In reference to your Complaint in regards to Joe Petrick and Code
Enforcement, we have reviewed the case along with your complaint.
Your complaint stated that You felt Joe Petrick was ineffective, unknowledgeable, and
inappropriate in regards to handling your case. You stated that Joe Petrick issued a
notice of hearing without a prior notice of violation, that you have not received an
official notice of violation as of the date ofyour complaint, and that Joe Petrick advised
you that the ordinance required all pools to have a screened enclosure.
The Magistrate has determined thatproper notice ofthe violation and hearing was
given. In reference to the term "screening" the code states; (Sec. 78 -585 -Child -resistant
barrier required) All pools shall be enclosed andprotected by a child -resistant barrier
meeting the requirements setforth in the latest adopted edition ofthe Standard Swimming
Pool Code.
After reviewingyour complaint Ihave notfound any violations ofdepartment policy.

The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Hearing held on the 180' day of December, 2008, and based
on the evidence and testimony presented, entered an Order Finding Violation. The following
Findings of Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
I . The Respondent(s), Kevin & Karen Newfield, were present at the hearing and
there was a finding of proper notice of the violation and the hearing.
2, The code compliance officer provided evidence and testimony of the violation.
3. The Respondent, Kevin Newfield provided additional evidence and testimony.
CONCLUSIONS OF LAW
Based on the above -stated facts, Respondent(s) is in violation of Section(s) 78-585 of the
Code of Ordinances of the Village of Tequesta and such violation constitutes a serious threat the
health, safety and welfare of the public.

ORDER
It is the Order of the Code Compliance Special Magistrate that Respondent(s), Kevin &
Karen Newfield, shall comply with Section(s) 78-585 of the Code of Ordinances of the Village
of Tequesta, immediately by erecting a swimming pool barrier that is compliant with the Village
Code, including the applicable swimming pool barrier codes.
FURTHERMORE, PURSUANT TO §§162.06(4) AND 162.09(l), F.S., THE VILLAGE OF
TEQUESTA IS HEREBY AUTHORIZED TO ENTER UPON THE PROPERTY AND ABATE
THE HEALTH, SAFETY AND WELFARE VIOLATIONS IF RESPONDENT HAS FAILED
TO DO SO AFTER ONE WEEK FROM THE RENDERING OF THIS ORDER. SUCH
AUTHORIZATION DOES NOT CREATE A CONTINUING OBLIGATION ON THE PART
OF THE VILLAGE TO MAKE FURTHER REPAIRS OR TO MAINTAIN THE PROPERTY.
Any costs incurred by the Village to abate the health, safety and welfare violation shall be
assessed against Respondent. Additionally, a fine in an amount not to exceed $250.00 per day
may be imposed against Respondent if Respondent fails to comply with this Order. A Fine
Assessment Hearing will be held before the Special Magistrate on the 22 d Day of January, 2009,
at the Village of Tequesta Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469.
Should you violate the same Section of the Code again, you may be subject to a fine of up
to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the Code
Inspector is not required to give a reasonable time to correct the repeat violation and the case may
be presented to the Special Magistrate even if the repeat violation has been corrected prior to the
Special Magistrate hearing.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondent(s) to contact the Code Compliance Division at (561) 575-3826 to request a
reinspection of the property.

• SWIMMING POOLS
R4101.15 Gas piping. Gas piping shall comply with the
Florida Building Code, Fuel Gas.
R4101.16 Electrical. Electrical wiring and equipment shall
comply with Chapter 27 of the Florida Building Code.
R4101:17 Residential sv"mt of bate alrement. Res-
idential swimming pools shall comply with Sections
R4101.17.1 through R4101.17.3.
Exception: A swimming pool with an approved safety pool
cover complying with ASTM F 1346.
R4101.17.1 Outdoor swimming pools. Outdoor swim-
ming pools shall be provided with a barrier complying with
R4101.17.1.1 through R4101.17.1.14.
R4101.17.1.1 The top of the barrier shall be at least 48
inches (1219 mm) above grade measured on the side of
the barrier which faces away from the swimming pool.
The maximum vertical clearance between grade and the
bottom of the barrier shall be 2 inches (51 mm) measured
on the side of the barrier which faces away from the
swimming pool. Where the top of the pool structure is
above grade the barrier may be at ground level or
mounted on top of the pool structure. Where the barrier is
mounted on top of the pool structure, the maximum verti-
cal clearance between the top of the pool structure and
the bottom of the barrier shall be 4 inches (102 mm).
R410117.1.2 The barrier may not have any gaps, open-
ings, indentations, protrusions, or structural components
that could allow a young child to crawl under, squeeze
through, or climb over the barrier as herein described be-
low. One end of a removable child barrier shall not be re-
movable without the aid of tools. Openings in any barrier
shall not allow passage of a 4-inch-diameter (102 mm)
sphere.
R4101.17.1.3 Solid barriers which do not have openings
shall not contain indentations or protrusions except for
normal construction tolerances and tooled masonry
joints.
R4101:17.1A Where the barrier is composed of horizon-
tal and vertical members and the distance between the
tops of the horizontal members is less than 45 inches
(1143 mm), the horizontal members shall be located on
the swimming pool side of the fence. Spacing between
vertical members shall not exceed 13/4 inches (44 mm) in
width. Where there are decorative cutouts within vertical
members, spacing within the cutouts shall not exceed 13/4
inches (44 mm) in width.
R410L17.1.5 Where the barrier is composed of horizon-
tal and vertical members and the distance between the
tops of the horizontal members is 45 inches (1143 mm) or
more, spacing between vertical members shall not ex-
ceed 4 inches (102 mm). Where there are decorative cut-
outs within vertical members, spacing within the cutouts
shall not exceed 13/, inches (44 mm) in width.
R4101.17,1.6 Maximum mesh size for chain link fences
shall be a 211, inch square (57 mm) unless the fence is
provided with slats fastened at the top or bottom which
reduce the openings to no more than 13/4 inches (44 mm).
R4101.17.1.7 Where the barrier is composed of diagonal
members, the maximum opening formed by the diagonal
members shall be no more than 13/4 inches (44 mm).
R4101.17.1.8 Access gates, when provided, shall be
self -closing and shall comply with the requirements of
Sections R4101.17.1.1 through R4101.17.1.7 and shall
be equipped with a self -latching locking device located
on the pool side of the gate. Where the device release is
located no less than 54 inches (1372 mm) from the bot-
tom of the gate, the device release mechanism may be lo-
cated on either side of the gate and so placed that it
cannot be reached by a young child over the top or
through any opening or gap from the outside. Gates that
provide access to the swimming pool must open outward
away from the pool. The gates and barrier shall have no
opening greater than'/, inch (12.7 mm) within 18 inches
(457 mm) of the release mechanism.
R411.171.9 Where a wall of a dwelling serves as part
of the barrier, one of the following shall apply:
1. All doors and windows providing direct access
from the home to the pool shall be equipped with
an exit alarm complying with UL 2017 that has a
minimum sound pressure rating of 85 dB A at 10
feet (3048 mm) and is either hardwired or of the
plug-in type. The exit alarm shall produce a con-
tinuous audible warning when the door and its
screen are opened. The alarm shall sound immedi-
ately after the door is opened and be capable of be-
ing heard throughout the house during normal
household activities. The alarm shall be equipped
with a manual means to temporarily deactivate the
alarm for a single opening. Such deactivation shall
last no more than 15 seconds. The deactivation
switch shall be located at least 54 inches (1372
mm) above the threshold of the door. Separate
alarms are not required for each door or window if
sensors wired to a central alarm sound when con-
tact is broken at any opening.
Exceptions:
a. Screened or protected windows having a bot-
tom sill height of 48 inches (1219 mm) or more
measured from the interior finished floor at the
pool access level.
b. Windows facing the pool on floor above the
first story.
c. Screened or protected pass -through kitchen
windows 42 inches (1067 mm) or higher with a
counter beneath.
2. All doors providing direct access from the home to
the pool must be equipped with a self -closing,
self -latching device with positive mechanical
latching/locking installed a minimum of 54 inches
(1372 mm) above the threshold, which is approved
by the authority having jurisdiction.
R4101.17.1.10 Where an aboveground pool structure is
used as a barrier or where the barrier is mounted on top of
the pool structure, and the means of access is a ladder or

VIOLATION PROCEDURES
The issuance of this Notice of Violation or Notice of Hearing
is under authority of FSS 162. It is a Civil Infraction which
requires immediate attention.
Option One
If you receive a Notice of Violation and you want to avoid being
issued a Notice of Hearing you must complete the following
steps:
1. Repair/correct the violation by the date specified.
2. Contact the Village Code Enforcement Officer at
561-575-6213 / 561-575-6210 to arrange an inspection, and
3. Meet the Code Enforcement Officer on the premise to verify
the violation has been corrected.
Option Two
If you received a Notice of Violation and you do not repair/cor-
rect the violation by the date specified on the violation form, the
Code Enforcement Officer may issue you a Notice of Hearing. If
you receive a Notice of Hearing you must complete the following
steps:
1. Notify the Code Enforcement Officer at least 10 days prior to
the hearing date of any witnesses and/or Attorney you may
hire to represent you.
2. Attend the hearing and plead your case in front of the Code
Enforcement Board/Special Master.
3. Satisfy the requirements of the Code Enforcement Board/
Special Master.
Option Three
1. If you should decide to contest your case and are found
guilty, you can be fined. That fine, by FSS 162 can be any
amount up to $250.00 a day. If found guilty on a repeat
violation of the same offense, you can be fined up to
$500.00 a day for every day you are or remain in violation.
A repeat violation is one that occurs at anytime up to five
(5) years after the initial offense. A mandatory appearance
is required on any repeat violation.
If you fail to appear before the Code Enforcement Board/Spe-
cial Master to contest your violation, you shall be deemed to
have waived your right to contest the violation and an order
may be entered against you for an amount up to the maximum
civil penalty.
