discharged, deposited or left, from any vessel or water craft any
refuse matter of any description into the waters located within
the area to which this ordinance applies.
(G) Udridnce Criteria.
(1) Any person desiring a variance from the terms of this ordi-
nance shall make application for same to the zoning board of
adjustment of the village in accordance with the procedures set
forth in this section.
(2) In order to authorize any variance from the terms of this
ordinance, the board of adjustment must find with respect to the
proposed project as follows:
(a) The variance being requested meets the definition of the
term "variance."
(b) No hazardous condition would be created.
(c) The flow of water would not be impeded or interfered with.
(d) No obstruction to navigation would occur.
(e) It would not interfere with traditional public uses of the
waterway, including but not limited to swimming, fishing,
or boating.
(� It would not create an appreciable obstruction of water��vay
views or otherwise detract from aesthetic values.
(g) It would not appreciably disrupt, interfere with, or disturb
marine or benthic life.
(h) It would not contribute to the pollution of the waterway or
the degradation of its condition.
(i) It would not interfere with the lawful� rights of riparian
owners.
(j) It would be consistent with any other applicable �aws,
rules or plans.

Application for Variance
Nature of Variance: Request variance allowing an elevator style lift to be installed
adjacent to existing wood dock.
Justification of Variance:
2a) The variance requested is not contrary to the public interest. Because the property is
located at the end of the canal, silt tends to build up causing shallow conditions close to
the bulkhead that would interfere with the operation of a lift installed directly adjacent to
the bulkhead. Installing the lift adjacent to the 5' wide existing dock allows for the
reoccurring slope in the bottom.
2b) Allowing the lift to be installed adjacent to the existing dock would create no
hazardous conditions.
2c) The flow of water would not be impeded or interfered with.
2d) As the lift would be installed in the location where our boat currently sits when tied
up to the dock with mooring whips, there will be no appreciable difference in distance
from the bulkhead. In addition, the property location is at the end of the canal so there is
no boat traffic that passes by and therefore no obstruction to navigation.
2e) The installation of the lift adjacent to the dock would not interfere with public uses
of the waterway.
2 fl Installing the lift adjacent to the dock would not obstruct waterway views nor detract
from aesthetic values.
2g) Approving the variance would not disrupt or interfere with marine or benthic life.
2h) The lift variance would not contribute to pollution of the waterway or degradat�on of
its condition.
2i) Installing the lift adjacent to the dock would not interfere with the lawful rights of
riparian owners.
2j) The installation of the lift would be consistent with any other applicable laws, rules
or plans.

(6) AIl sections or areas of any dock or pier which intersect at
any angIe with the main portion of a dock or pier extending from
the shoreline, may not exceed a total combined tength of twenty
(20)feet. .

(7) The total area of all docks and piers located on any riparian
par�cel�hall not exceed five hundred(500)squa�e feet for each one-
hundred (140) linear feet of that parcel shoreiine. �
(S) Mooring devices such as boat lifts, davits and whips shall
not be considered in computing the required length, width and
configuration of docks or piers regulated by this ordinance. Nei-

Sec. XVI APPENDIX A—ZON[NG Sec. XVI
not said reconstructiun, alterativn or new construction is an ex-
tension of a noncunforming use. However, this egemption shall
not apply to structural alterations which a.f�ect the length, width
and configuration of a dock or pier, exclusive of the alteration of
any mooring device si�ixed or accessory thereto. Boatlifts and
mooring pilings outboard of docks and piers on waterways and
canals of eighty-five (85) feet or Iess in width are not permitted.
(C) Commercictl Docks.
(1) No commercial docks shall be permitted within the R-1,
R-lA and R,/OP districta.
(2) Docks, p�ers, mooring devices and seawalls located within
the single-family dwelling districts Rrl, and R-lA shall be for � _
single-family use only.
(D) Boacthouses or Shetters.
� (1) No boathouse or enclosed boat shelter shall be permitted to
_ '�� be located waterward of a seawall or mean high water line,which-
ever is applicable.
� (E) Anchoring or Mooring of Yessets.

i� (1) No person shall anchor, moor or park or cause, permit or
allow any other person under hia or her control or command, ta
anchor, moor or park any vessel or water eraf� of any description
used or capable of being used as a means of transportation on
water, within the R-1 and R-].A single-family dwelling district8,
for a period of time in excess of seventy-two(72) continuous hours
during any consecutive thirtyday period, unless such vessel or
water craf�is located at an approved.dock and with the consent of
the owner of such approved dock.
(2) The anchoring, mooring or parking of vessels or water craft
in all districts sha11 be at an approved dock, pier or seawall and
attached or secured by approved methods and/or devices.
(F) Discharge of Refuse.
(1) No person shall discharge, or permit or allow any other
person on a vessel or water craft under his or her control or
command to discharge, any human or animal excreta. from any
f head, toilet or similar facility on any vessel or water craft, or
