with IAng and Valier voting against the motion because of the drainage problem. Eowden moved, second by Cunningham and passed that we advise the Palm Eeach County Community Action Council that the Village does not want to participate in. the Economic Opportunity Act. Long moved, second by Cunningham and passed that the Tax Assessors request for an extension of time for presentation of 1965 Tax Roll be approved. The Tax Roll wall be presented to the Council at the August Council Meetiaag at eahich time the Council will sit as a Eoard of Equalization of Taxes . Eowden moved, second by Cunnsngha,m and passed that the written request from Village Realty, Inc. requesting an additional six (6) months Developers Sign Perm_i.t for their sign located on the north side of Tequesta Drive at Venus Avenue be approved, su'oject to receipt of fee and applica- tion. Eowden moved, second by Cunn?n~~ that the sum of $1,500. be contributed to the Jupiter-Tequesta Chamber of Commerce for use in con- nection with the Solitron Devices promotion which brought that company to the area, Mr. Paugh reported that no~much activity is taking place with the committee working on the proposed forraa,tion of a Sewerage District. • The Village Manager advised that a contract between the Water Department and the U. S, Coast Guard had been renewed for a year from July 1, 1965, to June 30, 1969. Re further reported that the first interest -55- 5 - 6-18-68 payment of. $26,.575. on the 1,063,000. Ulater Revenue Certificates would be paid pra.or to July 1, 198, to Manufacturers t~anaver Trust Company, • P1ew York, Mew York, the paying agent for the issue. ~Ie also reported that the water line relocation across the Intracoastal ti~la~erway had been completed. The Village Clerk read an ordinance providing for the amending of the Village Zoning Ordinance to change the zoning cla,ssifica.tion of a parcel of ]and owned by Mrs . Jennie Zi egler from C-1 to R-2 cla,ssifica,tion. Bowden moved, second by C,~+n;ngham that the ordinance be approved. All CounciLnen being present and voting for the adoptit+n, Ordinance No. 147 was hereby passed and adopted on first reading. Upon motion by Valier, second by Dowden and passed, the Tax Collector was authorized to transfer Tax Sale Certificates Mo. 4-65 and 1-66, on Lot No. 159, Tequesta, to the ptar~.~c~,ser of the 1967 Tax Sale Certificate on the same property, upon receipt of amount due plus interest. The Village Manager advised that the Tax Sale was held on June 12, 1968. Two certificates were sold, one remains to be sold and due to an error in advertising, one must be re-advertised and ano~th.er sale held. Mr. hadlec, from Country Club Point, suggested that the Vil]age get some definite figures for dredging tine canals in Country Club Point. Mayor Sylvester said he would look into the possibility of a local builder taking the dredged material for fill for lots. • The Village Maintenance Department is to see if anything can be done to relieve the flooded condition at ~~illow Foad and Tequesta Drive during heavy rains. Purchase Price Paid And Future Commitment To The Tequesta ~7ater Company, Inc. Many times the press has published and others4~a,ve stated that the Village of Tequesta purchased the Tequesta Water Company, Inc. at a price of $1,700,000. This is emphatically wrong. The Purchase and Sales Agreement dated August 14, 196?, provided a price of $968,000. based on the volume of existing business at June 30, 1967, wi'ch subsequent yearly payments for additional equivalent connections producing annual revenue of $94.60 for a sixteen year period not to exceed $637,000., a maximum price of $1,605,000. The Village of Tequesta authorized and issued, validated by the Circuit Court, $1,700,000. of SI Revenue Certificates and its dis- position follows: For Purchase Price of Tequesta j~ater Co., Inc. $ 800,000. (engineers) to appraise .the physical properties and at August 31 1967, determined that the replacement depreciated value was $951,000. The Council engaged. the service of Sullivan Nelson ~ Goss, Inc. and. Thomas M. Cook ~ Co., jointly, (fiscal agents) to prepare a feasibi- lity study based on existing business at august 31, 1967, and recoimmended a price of $900,000. The full Council approved tldis price and proceeded bo finalize negotia, tions . The Purchase and Sales Agreement provides that for a period of sixteen years additional bonds will -~'vered at the rate of $500.00 for each additional equivalent connection:, _t~o exceed $637,000. (1274 at $500.) a maximum final pt~ice for the system`®~ X1,605,000. If this amount has not been paid at the end of s~a~cteen years,~further payments cease and the Village agreed maximum purchase`~p~ice of $1,605,000. is reduced by the difference. An equivalent connection is determined by increased revenue of $94.60 and not by count of actual number of connections. 6-18-68 GEB
