Couzzo, Jr., Village Manager FROM: Jack Horniman, Village Planning Consultant DATE: October 12, 2005 RE: Gallery Grille Restaurants STAFF SUMMARY AND COMMENTS: Gallery Grille Restaurant, located at 383 Tequesta Drive in Gallery Square North, being represented by Bruce Nierman is applying to: Receive a variance from the Village of Tequesta's Code of Ordinances, which does not allow intoxicating beverages to be sold for consumption on the premises within 1,000 feet of a church, school or youth center. APPLICABLE ZONING REGULATIONS: Section IX. Supplemental Regulations, Division 1. Generally, Sec. 78-298, Establishments Selling Intoxicating Beverages. Sec. 78-298: "All places of business selling intoxicating liquors, wines and beverages for consumption on the premises shall not be located within aone-thousand-foot radius of any church, school or youth center. The one thousand (1,000) feet shall be measured in a straight line from main entrance door to main entrance door." STAFF COMMENTS: The applicant is seeking relief from the regulation outlined above in order to sell intoxicating liquors, wines and beverages for consumption on the premises Gallery Grille restaurant located at 383 Tequesta Drive. The restaurant is to be located within 1000 feet of the First Baptist Church located at 411 Tequesta Drive; Church of the Good Shepherd located at 400 Seabrook Road; and the Village Recreation Center located at 399 Seabrook Road, all located within Tequesta, Florida. Therefore, a variance is required. STAFF RECOMMENDATIONS: Previous variances for this ordinance addressed the hours of operation and the transferability of the variance. Staff recommends that the variance be approved with these conditions: 1) The Village Council should address the hours of operation. The Village of Tequesta's Code of Ordinances; Part II, Chapter 6, Alcoholic Beverages, Section 6-1, Hours of Operation states: RE: Gallery Grille Restaurant October 12, 2005 Page 2 - "No intoxicating or alcoholic beverages maybe sold in sealed containers or otherwise, for consumption on or off the premises, or served or permitted to be served, or consumed in any place holding a beverage license from the Village, or in any public place within the territorial limits of said Village by any person, persons, firm or corporation, vendor or distributor between the hours of 3:00 a.m. and 7:00 a.m., of the same day on weekdays, and between the hours of 3:00 a.m. and 8:00 a.m. of the same day on Sundays. Nothing herein shall be deemed to prohibit the sale of intoxicating beverages during the lawful hours of sale on Sunday." 2) That the variance be deemed non-transferable, that is, that the variance remain tied to both the exact location (383 Tequesta Drive) and to the exact lessee of the tenant space (Bruce Nierman). This will ensure that if another tenant takes over the space, the new owner will be required to file for a variance. It will also ensure that if the current lessee moves the restaurant to another location within 1000 feet of any church, school or youth center, the Village Council will be able to research the new restaurant before allowing another variance.
