The regular monthly meeting of the Councilmen of the Village
of Tequesta, Florida was held Tuesday, Ueptember 17, 1968, at 8:00 P.Ni.
at the Village Hall. Councilmen present were: A~Iessrs. Sylvester, Long
and Cunningham. Also present was Hobert ~Iarp, Village N(anager and Clerk.
The meeting was opened with prayer and the Pledge of Allegiance
to the Flag by Councilman Cunningham.
The Minutes of the meeting of l~Ltgust 20, 1968, were read and
approved as read.
Cunningham moved, second by Long and passed that the detailed
reading of the financial statement for August, 1968 be waived. The
Village Manager recapped the receipts and disbursemen~,s for the eleven (11)
months period ending August 31, 1968, and upon motion by Long, second by
Cunningham and passed, the financial statement and di~.bursements for the
month of August were approved. F~alances on eland at August 31, 1968, were
as follows:

The Village Manager presented his report for the month of

Mayor Sylvester presented his report for August, 1968.
Councilman Long and Mr. 'adlec reported there had been no further
progress in negotiations for possi~le purchase of the Junior Citizens
property.

Councilman Cunningham reported on COG and advised that tl-xa~_:c
meetings were held the fourth Wednesday of each month.
Police Chief Dusenbery presented the Police Department and Civil
Defense reports for the month of August.
The Village Clerk read an ordinance amending the Zoning Ordi-
nance to provide for the construction of austra Tian pine hedges on property
zoned C-1 and C-2, that lie adjacent to residential property; providing
for the size, location and time of planting; and providing penalties for
the violation thereof. Cunningham moved, second by Long and passed that
the first reading be approved.
The Village Clerk read an ordinance regulating the parking of
boat trailers and fold down tent trailers ors public and pri~rate property
~rithin the Vi1la,ge. Action on the ordi~-~znc~; ~,ra,s tabled for further study
and consideration to have the wording of the ordii^.anae include the word
boats; a time limit; a clearer explanation of Sectior~ 3 as to front, rear
and side line restrictions; and Section 5 to end E,iith words 'while so
parked".
- The Village Clerk read an ordinance amending Ordinance Pio. 19
relating to the plumbing code of the Village by adopting the plumbing
code of Palm Beach County, Florida, presently in force. Mr. Joe Elizzard,
a Village resident and principal in tlorth County Construction Company,
a local plumbing boncern, e~~pressed his opposition to several items of
the existing plumbing code bf Palm Eeach County. He stated the code should
• include: 1. %-H cast iron pipe in 'ouildings over 3 stories in height;
2. €~aste arms on multi-story buildings over 3 stories to be "L" type
copper or S-H cast iron; 3, Eliminate use of unperforated bituminous fiber
pipe; 4. provide that PVC shall not be used inside underground or multi-
story buildings or in one story dwellings; 5. Jointing requirements
should include words "suitable gas2{ets"; 6. ~7ater piping and tubing should
specify "L" or "K" type copper tubing and fittings and eliminate PVC com-
pletely with inside underground to be "L" or "1~" type copper. He dis.-
played various types of PVC presently being used in various areas. He
stated he was not against the use of P7C but thought the code should be
more restrictive in the use of this material. Wilbur Oldham of I~-ilbur
Plumbing stated he believed the e.~cisting Palm Beach County Plumbing Code
was satisfactory. Action on the ordinance was tabled and the matter is
to be submitted to the Village engineers for their opinion on the existing
Palm Beach County Plumbing Code and to consider amendments and changes as
proposed by Mr. Blizzard.
A letter had been received from r~r. Joseph T. Laterza, engineer,
certifying that Eeaeon Street, Church P.oad and Franklin load, recently
installed by Mr. Schlusemeyer, had been done according to plans and speci-
fications. Long moved, second by Cunningham and passed that the roads
be accepted for normal maintenance.
Mayor Sylvester advised thaw a letter had been received from
Dr. George M. Shearer, Ju zter Inlet Colony, requesting the Village sub-
• rtit a proposed thirtp (30~ year water franchise to them for consideration
of their Commissioners. It was suggested that perhaps their attorney
should prepare the franchise since Jupiter Inlet Colony would be granting
the franchise to the Village of Tequesta hater Department, however, the
Village Manager will speak with the Village Jttorney and see if he would

write the franchise agreement which would include: 1. For 30 year re.io~'.;
. 2. 25~ surcharge; 3. IJater Department gill consider Jupiter Inlet Co:io:xy
as a preferred customer; 4. dates to Jupiter Inlet Colony will be same
as charged to Village customers; 5. The franchise xee well be 6~ of gross
annual water sales. The Council were in agreement to enter into such a
franchise agreement with Jupiter Inlet Colony.
A letter was received frog: the Tequesta Country Club Community
Association, Inc. stating they had recently planted the road rights-of-way
at each end of Point Circle where it intersects with River Drive and that
cars and .trucks were continually parking on the newly seeded areas. The
Association requested that these areas be posted "no parking". Cunningham
moved, second by Long and passed that these areas be posted as requested.
The Councilmen were advised of a problem that had atiseh in the
sale by bffutt to Smith and Deschields conceYninb an old agreement between
a A~Ir. Flanagan, Mr. Schlusemeyer and Jupiter ~Jater Com~,any dated February 19,
1958, giving the Jupiter Water Company penuission fora watet~ main and
proposed pump site on the property under contract for sale, The agreement
was filed Nia,rch 3, 1959, in OBE 327, page 603 through 609, of the records
of Palm Eeach County, Miss Eva ~1liott of John F. Doran, Inc. hid written
requesting the Village to give a quit claim deed to any interest they
might have in the subject property. Cunningham moved, second by Long and
passed that the Mayor and Vi1la.ge Cleric be authorised to sign such a quit
claim deed providing such action has the approval of the Village Attorney.
A [~Torkshop Meeting was scheduled for ? : 30 P .M. , L~~ednesday,
• September 25, 1968, and a Special Council Meeting was scheduled for 8:00 '?.P~i.,
Monday, September 34, 1968, for adoption or" the budget and to set the 1968
millage rate.
Mayor Sylvester advised that the Water Department was looking
into the purchase of 15 acres of land which lies east of the Old Dixie
xiighway and south of the County Lane road fora new well field site.
Details of the transaction are being worked upon.
The meeting was advised that a proposal from Teleprompter Corpo-
ration fora CATV Franchise had 'peen rei"erred to the appropriate COG Com-
ma.ttee for their study.
The Pillage Manager advised that an application fora new well
for the Water Department had been forwarded to the State Health Department.
..e also reported that the U~later 7epartraent financial figures for the sax (6'~
months period ending August 31, 1968, had been forwarded to the Water Depa rt-
ment Fiscal Agent, Engineers and Village Attorney to consider, study and
review to see if a rate revision is possible at the present time.
Mr. Middleton, from ~;-hitehall A;~artraents, stated he was concerned
about the unsightlyness of yard trash that. is placed at the street line of
Village residences and asked that this matter be placed on a workshop meeting
agenda for further study and consideration.
