Dear Mr. & Mrs. Brecht:
This letter is to confu7n the action of the Village of Tequesta Board of Adjustment at their
November 18, 2002, Public Hearing deferring your application for variance to the terms of the
Official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as
amended, Section VII. Schedule of Regulations and Application of Regulations, Subsection (C),
Schedule of Site Requirements, R-1 District, Minimum Rear Yard Setback, to allow the
construction of a 468 square foot addition with a rear yard setback 17 feet in lieu of 20 feet as
required by Code.
Please be advised that this deferment is until time certain; December 9, 2002 at 7:00 P.M., which is
the ne� scheduled meeting of the Village of Tequesta Board of Adjustments. The meeting will take
place the �'equesta Recreation Center, 399 Seabrook Drive, Tequesta Florida.

Board of Adjustment Variance Request
August 24, 2002
To the members of the Board of Adjustment of Tequesta,
Re: 364 Franklin Road, Tequesta.
Thank you for your consideration of our request for a variance of current setback
restrictions for our residence at 364 Franklin Road. It is our intention to add an
additional bed and bathroom on the South side of our two bedroom, two bath home
so as to:
1. Provide more living space for our family (our two children and my wife and I)
since my wife and I purchased our home in 1996,we have had two children,
Austin 5 and Cory 4, consequently outgrowing our home. (We do not intend to
have anymore children).
2. Upgrade our beautiful home and neighborhood (please see attached
photograph).
3. Provide a better quality of life for our family.
4. Continue to live in Tequesta with our friends and Family.
Nature of variance:
My wife and I are asking the board to consider a variance of three- feet on our rear
setback, as the Village of Tequesta requires a twenty-foot setback on rear property
lines.
With considerable planning and revising we have created a floor plan that is
feasible for our added living space and budget. We have reduced our initial plan,
So that we would need to request only a three-foot variance on our rear setback
rather than six- feet.
In submitting the application for variance the Board of Adjustment requires us to
meet six criteria. These are addressed below:
1. Our"special condition" exists whereby our residence was placed 27.81 feet from
the front property line rather than the required 25 feet from the front property
line which shifted our house 2.81 feet toward the rear property line (see attached
survey). The decision to shift the residence 2.81 feet to the rear was made by the
person who originally contracted the construction of our home. That decision
resulted in a loss of 2.81 feet. If we had that 2.81 feet we would be requesting a
variance to encroach 3 inches into the rear setback. Instead we must ask to
encroach 3 feet into the rear set back.

2. This "special condition" existed prior to my wife and I acquiring the residence in
1996.
3. In granting us this variance the Board would not be granting us any special
privilege that is denied by this ordinance to other lands, building or structures in
the same zoning district. Although we understand that each case is judged
individually we have seen an increase in additions to the homes in our zoning
district. We assume that the addition of a third bed and bathroom would not be
a special priviiege denied by this ordinance to other applicants in this zoning
district.
4. That literal interpretation of 20' rear setback would deprive our family from a
Third bed and bathroom, rights commonly enjoyed by other properties in our
zoning district under the terms of zoning district ordinance. Because the person
who originally contracted the construction of our home chose to place the
residence 27.81 feet instead of the required 25 feet from the front property line
we ask the board to approve a 3 foot encroachment into the rear setback. The
Board's approval would provide for a better quality of life for our family.
5. My wife and I have revised and "tweaked" our building plans to minimize the
number of feet we are requesting permission from the Board to encroach into the
reasonable twenty foot setback required by the zoning district. We feel that we
have done extensive planning and appropriated the space creatively in order to
minimize our request of the Board.
6. In granting our Adjustment Variance Request the Board will find the residence
located at 364 Franklin Road not injurious to the area involved or detrimental to
the public welfare. As we are requesting to encroach 3 feet into the rear 20-foot
setback the value of the additional square footage is twofold. Our family will
have adequate living area to reside in our home and The Village of Tequesta will
have additional residential square footage to tax.
