UTILITY ENGINEERING SERVICES WORK AUTHORIZATION
WTP MISCELLANEOUS UPGRADES
On December 2, 2016, Kimley-Horn and Associates Inc. (Consultant) received a
purchase order from the Village of Tequesta (Client) to perform Phase I design services
for the "WTP — Miscellaneous Upgrades" project. A copy of the authorization and
purchase order is attached. This authorization established a scope for Phase II services
which includes Construction. The intent was to authorize Phase II services at the
conclusion of Phase I. The first phase and the bidding phases are now complete. An
award to initiate the construction phase is now imminent.
The purpose of this is to authorize Phase II services (exclusive of bidding services) as set
forth in the original authorization. The services covered by this authorization are subject
to all terms and conditions as set forth directly, or by reference, in the Phase I
authorization. The following descriptions provide additional detail to the services to be
provided under Items 3, 4, 11, and 24 as contained in the Phase II section of the original
authorization.
Visits to Site and Observation of Construction. Consultant will make visits in order to
observe the progress of the Work. Such visits and observations by Consultant are not
intended to be exhaustive or to extend to every aspect of Contractor's work. Observations
are to be limited to spot checking, selective measurement, and similar methods of general
observation. Based on information obtained during such visits, Consultant will evaluate
whether Contractor's work is generally proceeding in accordance with the Contract
Documents, and Consultant will keep Client informed of the general progress of the Work.
Consultant shall not, during such visits or as a result of such observations, supervise,
direct, or have control over Contractor's work, nor shall Consultant have authority over or
responsibility for the means, methods, techniques, equipment choice and usage,
sequences, schedules, or procedures of construction selected by Contractor, for safety
precautions and programs incident to Contractor's work, nor for any failure of Contractor
to comply with applicable laws and regulations. Consultant neither guarantees the
performance of any Contractor nor assumes responsibility for any Contractor's failure to
furnish and perform its work in accordance with the Contract Documents.
Applications for Payment. Based on its observations and on review of applications for
payment and accompanying supporting documentation, Consultant will determine the
amounts that Consultant recommends Contractor be paid. Such recommendations will
be based on Consultant's knowledge, information and belief, and will state whether in
Consultant's opinion Contractor's work has progressed to the point indicated, subject to
any qualifications stated in the recommendation. Consultant's recommendations will not
be a representation that its observations to check Contractor's work have been
exhaustive, extended to every aspect of Contractor's work, or involved detailed
inspections.
Final Notice of Acceptability of the Work. Consultant will conduct a final site visit to
determine if the completed Work of Contractor is generally in accordance with the
Contract Documents and the final punch list so that Consultant may recommend, in
writing, final payment to Contractor. Accompanying the recommendation for final
payment, Consultant shall also provide a notice that the Work is generally in accordance
with the Contract Documents to the best of Consultant's knowledge, information, and
belief based on the extent of its services and based upon information provided to
Consultant upon which it is entitled to rely.
As described, the Construction Phase services will be performed over an assumed 11
month construction period on a lump sum basis for $122,150.00.
