Dear Ms. Campbell:
On,October 8,2002,we received your application for an exemption to perform the following activities: construct a
480 sq. ft. dock,5 feet above mean high water,with a 4'x 84' access pier and a 6'x 24'terminal platform, install a
12'x 13'pile-supported boatlift adjacent to the proposed dock,and insta112 mooring piles. The activity is located
adjacent to 30 Eastwinds Circle, Section 25,Township 40 South,Range 42 East,Tequesta, Palm Beach County.
The site is located on the Loxahatchee River(Jupiter River North Fork),in the Loxahatchee River—Lake Worth
Creek Aquatic Preserve, Outstanding Florida Waters,Class II waters.
Your application has been reviewed to determine whether it qualifies for any of three kinds of authorization that
may be necessary for works in wetlands or waters of the United States. The kinds of authorization are(1)regulatory
� authorization,(2)proprietary authorization(related to state-owned submerged lands),and(3)federal authorization.
The authority for review and the outcomes of the reviews are listed below. Please read each section carefully. Your
project may not have qualified for all three forms of authorization. If your project did not qualify for one or more of
the authorizations,refer to the specific section dealing with that authorization for advice on how to obtain it.
1. Regulatory Review. —GRANTED
The Deparhnent has the authority to rev;ew your project under Part IV of Chapter 373,Florida Statutes(F.S.),Title
62,Fldrida Administrative Code(F.A.C.),and in accordance with operating agreements executed between the
Department and the water management districts, as referenced in Chapter 62-113,F.A.C.
Based on the information you submitted,we have determined that your project to construct a dock and lift is exempt
from the need to obtain a DEP Environmental Resource Permit under Rule 40E-4.051(3)(b),F.A.C., and your
project to install mooring piles is exempt from the need to obtain a DEP Environmental Resource Permit under Rule
40E-4.051(3)(a),F.A.C.
2. Proprietary Review(related to state-owned lands). —GRANTED
The Deparnnent acts as staff to the Board of Trustees of the Internal Improvement Trust Fund(Board of Trustees)
and issues certain authorizations for the use of sovereign submerged lands. The Deparnnent has the authority to
review your project under Chapters 253 and 258,F.S.,Chapters 18-20 and 18-21,F.A.C.,and Section 62-343.075,
F.A.C.
Your project will occur on sovereign submerged land and wil]require authorization from the Board of Trustees to
use public property. As staff to the Board of Trustees, we have reviewed the proposed project and have determined
that,as long as it is located within the described boundaries and is consistent with the attached general consent
conditions,the project qualifies for consent to use sovereign submerged lands. Therefore,pursuant to Chapter
253.77,Florida Statutes,you may consider this letter as authorization from the Board of Trustees to perform the
project.
3. Federal Review(State Programmatic General Permit). —NOT GRANTED
Federal authorization for the proposed project is reviewed by DEP pursuant to an agreement between the
Department and the U.S. Army Corps of Engineers(Corps). The agreement is outlined in a document titled
"More Protection, Less Process"

� Coordination Agreement Between the U.S. Army Corps of Engineers and the Florida Department of Errvironmental
Protection State Programmatic General Permit, Section 10 of the Rivers and Harbor Act of]899 and Section 404 of
the Clean Water Act.
Your project has been reviewed for compliance with a State Programmatic General Permit(SPGP).As shown on the
attached drawings,the proposed project is not consistent with the SPGP program. A copy of your application has
been sent to the Corps who may require a separate permit. Failure to obtain their authorization prior to construction
could subject you to enforcement action. For further information,contact the Corps directly.
The determinations in this letter are based solely on the information provided to the Department and on the statutes
and rules in effect when the appiication was submitted.The determinations are effective only for the specific activity
proposed. These determinations shall automatically expire if site conditions materially change or if the governing
statutes or rules are amended. In addition, any substantial modifications in your plans shonld be submitted to,he
Deparnnent for review, as changes may result in a permit being required. In any event,this determination shall
expire after one year.
This letter does not relieve you from the responsibility of obtaining other permits(federal,state, or local)that may
be required for the project.
NOTICE OF RIGHTS OF SUBSTANTIALLY AFFECTED PERSONS
This letter acknowledges that the proposed activity is exempt from ERP permitting requirements under Rules 40E-
4.051(3)(b),F.A.C.and 40E-4.051(3)(a),F.A.C. This determination is final and effective on the date filed with the
Clerk of the Department unless a sufficient petition for an administrative hearing is timely filed under sections
120.569 and 120.57 of the Florida Statutes as provided below. If a sufficient petition for an administrative hearing
is timely filed,this determination automatically becomes only proposed agency action subject to the result of the
administrative review process. Therefore, on the filing of a timely and sufficient petition,this action will not be
fmal and effective until further order of the Department. The procedures for petitioning for a hearing are set forth in
the attached notice.
This detezmination is based on the information you provided the Department and the statutes and rules in effect
when the application was submitted and is effective only for the specific activity proposed. This determination shail
automatically expire if site conditions materially change or the governing statutes or rules are amended. In addition,
any substantial modifications in your plans should be submitted to the Deparhnent for review, as changes may result
in a permit being required. In any event,this determination shall expire after one year.
Be advised that your neighbors and other parties who may be substantially affected by the proposed activity allowed
under this determinatio;l of exemption have a right to request an administrative hearir:U on the Department's
decision that the proposed activity qualifies for this exemption. Because the administrative hearing process is
designed to redetermine final agency action on the application,the filing of a petition for an administrative hearing
may result in a final determination that the proposed activity is not authorized under the exemption established under
Rules 40E-4.051(3)(b),F.A.C. and 40E-4.051(3)(a),F.A.C.
The Department will not publish notice of this determination.Publication of this notice by you is optional and is not
required for you to proceed. However, in the event that an administrative hearing is held and the Department's
determination is reversed,proceeding with the proposed activity before the time period for requesting an
administrative hearing has expired would mean that the activity was conducted without the required permit.
If you wish to limit the time within which all substantially affected persons may request an administrative hearing,
you may Elect to publish, at your own expense,the enclosed notice(Attachment A)in the legal advertisement
section of a newspaper of general circulation in the county where the activity is to take place. A single publication
will suffice.
If you wish to limit the time within which any specific person(s)may request an administrative hearing,you may
provide such person(s),by certified mail,a copy of this determination, inciuding Attachment A.

A. To construct the dock as permitted by D.E.P. and Army Corps it will
have to exceed the maximum length set forth by the uniform waterway
control ordinance.
B. Said dock would be no more hazardous than the allowed 75' dock.
C. Spacing piting @ 10' intervals would not impede any water flow in #his
area.
D. Because of the dock location, there would be no obstruction to
navigation.
E. The dock wouid not interfere with any traditional public uses of the
waterway such as boating, swimming, fishing, etc.
F. The dock height would be 5' above M.H.W. as required by D.E.P. It will
, not obstruct any waterviews or detract from as#hetic values.
G. The dock will not interfere or disturb any marine or Bethnic life.
H. The dock would not be approved by D.E.P. if it appreciably contributed
to pollution and degradations of the waterway.
I. The dock would not interfere with the adjoining owners reparian rights
as it is wefl within the setback guidelines.
J. The dock plans have met all conditions required by D.E.P. and Army
Corps.

1. Extending the dock to 90' provides more wafier depth for boat mooring
than the 75' limit as per Tequesta dock ordinance. This is encouraged by
D.E.P. to heip etiminate disturbing the river bottom with prop-wash.
2. The conditions are existtng and are not as a resuit of the actions of the
�pplicant.
3. Granting this variance.vvill not confer on the applicant any special
privilege. -
4. The litera{ interpretation of the provision of the ordinance wouid deprive
the applicant of righ#s enjoyed by other properties in the same zoning
district under the terms of the ordinance and would work unnecessary and
undue hardships on the applicant.
5. This is the minimum variance that will make possible the reasonable use
of the land, buitding or structure.
6. Granting of this variance will be in harmony with the general intent and
purpose of the ordinance and that such variance will not be injurious to the
area involved or otherwise detrimental to the pubtic welfare.

Agenda to be held at 7:00 P.M., Monday July 21, 2003, in the Village Recreation Center,
Council Chambers, 399 Seabrook Road, Tequesta, Florida, to act upon your application
for variance to the terms of the Official Comprehensive Zoning Ordinance of the Village
of Tequesta.
As you are aware, this is the second hearing for your variance, as the application was
deferred until this coming meeting. A copy of the minutes from the June 16, 2003
meeting is enclosed. I am in receipt of the elevation survey from Dolphin Marine
Construction, Inc. that was requested at the previous meeting.

Dear Sir:
My wife and I strongiy objEct to granting the"dack length" variance to the above
referenced property owner for the following reasons:
l) In the early"90's" we lived in 4rlando and were deeply saddened to read of the
tragic boating accident that occurred to three major leagt,ie baseball players where one died
from injuries sustained after their speed boat hit a dock. Whether or not the dock extended
into the waterway more than the surrounding docks or if there was even a"dock length"
ordinance in that particular area of xhe waterway probably is immaterial. The point is, this
kind of accident is much more likely to occur if any dock is allowed to extend further into the
waterway than all of the other docks in the immediate area.
2] At this particular location, the North Fork of the river is fairly narrow in relatian to
the width further downstream south of the Tequesta Drive bridge. Just a few hundred yards
north of this location, the North Fork gets quite shallow as well as narrower thus many boats
will be turning around in this area. Large boats need as much room for this maneuver as the
river can possibly provide. An extended dock in this azea is just not a good idea.
3] In as much as boat size(length/height)is somewhat restricted due to the Tequesta
Drive bridge, it doesn't seem practical or necessary to require an"extended dock".
There are probably many more reasons this variance should not be granted but please
seriously consider these three.

(7) Penalties. Any person violating the provisions of.any sec-
tion of said code, or this ordinance, shall, upon conviction by the
code enforcement board, be fined not more than five hundred
dollars ($500.40) per day. Each day such violation shall continue
shall constitute a separate offense. In lieu of such fine, or in
addition thereto, such person or persons, if licensed to do busi-
ness within the Village of Tequesta, may have such license sus-
pended for a definite period of time, or such license may be
revoked, said revocation to be subject to concurrence of the Palm
Beach County Construction Industry Licensing Board where ap-
plicable, as cantained in Chapter 67-1876, as amended by Chap-
ter 69-1433, Florida Statutes.

SECTION XVI. UNIFURM WATERWAY CONTROL
(A) J�risdiction. �
(1) To provide for the regulations described herein within the .
public waters of the State of Florida, comprising the Loxahatchee
I�iver an� the I�atracoastal Waterway and all creeks, canals or
waterways or tributaries connected therewith, located within the
geographical boundaries of the Village of Tequesta, Florida.
(B) Dock and Pier Length, Width and Configuration.
(1) No dock or pier shall be constructed which extends water-
ward from the mean high water line in excess of the least of the
following distances;

(a) Seventy-five (75) feet; or
(b) Ten (10) percent of the waterway width; or
(c) The distance from the point at which the dock or pier
intersects the mean high wa+er line measured in a straight
line to the nearest point on the three-foot mean low water
line;
provided, however, the foregoing limitations shall not prohibit a
dock which does not extend waterward from the mean high water
line in excess of six (6) feet.
(2) No dock or pier area shall be constructed with a�maximum
width in excess of six (6) feet.
(3) No dock or pier shall be located less than twenty-five (25)
feet from the waterward extension of the property line of any
adjoining riparian praperty owner.

not said reconstruction, alteration or new construction is an ex-
tension of a nonconforming use. However, this exemption shall
not apply to structural alterations which affect the length, width
and configuration of a dock or pier, exclusive of the alteration of
any mooring device aff'ixed or accessory thereto. Boatlifts and
. mooring pilings outboard of docks and piers on waterways and
canals of eighty-five (85) feet or less in width are not permitted.
(C) Commercial Docks.
(1) No commercial docks shall be permitted within the R-1,
R-lA and RJOP districts.
(2) Docks, p�ers, mooring devices and seawalls located within
the single-family dwelling districts R-1, and R•lA shall be for -
single-family use only.
(D) Boathouses or Shelters.
(1) No boathouse or enclosed boat shelter shall be permitted to
` � be located waterward of a seawall or mean high water line,which-
;
ever is applicable.
(E) Anclaoring or Mooring of Vessets.
(1) No person shall anchor, moor or park or cause, permit or
allow any other person under his or her control or command, to
anchor, moor or park any vessel or water craft of any description
used or capable of being used as a means of transportation on
water, within the R•1 and R-lA single-family dwelli.ng districta,
for a period of time in excess of seventy-two (72) continuous hours
during any consecutive thirty-day period, unless such vessel or
water craft is located at an approved dock and with the consent of
the owner of such approved dock.
(2) The anchoring, mooring or parking of vessels or water craft
in aIl disLricis sh� � �t an �pp�°oved doek, �i�� �� se�wall and
attached or secured by approved methods and/or devices.
(F) Dischcxrge of Refuse.
(1) No person shal� discharge, or permit or allow any other
person on a vessel or water craft under his or her control or
command to discharge, any human or animal excreta from any

thr•ow, discharge,depasit or leave,or ca.use or permit to be thrown,
discharged, deposited or left, from any vessel or water craft any
refuse matter of any description into the waters located within
the area to which this ordinance applies.
(G) Variance Criteria.
(1) Any person desiring a variance from the terms of this ordi-
nance shall make application for same to the zoning board of
adjustment of the village in accordance with the procedures set
forth in this section.
(2) In order to authorize any variance from the terms of this
ordinance, the board of ac�justment must find with respect to the
proposed project as follows:
(a) The variance being requested meets the definition of the
term "variance."
(b) No hazardous condition would be created.
(c) The flow of water would not be impeded or interfered with.
(d) No obstruction to navigation would occur. �
(e) It would not interfere with traditional public uses of the
waterway, including but not limited to swimming, fishing,
or boating.
(fl It would not create an appreciable obstruction of waterway
� views or otherwise detract from aesthetic values.
(g) It would not appreciably disrupt, interfere with, or disturb
marine or benthic life.
(h) It would not contribute to the pollution of the waterway or
the degradation of its condition.
(i) It would not interfere with the lawful rights of riparian
owners. � �
(j) It would be consistent with any other applicable laws,
rules or plans.
