The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162,Florida Statutes, heard testimony at
the Code Compliance Special Magistrate Hearing held on the 4t" day of December, 2018. Based
on the evidence and testimony presented, the following Findings of Fact, Conclusions of Law
and Order Finding Violation are hereby entered:
FINDINGS OF FACT
1. Respondents are the owners of the above-described property.
2. Respondents were represented at the hearing by GREGORY C. NELSON; there was also
a finding of proper notice.
3. Code Enforcement Officer Michael Filipkowski provided testimony and evidence of the
violation, as contained in the Village's evidentiary case file which was accepted into
evidence.
4. As of the hearing on December 4, 2018, based on testimony presented by the code
enforcement officer, the property was in compliance with Section 302.8 of the IPMC per
Section 14121 of the Code of Ordinances of the Village of Tequesta, but had not
achieved compliance within the time specified in the Notice of Violation.

The above-stated facts constitute a violation of Section 302.8 of the IPMC per Section
14121 of the Code of Ordinances of the Village of Tequesta.
ORDER
Respondents are hereby ordered to continue to comply with Section 302.8 of the IPMC
per Section 14121 of the Code of Ordinances of the Village of Tequesta.
Respondents are assessed $189.96 for administrative costs incurred by the Village prior
to December 4, 2018 hearing.
Should you violate the same Section of the Code again, you may be subject to a fine of
up to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the Code
Inspector is not required to give a reasonable time to correct the repeat violation and the case
may be presented to the Special Magistrate even if the repeat violation has been conected prior
to the Special Magistrate hearing.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondents to contact the Code Compliance Division at (56l) 768-OS19 to request a
reinspection of the property.
