(7) Penalties. Any person violating the provisions of,any sec-
tion of said code, or this ordinance, shall, upon conviction by the
code enforcement baard, be fined not more than �ve hundred
dollars ($500.00) per day. Each day such violation shall continue
shall constitute a separate offense. In lieu of such fine, or in
addition thereto, such person or persons, if licerised to do busi- �;
ness within the Village of Tequesta, may have such license sus-
pended for a definite period of time, or such license may be
revoked, said revocation to be subject to concurrence of the Palm
Beach County Construction Industry Licensing Board where ap-
plicable, as contained in Chapter 67-1876, as amended by Chap-
ter 69-1433, Florida Statutes.

SECTION XVI. UNIFORM WATERWAY CONTftUL

(A) Jccrisdiction. �
(1) To provide for the regulations described herein within the ,
public waters of the State of Florida,_comprising the Loxahatchee
River and the Intracoastal Waterway and all creeks, canals or
waterways or tributaries connected therewith, located within the
geographical boundaries of the Village of Tequesta, Florida.
(B) Dock and Pier Length, Width and Con�guration.
(1) No dock or pier shall be eonstructed which extends water-
ward from the mean high water lir�e in excess of the least of the
following distances;

(a) Seventy-five (75) feet; or
(b) Ten (10) percent of the waterway width; or
(c) The distance from the point at which the dock or pier
intersects the mean high water line measured in a straight
line to the nearest point on the three-foot mean low water
line;
provided, however, the foregoing limitations shall not prohibit a
dock which does not extend waterward from the mean high water
line in excess of six (6) Feet.
(2) No dock or pier area shall be constructed with a�ma�imum
width in excess of six (6) feet.
(3) No dock or pier shall be located less than twenty-five (25)
feet from the waterward extension of the property line of any
adjoining riparian property owner.

(5) Mooring pilings may not be located within ten (10) feet of
the waterward extensi�n of the property line of any adjoining
riparian property awners, nor more than fifteen (15) feet water-
ward of a line perpendicular to and passing through the water•
ward end-point of the center line of any dock used with the same

(7) The total area of all docks and piers located on any riparian
parcel shall not exceed�ve hundred(500)square feet for each one
hundred (100) linear feet of that parcel shoreline. �
(S) Mooring devices such as boat lifts, davits and whips shall
not be considered in computing the required length, width and
co�guratian of docks or piers regulated by this ordinance. Nei-
ther shall the reconstruction, alteration or new construction of
mooring devices such as boat lifts, davits and whips be considered
as structural alterations for purposes of determining whether or

not said reconstruction, alteration or new construction is an ex-
tension of a nonconforming use. However, this exemption shall
not apply to structural alterations which affect the length, width
and co�guration of a dock or pier, exclusive of the alteration of
any mooring device aff'ixed or accessory thereto. Boatlifts and
mooring pilings outboard of docks and piers on waterways and
canals of eighty-five (Sb) feet or less in width are not permitted.
(C) Commercial Docks.
(1) No commercial docks shall be permitted within the R•1,
R-lA and R,/OP districts.
(2) Docks, p�ers, mooring devices and seawaUs loca.ted within
the single-family dwelling districts R-1, and R-1A shall be for -
single-family use only.
(D) Boathouses or Shelters.
(1) No boathouse or enclosed boat shelter shall be permitted to
'•� be located waterward of a seawall or mean high water line,which-
ever is applicable.
j` (E) Anchoring or Mooring of Vessets.

(1) No person shall anchor, moor or park or cause, permit or
� allow any other person under his or her control or command, to
�' a.nchor, moor or park any vessel or water craft af any description
, used or capable of being used as a means of transportation on
water, within the R-1 and R-lA single-faauly dwelling districts,
for a period of time in excess of seventy-two (72) continuous hours
during any consecutive thirty-day period, unle8s such ves8el or
water craft is located at an approved dock and with the consent of
the owner of such approved dock.
(2) The anchoring, mooring or parking of vessels or water craft
in all districts shall be at an approved dock, pier or seawall and
attached or secured by approved methods and/or devices.
(F) Discharge of Refuse.
(1) No person shall discharge, or permit or allow any other
person on a vessel or water craft under his or her control or
command to discharge, any human or animal excreta. from any
€ head, toilet or similar facility on any vessel or water craft, or

thi•ow, discharge, depasit or leave,or cause or permit to be thrown,
discharged, deposited or left, from any vessel or water craft any
refuse matter of any description into the wafiers located within
the area to which this ordinance applie$.
(G) Variance Criteria.
(1) Any person desiring a variance from the terms of this ordi-
nance shall make application for same to the zoning board of
adjustment of the village in accordance with the procedures set
forth in this section.
(2) In order to authorize any variance from the terms of this
ordinance, the board of adjustment must find with respect to the
proposed project as follows:
(a) The variance being requested meets the de�nition of the
term "variance."
� (b) No hazardous condition would be created.
(c) The flow of water would not be impeded or interfered with.
(d) No obstruction to navigation would occur. �
(e) It would not interfere with traditional pubiic uses of the
waterway, including but not limited to swimming, fishing,
or boating. �
(fl I�would not create an appreciable obstruction of waterway
views or otherwise detract from aesthetic values.
(g) It w�uld not appreciably disrupt, interfere with, or disturb
marine or benthic life.
(h) It would not contribute to the pollution of the waterway or
the degradation of its condition.
(i) It would not interfere with the lawful rights of riparian
owners. �
(j) It would be consistent with any other appticable laws,
rules or plans.
