RE: Request for Variance to Rea�°Yard Setback for Residence
at 368 Church Road
DATE: November 9, 2005
Mr. Stephen F. Coffey, owner of the property located at 368 Church Road in Tequesta, is
requesting a variance from the requirements of the "O�icial Zoning Ordinance of the Village of
Tequesta, Florida", Article VI, Schedule of District Regulations, Section 78-143, Schedule of
Site Requirements, R-1 District, Rear Yard Setback for a principal structure of 20 feet, to allow
far the construction of a 28 feet x 30 feet 11 3/4 inch one story addition to an existing single
family residence that will e�end within the 20 foot rear setback. The applicant is requesting a
variance of 2 feet 1 I 1/16 inch from the 20 faot rear yard setback to allow for a total proposed
rear setback of 17 feet 10 5/16 inch.
Properties within 300 feet of the Coi'�ey residence have beeY� r�vti#ied by inail c�f�l�is proposec�

State law requires construction to be done by licensed contractors. You have applied for
a permit ixnder an exemption to that law. The exemption allows you,as the owner of
your property,to act as your own contractor with cei�tain iestrictions even though you
do not have a license. You must provide direct, onsite supervision of the const�uction
yourself. You may.build ox� improve a one-family or two-family residence or a farm
outbuilding. You may also build or improve a commercial building provided your costs
do not exceed $25,000. The building or residence must be for your own use or
occupancy. It may not be built or sabstantially improved for sale or lease. If you sell or
lease a building you have built or substantially improved yourself within 1 year after the
construction is complete,the law will presume thaf you built or substantially improved it
for sale or lease,which is a violation of this exemption. You may not hire an unlicensed i
�ei�son as your contractor or to supervise people working on your building. It is your �
responsibility to make sure that people employed by you have licenses required by state
law and by county or municipal licensing ordinances. You may not delegate the
responsibility for sixpervising work to a licensed contractor who is not licensed to
perform the work being done. Any person working on your building who is not
licensed must work under yoixr direct supervision and must be employed by you,which
means that you must deduct F.I.C.A. and withholding tax and provide workers'
compensation for that employee, all as presci�ibed by law. Your consti7zction must
comply with all applicable laws,ordinances,building codes,and zoning regulations.
