Address: 10 Westwood Avenue Tequesta, Florida 33469 Legal Description: SECALT4 PCN: TEQUESTA GARDENS 60-42-40-25-15-000-0040 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held on the 18~' day of December, 2008 and based on the evidence and testimony presented, the following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. The Respondent(s), Tequesta Garden Condominium Association, was present at the hearing and there was a finding of proper notice. 2. The City Code Compliance Officer provided evidence and testimony of the violation. 3. The Respondent provided evidence and testimony regarding the violation, and current efforts to hire a contractor to pull permits and complete the work according to code. Page 1 of 2 CONCLUSIONS OF LAS Based on the above-stated facts, Respondent(s) is in violation of Section(s) 14-152 of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Compliance Special Magistrate that Respondent(s), Garden Condominium Association, shall comply with Section(s) 14-152 of the Code of Ordinances of the Village of Tequesta as follows: Respondents shall perform no further concrete restoration work until all necessary permits have been obtained. Respondents shall be required to pay double permit fees for performing work without a permit. The Special Magistrate hereby retains jurisdiction to enter further findings and conclusions regarding the existing violations, compliance, and the assessment of fines, if any. Administrative costs in the amount of one hundred ninety one dollars and seventy three cents ($191.73) are hereby assessed for this hearing. A Status Hearing will be held before the Special Magistrate on the 22°d day of January, 2009, at 10:00 a.m., at the Village of Tequesta Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469. Should you violate the same Section of the Code again, you may be subject to a fine of up to five hundred dollars ($500.00} per day for such repeat violation. Additionally, the Code Inspector is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. The report was presented on October 16, 2008. The Association has just hired us to write repair specifications as part of a bid package and to solicit bids for the required work. Typically it takes approximately 4 to 6 weeks for a Contract to be signed and for the Contractor to apply for a Building Permit. Therefore we expect work to begin by the end of January 2009. BUILDING & GROUNDS: James Folz reported: Going over the projects that were `~ tabled at last months meeting. 1. The two disabled parking spaces have been painted and the signs will be installed. 2. Laundry Room sinks that need replacement will be done as needed. 3. The color has not been selected for the painting of the arches of the buildings. 4. We have two bids on the Time Clocks. Bill Gilbert Electric for $565.00 for two clocks installed and Thomas Electric for `'~ t each clock $800.00. Jim Folz motion hiring Gilbert Electric for two clocks, total cost with ~<<~t~~ installation, $565.00. Fred Dever seconded the motion. Vote was unanimous. 5. The decorative shutters would have to be done for all the buildings at the same time. The cost for solid shutters is $9200.00 and louvre shutters $7000.00. Due to some residents that have hurricane shutters the installation will be more difficult to make it uniform. The design on other buildings for shutters will not fit on the first floor units. The Committee put this project on hold for a later date to come ~up with an alternative. 6. James Folz motion for Lawrence Fencing to install the gates to encompass the recreation area, required by law to protect the pool from small children. The total cost $4339.00. Fred Dever second the motion. Vote was unanimous. 7. Building Committee still looking for decorative numbers for identification of the units. B. Frank reported the committee met again on February 21, 2008. Members submitted detailed reports on the 18 Guildings. (2) problems of spalling have been addressed. Spalling is a condition when the steel r;:bar inside the concrete is exposed;, causing, the rebar to corrode and expand. This condition must be addressed before a mzj ~r ccncrete ~.~estoration is required. Jim Folz reported on the replacement oi~ the electronic controls for the sprinkler system. This project will be done over a period of (2) years as money is available. We have (114) fire extinguishers. The annual inspection is due, using the same contractor. Reed Termite Inspection, cost $6200.00. 2. Beach Envirorunent, cost $12,900.00 and Insect Protection Co. $6000.00. Jim Folz motioned, we accept *.he corrtract with Insect Protection for one year, cost $6000.00. AI Aceto seconded the motion. Discussion followed. Vote was unanimous. Insect Protection currently has been servicing unit owners for their insect control. Jim also informed the board five more clocks for the sprinkler systems have to be replaced, cost $1000.00 per unit. Four of the five were replaced when a major sod was done so we will be replacing only one for the present time.
