Supplemental Regulations Applying to a Specific, to Several or to all Districts, Subsection (A) General Provisions, (8) Floor elevation above sea level; to allow the enclosure of a 10' x 12' (foot) portion of the existing rear roofed porch to match the floor at the existing house floor elevation of 7.20', in lieu of minimum finish first floor elevation above mean sea level (MSL) for all new construction, additions, and substantial improvements to e�sting structiues being 8.5' MSL or 18" above the crown of the road, cul-de-sac or highway or meet the requirements of Section XV, Flood Hazard Areas, whichever is more stringent, as required by the Zoning Ordinance. This approval is subject to the proper execution and recordation, by the applicant, of the attached General Release and Hold Harmless Agreement with the Palm Beach County Clerk of the Court. Please note that this v�riance shali expire within s� (6) months from the date of grant, unless a building permit based upon and incorporating the variance is issued witlun the aforesaid six-month period and constructian has begun thereunder. The area of the home the �wner is proposed io be enclosed ior a Sitting Area o the Kitchen and Family Room area is the only area common to these two space It is within the existing roofed Rear Porch and to raise the floor to the heiglit � 8.5 (now required by the Village af Tequesta) versus matching the existing fini: floor height of 7.2, would require the removal of the existing rear porch roof ar main house roof and existing rear wall beams to allow minunum head height steps and sitting area. 2. The existing finish floor elevation of 7.2 was set more than 12" above 6.0 (6 being the then and still current flood plane for the area) and more than 1 S" abo` the crown of road requirement. A change in the minimum allowable Finish Flo� Elevation by the Village of 8.5' regardless of flood zone/ flood elevatic determined by FEMA. This in turn rendered the otherwise proper 7.2 Fini: Floor Elevation not in compliance�vith Village requirements. 3e Tliis granting of this variance will not confer any special privilege on tl applicant,because of the unique existing condition of the roofed porch area whe the enclosure is proposed. Further, the enclosing of the existing porch space simply ai�alteration to tt�e existing home and not an addition external to the hom 4. There literal interpretarion of the provisions of the ordinance would deprzve tl applicant of rights commonly enjoyed by others because all portions of the rooff structure were constructed above minimum required elevations, and othe building rc��v�ti�ould t;��b?e t�� infil?!enc4,se ure:as�nder t��eir e�isting roofs. 5. The requested variance is the minimum that will make reasonable use of tl proposed Sitting Area enclosure. This simply allows them to more fully utilize � existing portion of their home. 6. The granting of the variance will be in hartnony with the general intent at purpose of the ordinance and will not be injuriaus to tlie area involved or to tl public because the proposed finish floor elevation is still well above the FEM flood elevation for this area.
