You stated that the Village is considering issuing a citation to my client for the alleged violation of the new Ordinance No. 11-OS which we understand had its second reading on 12 June 2008. Before the Village considers taking any action against my client with regard to that ordinance, I suggest to you that under my client's circumstan~:es no violation of the Ordinance exists. ,4s i read the Ordinance, it prohibits parking any trailers in any zoning districts except where the parking of the trailer is specifically allowed by the Village's Code of Qrdinances The fiacts as I understand them are thak my client has been parking the trailer on the properties for some time in compliance with the Gods prior to the Ordinance. No citation has ever been issued by the Village regarding the trailer- Specifically, the trailer is not used to store anything in it, but it is used for the transportation of race cars, which is an integral part ofi my client's permissible business use of these properties. Nothing in the Code prior to the Ordinance prohibits this use in the mixed use zoning district. Since the trailer is an integral part of the permissible business use, the trailer is allowed In the zoning district. Other property owners in the Village similarly have trailers used in their businesses that are located on their property, including a jet ski dealer, a motorcycle dealer and v~~riau5 trades business. Therefore, since the trailer is a permissible use integral with or accessory to the race car operation, it is a use that "is specifically allowed by Code", and the use of the trailer on these properties for this business is not a violation of the Ordinance- Furthermore, the client has been informed by the ~Ilar.~e that the trailer was not in violation of the Code prior to the Ordinance. Therefore this u~:e of my client's property could not be terminated by the passage of the Ordinance even If it violated the Ordinance since the Code clearly permits nonconforming uses to continue, see Code Section 78-91. (a) No person shall park, store, leave or permit the parking, storing or leaving of any motor vehicle of any kind or of any trailer, boat, bicycle, machinery, refrigerator, washing machine, plumbing fixture, furniture or other similar articles which are in an abandoned, wrecked, dismantled, inoperative, rusted, junked or partially dismantled condition, whether attended or not, upon any private property within the village for a period of time in excess of 72 hours. The presence of an abandoned, wrecked, dismantled, inoperative, rusted, junked or partially dismantled vehicle or article described in this section on private property is hereby declared a public nuisance which may be abated as such in accordance with the provisions of this division. (b) This section shall not apply to any vehicle or article described in this section which is completely enclosed within a building on private property or to any such property held in connection with a business enterprise lawfully licensed by the village and properly operated in the appropriate business zone pursuant to the zoning laws of the village.
