STAFF SUMMARY AND COMMENTS:
Grassy Flats Restaurant, located at 157 U.S. Highway One in the Tequesta Shoppes (previously
Eatsy's Cafe) being represented by Michael R. Vaccaro, is applying to:
Receive a variance from the Village of Tequesta's Code of Ordinances, which
does not allow intoxicating beverages to be sold for consumption on the
premises within 1,000 feet of a church, school or youth center.
APPLICABLE ZONIlYG REGULATIONS:
Section IX. Supplemental Regulations, Division 1. Generally, Sec. 78-298, Establishments
Selling Intoxicating Beverages.
Sec. 78-298: "All places of business selling intoxicating liquors, wines and beverages
for consumption on the premises shall not be located within cone-thousand-foot
radius of any church, school or youth center. The one thousand (1,000) feet shall
be measured in a straight line from main entrance door to main entrance door."
STAFF COMMENTS:
The applicant is seeking relief from the regulation outlined above in order to sell intoxicating
liquors, wines and beverages for consumption on the premises of Grassy Flats restaurant located at
157 U. S. Highway One, Tequesta, Florida. The restaurant is to be within 1000 feet of the front door
of St. Jude's Church located at 204 U. S. Highway One, Tequesta.
The measurement from the front door of the Church to the front door of the proposed restauranrt is
722 feet based on GIS measurements (please refer to the map and aerial photo attached)
Research into the area confirmed that there are several other restaurants that have received
variances for being situated within 1000 feet of St. 7ude's Church. These current and past
restaurants include:
1) The Heidelberg Restaurant located in Fashion Square Mall, serves beer and wine and
is applying for a liquor license.

2) Poncho and Pepe's Mexican Restaurant, also located in the Fashion Square Mall, serves
beer and wine.
3) Giacomo's was a restaurant that served alcohol and was located in the same tenant
space.
4) A restaurant known as Brandywine Downs served alcohol and was located in the far
northern space of the Tequesta Shoppes.
STAFF RECOMIVI~NDATIONS:
Previous variances for this ordinance addressed the hours of operation and the transferability of the
variance. Staff recommends that the variance be approved with these conditions:
1) The Village Council should address the hours of operation. The Village of Tequesta's
Code of Ordinances; Part II, Chapter b, Alcoholic Beverages, Section 6-1, Hours of
Operation states:
"No intoxicating or alcoholic beverages maybe sold in sealed
containers or otherwise, for consumption on or off the premises,
or served or permitted to be served, or consumed in any place
holding a beverage license from the Village, or in any public
place within the territorial limits of said Village by any person,
persons, firm or corporation, vendor or distributor between the
hours of 3:00 a.m. and ?:00 a.m., of the same day on weekdays,
and between the hours of 3:00 a.m. and 8:00 a.m. of the same day
on Sundays. Nothing herein shall be deemed to prohibit the sale
of intoxicating beverages during the lawful hours of sale on Sunday."
2) That the variance be deemed non-transferable, that is, that the variance remain tied to both
the exact location (157 U.S. Highway One) and to the exact lessee of the tenant space
(Michael R. Vaccaro). This will ensure that if another tenant takes over the space, the new
lessee will be required to file for a variance. It will also ensure that if the current lessee
moves the restaurant to another location within 1000 feet of any church, school or youth
center, the Village Council will be able to research the new restaurant before allowing
another variance.

Public Notice is hereby given that the Village of Council of the Village of Tequesta has rescheduled
the Public Hearing for the Village Council Regular Meeting from Thursday, November 10, 2005 to
Thursday, November 17, 2005 beginning at 7:00 P.M., in the Tequesta Recreation Center, 399
Seabrook Road, Tequesta, Florida to consider:
An application from Michael R. Vaccaro, lessee of the property located at
157 U.S.Highway One, Tequesta Shoppes, requesting a variance to
the terms of the "Official Zoning Ordinance of the Village of Tequesta,
Florida", Article IX. Supplemental Regulations, Division 1. Generally,
Sec. 78-298, Establishments Selling Intoxicating Beverages:
Sec. 78-298 -All places of business selling mtoxicatrng liquors, wines and
