At the Special Council Meeting held on October 31, 2005, the Council voted to waive Section 14-1(a) of the Code of Ordinances of the Village of Tequesta, Florida, prohibiting construction work on Sunday's and Holiday's, to assist homeowners with their repairs resulting from Hurricane Wilma damage. The immediate wavier was set to expire at the next Council Meeting of November 17, 2005. At that time consideration for an extension of time would be given. Staff recommends an extension of time until November 30, 2005. • • BUILDINGS AND BUILDING REGULATIONS ARTICLE I. IN GENERAL Sec. 14-1. Limitations on days and hours of work on buildings. (a) No person shall conduct the erection (in- cluding excavating), demolition, alteration or re- pair of any building in the village on Sundays or legal holidays. (b) No person shall conduct the erection (in- cluding excavating), demolition, alteration or re- pair of any building on weekdays, including Sat- urdays, other than between the hours of 7:00 a.m. and 6:00 p.m. (c) No person shall deliver building supplies or materials during the hours when erection, demo- lition, alteration or repair of any building is forbidden by this section. (d) There shall be no contracted labor or ser- vices, excluding janitorial services, performed on any yard or building in the village on Sunday or legal holidays, and on weekdays, including Satur- days, other than between the hours of 7:00 a.m. and 6:00 p.m. (e) The conduct described in this section may be carried on in cases of urgent necessity where health or safety is involved. (Code 1977, § 6-1) Sec. 14-2. Numbering of buildings. The building official, br other official desig- nated by the village council, shall provide for the numbering of all houses and buildings within the village, and shall maintain a map in the office of the village showing the numbers. (Code 1977, § 6-2) Sec. 14-3. Control of dust and blowing sand. (a) During the course of any construction or demolition work being done on any premises, it shall be unlawful for any person to cause, permit or allow the emission of particulate matter from any source whatsoever, including but not limited to incidents caused by vehicular movement, trans- portation of materials, construction, alteration, demolition or wrecking of buildings or structures, or the stockpiling of sand or dirt, without taking § 14-32 reasonable precautions to prevent such emissions or to preclude such particulates that may trespass on neighboring properties during dry and windy weather.. In the case of stockpiled particulate materials, such materials shall be stabilized by adequate coverings, by wetting, by approved chem- ical application or by other approved means, to the satisfaction of the building official. (b) In addition to other remedies for violations of this Code, the violation of this section shall constitute grounds for the issuance of a stop work order by the building official in accordance with the provisions of the building code. (Code 1977, § 6-3) Secs. 14-4-14-30. Reserved. ARTICLE II. BUILDINGS Sec. 14-31. Florida Building Code adopted. The Florida Building Code, 2000 edition, of which copies have been and are now filed in the office of the building official of the village, is hereby adopted and incorporated as if set forth at length herein, and from the date on which this section shall take effect, the provisions therein shall be controlling in the area of jurisdiction of the village. The countywide uniform amendments to the Florida Building Code, 2000 edition, section 103.5, relating to unsafe buildings or systems, including sections 103.5.1 through 103.5.6 inclusive, are hereby adopted and incorporated as if set forth at length in this section and from the date on which this section shall take effect the provisions therein shall be controlling in the area of jurisdiction of the village.
