July 18, 196? at the Village Hall. Councilmen present were: Messrs: Bowden, Sylvester, Cornelius and Bledsoe. Also present were Robert Harp, Village Manager and Clerk and William A. Lord, Village Attorney. The meeting was opened with prayer and the pledge of alle- giance to the flag by the Village Manager. The Tax Assessor presented the 1967 Tax Roll to the Council and the roll was as follows: Total Valuations $19,834,408. Less Exemptions _ 1.485.188. Taxable Valuation $18,349,220. Cornelius moved, second by Sylvester and passed that the Tax Roll be accepted. The Council meeting was adjourned at 8:05 P.M. and reconvened at 8:10 P.M. during which time the Councilmen sat as a Board of Equali- zation. The Minutes of the previous Council meeting were read and approved upon motion by Cornelius, second by Bledsoe and passed. Sylvester moved, second by Cornelius and passed that the detailed reading of the financial report for June 1967 be waived. The Village Manager recapped the financial statement for the nine month period ended June 30, 196? anti upon motion by Bledsoe, second by Cornelius and passed,-the financial statement and disbursements for the month of June were approved. Balances on Hand at June 30, 1967 were as follows: First Bank of Jupiter/Tequesta $ 9,193.97 Petty Cash 25.00 Community Federa 1 Savings and Loan 10,596.59 Fidelity Federal Savings and Loan 10,145.58 U. S. Treasury Bills 19,661.33 $49.622.47 Account balances were as follows: Operating Account $36,491.82 Petty Cash 25.00 Capital Fund 7,225.33 Streets, Roads and Drainage Fund 5,880.32 49 622.47 The Sinking Fund balance was X1.8.112.74. -39- 2 - 7-18-67 i The Village Manager presented his report covering various activities during the month of June. The report showed building permits as follows: June 1967 No. Valuation 19 (3 Houses) $110,718. Year to Date ~,9 Months,Z Pdo. Valuation 165 (33 Houses) $1,789,357. Mayor Bowden presented his report mentioning to the Councilmen the possibility of a feasibility study for the purchase of the sewerage treatment plant; possible future annexations to the Village limits. Mayor Bowden stated that he would be absent during the preparation of the 1967-1968 Budget but wanted to be put on record as being opposed to any tax milla,ge increase. Mayor Bowden read a prepared statement in reply to being publicly censored by Councilman Cornelius at the June 20, 1967 Meeting. Following the reading, Mayor Bowden asked that the statement be entered into the minutes verbatim. Cornelius moved, second by Sylvester and passed that the statement lie written into the minutes verbatim: STATEMEILT BY THE MAYOR • At the Council meeting held on May 16, 1967 your Mayor an- nounced that he had accepted a three months assignment to go to Bogota,, Colombia, "Minister of Communications"-- Port of Authority Division; to review its administration procedure and recommend any improvements. At the Council meeting held on June 20, 1967, I was publicly censored by Councilman Cornelius because of this absence from Council meetings, to the point that I ~a.s violating my oath of office. There are several important points that I did not mention at that time because of the unexpected and surprise charges. ~. The International Executive Service Corps is a non-profit. corporation subsidized by the Agency of International Develop- ment and by big business. Retired executives specialized in all phases of business techniques are assigned to undeveloped countries to assist to ca 1 business firms and government in American procedures. This is a patriot and good will program; approved by the United States Government with annual report to the President. The volunteer does not receive any monetary gain; expenses only; he must endure a health hazard and the risk of life. The prime purpose of this program is: 1. Teach the American know-how and the profit system. 2. Means of combating spreading Communism. B. I have been a member of the Council for over five years . serving as tax collector, treasurer, vice mayor, presently mayor and my attendance record is perfect. Being retired my time has always been available and I have devoted my best efforts to the welfare of this Village and the interests of the ta,x payers- a,ll areas of the Village. -40- 3 - ?-18-67 There is no provision in the Village Charter to prevent me from accepting this assigrnnent and emphatically I have not violated and am not violating in any way mY oath of office. C, My statement of being absent for three months is correct and it was questioned. In August I will be on vacation which every member is entitled to and I will return on August 20th. This assignment is fora three months period beginning August 22nd and with my broad experience i expect to complete before time allotted and be present at the Council meeting on Novem- ber 21st-tea, total of throe meetings when I will not be present. D. This Council is composed of capable and dedicated men. This Village is organized. In the event that the Mayor is incapicitated'or absent the Vice Mayor as prescribed in the Village Charter automatically assumes responsibility for the functions of the Vi1la,ge--no man is indispensable. If any Councilman was hospitalized it would be a similar situation. My mailing address is on file with the Village Manager. After more than five years service you would expect some degree of esprit-de-core and co-operation in this worthy chal- lenge. This exists in eighty percent of the members, we have respect, loyalty and consideration for each other. • You a 11 know the dirty campaign I endured to be elected Mayor. I did receive the largest number of votes ever recorded; indicative of confidence and I definitely do not intend to re- sign. As to the Village purchase of the Tequesta Water Company. The negotiations have been continuous since last August and we ~axpect the principal to sign on July 19th. If the sales and purchase agreement are consumated tomorrow, it will be early December before the Village will operate this project. E. We will return from the Northwest on August 20th. On Monday, August 21st, we will repack and leave for Bogota on Tuesday, August 22nd. The scheduled Council meeting is Tuesday, August 15th and I respectfully request that this meeting be advanced and held on Monday, ~iugust 21st so that I may be pre- seat. If this request is granted, it means I will be absent tuo consecutive meetings--this is no precident---instead of four as publicly and in print accused. F, Perhaps to avoid any future situation the Gouncil may con- sider the suggestion advanced by Councilman Sylvester requiring a change in the Village Charter: Elect 3 Councilmen from Ward #1 Elect 3 Councilmen from Ward. #2 Elect 1 Mayor Counci]rnan at la rge. July 18, 1967 George E, Bowden, Mayor -~ 1- ~ - 7-18-67 Mayor Bowden stated he would be in the Village August 20 and could attend a Council meeting if it was changed from August 15 to • Monday, August 21, 1967. Cornelius moved, second by Sylvester and passed that the August Council meeting be held Monday, August 21, 1967 at 8:00 P.M. Police Chief Dusenbery presented the Police Dega rtment and Civil Defense Reports for June and both were accepted. The Village Clerk gave second reading to an Ordinance by title only providing for the annexation of two (2) parcels of land owned by Eastern Sales, Inc, to the territoria 1 limits of the Village of Tequesta. Cornelius moved, second by Sylvester and passed that the reading be approved. Both first and second readings having been ap- proved, Ordinance No. 133 was hereby adopted on second reading. The Village Attorney presented a deed which he had prepared by which the Tequesta Country Club Community Association, Inc. would convey title to Lots A, B and C of Tequesta Subdivision to the Village of Tequesta. He also presented a lease from the Village to the Tequesta Country Club Community Associat~_on, Inc. for Lots A, B and C. He ex- plained that the lease was written presuming that the Tequesta Country Club Community Association, Inc. would have perpetual existence. tie noted he had left the term of the lease to be decided by the Council. Iie pointed out that the maintenance and operation and use of the sub- ject property would be completely and exclusively under the control of the lessee; and the lessor sha 11 have no obligation of any kind in this matter. He further pointed out that the lease provides that the lessee • wi 11 acquire and maintain, throughout the term of the lease, comprehensive insurance coverage for the protection of the lessor against liability for damage to person or property with limits of $100,000./$300,000. with the stipulation that at the end of each five (5) years of the term of the lease the lessor may require reasonable increases of the coverage based upon experience and economics. Councilman Sylvester stated he would have no objections if the arrangement would not cost the Village any expense. Cornelius moved that the Village accept a deed to Lots A, B and C Tequesta, from the Tequesta Country Club Community Association, Inc, and that the Mayor and Clerk be and are hereby authorized to sign a ten (10) year lease in behalf ox" the Village by which the subject lots are leased back to the Tequesta Country Club Community Association, Inc, for their use, maintenance and operation according to the terns of the lease. The term of the lease will commence from July 1, 1967. Bledsoe seconded the motion and it wa.s passed. Mayor Bowden advised that the Beautification Committee had referred the matter of a Village sign at U. S. No. 1 and Tequesta Drive back to the Council. Councilman Bledsoe was brought up to date on the subject and was shown the picture and plan of the sign. He stated that since Tequesta Drive was about the only way into the Village from U. S. No. 1, that the present street narle signs on the rocks were ade- quate identification for the street and he would prefer not to have any signs in the island. The Councilmen decided to table the matter until Councilman Valier is present since it was his committee project. • Mayor Bowden reviewed the progress in negotiations for the purchase of the Tequesta Water Co. stating that both parties were a]most in agreement as to the conditions of the Purchase and Sales Agreement. The Councilmen discussed the probable problem of the very -~'2- 5 - 7-18-67 near future involved in re-locating the line under the Intracoastal :'daterway when the proposed new bridge is constructed. The Village engineer estimates this work could cost a maximum of $50,000. and funds would not be available for this purpose in the very near future. It was suggested that the Village Attorney negotiate with the seller to assume the entire cost of any necessary re-location of the water lines in this area and the Village would reimburse the seller for 50~ of the total cost with funds for this reimbursement to come from frontage charges the Water Company expects to receive from customers connecting to water mains which the 6+later Company has installed at i.ts own expense. Cornelius moved, second by Sylvester and passed that the Mayor and Clerk be authorized to sign a Purchase and Sales Agreement for the purchase of the Tequesta Water Company if an agreeable solution to the financing of the probable relocation expense could be made. The Village Attorney discussed the recent "bingo" legis]a.tion passed by the State Legislature and called the Council's attention to Section 8, Ordinance No. 1 which states: "that it shall be unlawful for any person within the corporate limits of the Village of Tequesta, Florida, to participate in any game of chance whether with ca rds, dice or by any other means whereby any sum is wagered or to be collected upon the outcome of any such game ox" chance", No action taken on the matter. The Village Manager advised the Council of receipt of a copy of a letter from the County Engineer to Erockway, Owen ~ Anderson Engineers, Inc. authorizing them to proceed with the preparation of • a recorded bulkhead map for all shorelines of the Loxaha,tchee River, including the North Fork, the Northwest Fork and the Hobe Sound area outside of the municipal limits inside of Palm Beach County. The Village Manager stated a letter had been received from the Jupiter Business and Professional Women~s Club requesting that the Village adopt an ordinance or resolution to prohibit anyone from molesting bottle nosed dolphins or porpoises in the Loxahatchee River and adjacent waters. The Village Council was in favor of such action and the Village Attorney is to prepare necessary document for action by the Council at the next meeting. A letter from John H. Hupp concerning the unkept condition of property adjacent to 470 Tequesta Drive and other properties in the same general area was read. The Councilmen were in general agreement with Mr. Hupp about the situation but the Village Attorney stated the matter is difficult to control or legislate since they are improved properties on which residences are located and where people are living.. The Attorney will look into the matter. The Village Manager advised the Councilmen of an error in the Village ad in the new Fishing Guide. :Ie also advised that Palm Beach Cable TV is looking fora tower site. The Village Manager stated that Carl Roderick has been hired, • effective August 1, 1967, to replace Police Officer Walter ~3rown, Jr. Officer Brown and his wife are returning north. --43- 6 - ?-18-6?
