The Respondent, JEFF H4LTZ;IYIAN was not present at the hearing, 2. There was a finding of proper notice served on JEFF HOLT~MAhY, the attorney handling the Estate of CI~~,RLES LOWRY, who is listed as the property owner in the public records. 3 • The Tequesta Code Enforcement Officer testified to the violation. CONCLUSIONS QF LAW Respondent, JEFF HOT,TZMAN, is ixz violation of Chapter 30 Article II Section 30-33, of the Code of Ordinances of the Village of Tequesta. page 1 of 2 ORDER It is the f,~rder of the Code enforcement Special Magistrate that Respondent, JEFF PIOLT~IVIAYV, shall comply with Chapter 30 Article II Section 30-33, of the Cody of Ordinances of the 'V'illage of Tequesta by the 7~' day of July, 2008. This violation tozastitutes an immediate threat to the public health, safety, and welfare. Due to the inoperative gate latch constituting an immediate threat to the public health, safety, and welfare, the Village is authorized to correct the violation with regard to the gate and charge the cost of repairs to the Respande~.t, if the Respondent does not comply by the time specified, If Respondent does not toniply within the time specified, Respondent shall be assessed a fine of up to two-hundred-fifty -dollars ($250.00) per day until the property is in full compliance. A Fine Assessment bearing will be held before the Special Magistrate on the 24th day of July, 2008, at 1Q:DQ a.m., at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida.. 1espondent shall be assessed four-hundred-thirty-three-dollars and nineteen-cents ($433.19) for administrative costs to be paid by the 7u' day of July, 2008. (d) It shall be unlawful for the owner of any lot, parcel or tract of land whether there are improvements and construction thereon or not to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises.
