Canvassing of an elecuon is an important procedure following an election in which the Canvassing Board publicl�� canvasses the absentee electors' ballots and provisional ballots as provided b`� state statute. r�dditionally, in the unlikely event of a contested election, the canvassing board meets to publicly canvass all election ballots. Canvassing Board members must remain unbiased at all times, and must neaer touch the ballots. When determining if a vote should count or not count, the Canvassing Board shall not base their decision upon the area in which a voter lives or their personal knowledge of a voter's intent in voting on a candidate or issue. DUTIES: • Tesang of tabulatin� equipment (I�&.� testing) — The canvassing board shall con�ene, and each member of the can��assing board shall ceruf�� to the accurac`� of the test. For the test, the canvassing board may designate one member to represent it. The L&� test is scheduled for 10:00 a.m. on Friday, March 1, 2019 at the Supervisor of Elections Office. The Village Clerk will attend as the designated representative for the test. • Canvassing of vote bv mail ballot — The super��isor shall safel`� keep the ballot unopened in his or her office until the canvassing board caneasses the vote. The canvassing board mav begin the canvassing of vote by mail ballots at 7:00 a.m. on the 1�`� da�� befc>re the election, but not later than noon on the day following the election. • Provisional ballots - The canvassing board shall examine each Provisiona] I3allot Voter's Certificate and Affirmation to determine if the person votin� that ballot was entided to vote at the precinct where the person cast a vote in the election and that the person had not already cast a ballot in the elecuon. (night of election or next day if needed) • Voring System Audit — Immediately following the certification of each elecrion, the county canvassing board or the local board responsible for certifying the election shall conduct a manual audit of the voting systems used in randomly selected precincts. (March 18, 2019 — 930 a.m.) REQUEST: Please appoint a council member to serve as a member of the Canvassing Board and an alternate in case the appointed member is unable to fulfill the duties. The following council members are eligible to serve as a Canvassing Board Member for the March election(s): • Council Member Vince Arena • Council Mernber Kristi Johnson • Council Member Laurie Brandon • Mayor Abby Brennan (if she is running unopposed — if she is opposed she is not eligible) 2 RESOLUTION 39-18 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, CALLING FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD TUESDAY, MARCH 12, 2019, AND IF NECESSARY, THE MUNICIPAL RUN-OFF ELECTION TO BE HELD TUESDAY, MARCH 26, 2019,FOR THE PURPOSE OF ELECTING COUNCIL SEATS 2 AND 4 FOR TWO YEAR TERMS; REQUESTING THE PALM BEACH COUNTY SUPERVISOR OF ELECTIONS CONDUCT THE ELECTION; DESIGNATING POLLING LOCATIONS; NAMING THE CANVASSING BOARD; ESTABLISHING ELECTION PROCEDURES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS,the Village has adopted the Uniform Filing and election dates as authorized by the Legislature of the State of Florida, House Bill 742, designating the second Tuesday in March as the uniform election date for municipal office; and designating a filing period for such office from Noon on the first Tuesday in December and end at Noon on the third Tuesday in December in the year immediately preceding the election; and WHEREAS, Section 2.01 of the Village Charter provides that Council Members shall be elected at large to Seats 2 and 4 in the odd yeazs; and WHEREAS, the Village Council of the Village of Tequesta requests the Palm Beach County Supervisor of Elections conduct the municipal election; and WHEREAS, Chapter 2, Article 5 of the Village Code of Ordinances provides that the Village Clerk, or designee, along with the Palm Beach County Supervisor of Elections, or designee, and one Council Member (which can include the Mayor) whose position is either not scheduled to be voted upon or who is unopposed at the election being canvassed, shall be appointed to serve as the Canvassing Board; and WHEREAS, Chapter 2, Article V of the Village Code of Ordinances further provides that the Village Clerk may appoint or hire as many inspectors of election, and other election workers as deemed necessary to conduct elections in the Village; and WHEREAS, the Village Council of the Village of Tequesta desires to designate polling locations, and establish election procedures for the General Municipal Election on March 12, 2019; and if necessary a Municipal Run-off Election on March 26, 2019. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,PALM BEACH COUNTY,FLORIDA,AS FOLLOWS: Section 1. Notice is hereby given that a General Municipal Election is scheduled to be held on Tuesday, March 12, 2019; and if necessary,a Municipal Run-off will be held on Tuesday, Mazch 26, 2019. The polling locations will be: Precinct 1078,Precinct 1088,and Precinct 1094 Tequesta Recreation Center, 399 Seabrook Road Precinct 1112, 1116, 1118,and 1120 Village Hall Chambers, 345 Tequesta Drive The polls will be open from 7:00 a.m. to 7:00 p.m. Section 2. In accordance with the provisions of Section 3.04 of the Village Charter, the Village Clerk shall be the Clerk of Elections and shall supervise the conduct of the General Municipal Election and Run off Election in accordance with the State of Florida Election Laws and the Village of Tequesta Code of Ordinances. Section 3. The Palm Beach County Supervisor of Elections is hereby requested to conduct the election as set forth in the Vote Processing Equipment Use and Election Services Agreement, effective January 1, 2019. Section 3. The Village Clerk shall authorize payment of the Inspectors of Election as per the rates attached as Ex. A. Section 4. Pursuant to Chapter 2, Article V of the Village Code of Ordinances, the Village Clerk, or designee, along with the Palm Beach County Supervisor of Elections, or designee, and one Council Member(which can include the Mayor) whose position is either not scheduled to be voted upon or who is unopposed at the election being canvassed, shall be appointed to and constitute the Village of Tequesta's Canvassing Board for the purpose of conducting the General Municipal Election and, if necessary, the Runoff Election. Section 5. The provisions of the Florida Elections Code relating to absentee ballots shall apply to the General Municipal Election and, if necessary, the Run Off Election, allowing the Palm Beach County Supervisor of Elections to canvass the absentee ballots, and attend the Logic and Accuracy Test, for the Village of Tequesta. Section 6. The Palm Beach County Supervisor of Elections is hereby designated to tabulate the ballots cast at the General Municipal Election March 12, 2019, and, if necessary, the Run-off Election March 26,2019. Section 7. The Village Clerk is hereby directed to post this Resolution in the Village Administrative Offices immediately after passage, and provide a certified copy to the Palm Beach County Supervisor of Elections. 2 Ex.
