Applicant Name: Gregory and Christina Rcynk
Lut 40, 147 Point Circle, Tequesta Country Club.
The following addresses the six criteria of the zoning code section XIII(E)(1)(b)1 thru 6;
(b)2. Due to th� existing special circumstance relating to the property's irregular"pie"
shape, the front setback is increased to a distance that would force the design af
any new structure to be configured in such a way that the floor plan would not
allow a consistent flow from room to room. This would result in a non-desirable
living space and cause the current and future owners economic and lifestyle
hardship that is not consisten# with other homes within the zoning district.
(b)2. The current owners did not originally plat this parcel and are in no way
responsible or the cause of the special circumstance.
(b)3. The granting of the variance requested would in no way confer on the current
owners/applicant any special privilege that is denied by any ordinances to other
ownerslapplicants in the same zoning district.
(b)4. The unnecessary hardship caused by this ordinance directly relates to the
following:
The layout of any new structure would not be"normaI" to current design and
market criteria. Since the front setback would be approximately 65', instead of
25' that other homeowners enjoy, the rooms must be arranged in a manner
that would result in a non-workable, non-flawing floor plan to an extent that
the value of the home would be considerably diminished. The floor plan
would feel "crammed" and undesirable.
The odd placement of any new structure would limit the enjoyment and use of
the praperty on the waterfront side of the property. A considerable portion of
this property's value is the waterfront. If the front yard (street side)is much
larger in comparison to the rear yard (waterfront side), then the result would
be an imbalanced placement of the residence and would not be consistent with
other placement of buildings in the zoning district. If the building be placed in
such a non-conforming manner, the"best use" of the property would not be
utilized and the value of the property would be drastically reduced due to this
condition.
(b)5, This application is requesting that the front set back be 33'. No other requests are
being made.
(b)6. The variance request will result in a structure that is in harmony with the
neighborhood, and has no injurious effect to the area.
