EXECUTIVE SUMMARY OF MAJOR ISSUES: (This is a snap shot description of the agenda item) Regions Bank has requested an extension of time for one year on their Site Plan. They were unable to secure a building permit within the required time of one year from the granting of their approval on 1-9- 09. Harding, Community Developmen Dir r DATE: February 2, ?009 SUBJECT: Regions Bank, 691 U.S. Highway One, Site Plan Extension The Site in question consisted of two lots located in Tequesta. Ordinance No. 620 in ?007 approved the Annexation of a third parcel to be united in title to form one lot for the purpose of building a new building for Regions Bank. An existing building on the lot was demolished in preparation for the new Bank. The Alley running across the rear of the property remained in the ownership of Tequesta as a public right-of--way. This Alley partitions the property, with the proposed bank on the frontage of Rt. # i and parking in the rear, using the Alley for access. Improvements to the Alley were part of the site plan approval. Regions Bank did not secure construction permits within the one year required to preserve their site plan approval. They are now asking for an extension of one more year. The Building Permits were approved and are waiting for pick-up; however, they have chosen to put them on hold. If the extension were approved, it would give Regions Bank or any other bank the right to build the approved site plan within the next year, after securing the proper permits. It would also give them an approved site for resale within the next year. Our main concern at this time is who will maintain the site now and possibly in the years to come and to what standard will the site be maintained. In consideration of this. I recommend the following as a condition of approval: • The site should be cleared and restored to a natural state. • All foundations, slabs, debris, utilities, etc., should be removed and suitable trees planted along the U.S. #l Corridor. • T11e site should be maintained by Regions Bank until such time as they either develop or sell the property. Memorandum Mayor & Village Council RE: Regions Bank, Site Plan Extension February 2, 2009 Page 2 - --------------------------------------------------- A reasonable bond should be secured to cover the cost of maintenance over the next year in the event Regions Bank tails to maintain the property. If Regions Bank sells the property. the bond should continue for the remainder of the year and the unused portion returned. Teguesta has had experience in the past with properties that have been abandoned due to market conditions. Maintaining these properties has taken time, diligence and Code Enforcement. If we do not address this situation now, we will invite more of the same.
