Special conditions and circumstances exist whieh are peculiar to the land, structure, or buildin; involved and which ai�e not applicable to othcr lands,structures or buildings in the same zoning district. �l�his lot ti�as developcd as a corner lot with frontage on both 1'equesta Drive and Riverside Uti���. l�he lot also abuts the Loxahatchee Rivei-. All lots w�ithin this subdivision and most if not all lots in other subdivisioi�s along the iiver were developed and are treated as having the i-car yard along thc ri��er. 1�lowevei�, prioi-to the date the applicant acquired title,the lot was split and access to Riverside Drive eliminated. As a result,the literal application ofthe � code creates the rare and unusual situation in which the yai-d along the Loxahatchee River is n-eated as the side yar-d, and the rear yard (accoi-ding to the code) of the applicant's lot abuts the neighbors sidc yard. 2. Tl�e speeial conditions and circumstances do not result from the actions of the applicant. Tlle lot split occurred prior to the date the applicant acquired title and therefor-c the special conditions wan�anting the variance do not result from the actions of the applicant. 3. Gi-anting the var-iance requested will not confer on the applicant any special privilege that is denied by this chaptei�to other lands,buildings or structures in the same zoning district. (irantin�� thc �'ar�ancc ��ill all��� the applicant to construct a home of similar size and charactei ro that pe7�mitted under rhe code for other river front lots and enable the applicant, in pi�act�ice, to tl�eat the yai-d alo�ig the r-iver- as the i-ear-yard like most other river front lot o���nc7:s. �l'herefore, granting the vai-iance will not confer any othei- special pi-ivilege i�ot enjoyed by other nver front lot owners. 4. Liteial inteipretation of the provisions of this chaptei-would deprive the applicai�t of rights commonly enjoyed by other pr-operties in the sdn�e zoning district undci the tetn�s of this chaptez-and would work umlecessary and undue hat-dship on the applicant. The literal application of the code makes what was originally th�side boundary the rear and wliat was originally the rear bout�dary along the river the side, making the lot oi�e which is much wider than it is deep. The imposition of the setbacks under this configuration creates an unusual,unappealing, and possibly unmarketable building envelope. More significantly it deprives the applicant of significant buildable area due to the fact that the building setback along the i�ver is much gi-eater than the rypical side setback. As a result, the application of 1 thc c��dr rcduc�, thr buildable area in a ma»ner that is unique to this lot and unfair to the �ipplicant. ln addirion, if thc variance is denied the applieant will be unable to construct a home of a qualiry and character- dictated by the location and size of the property thereby de��aluing the lot and creating an unfair and undue hai-dship on the applicant. 5. T'he variance gi-anted is the minimum variance that will make possible the reasonable use of the land, building or str-ucture. . Given the increased set back along the river and tt�e lack of aceess from Ri�-erside I�i-ive,the vanance rec�uested is the minimum variance that will allow the applicant to build a home of the size, c�uality, and configuration that is dictated by the location and size of the property, and one which will be marketable if the applicant ever decided to sell the propei-ty. 6. The gral�t of the variance will be in hai-mony with the general intent and putpose of this chapter and such vanance will not be injurious to the area involved ot-othez-wise detrimental to thc �ublic ���clfarc. _ (�i�c �roperty boundaiy t�hat is the subject of the vai-iance requcst is a conmlon boundaty s�rving as thc side bounda�y ofthe ncibhboring property in which the 7.5'side setback would customarily apply. ln this case, with the vanance, the applicants side setback will be 13' - S.S greater thai�the neighbor would customanly�xpect. Therefore,the neighbor will not be deti-imentally impacted by the vanance. li� addition,given the great appreciation in value of ii�er fi-ont �roperty, homes of greater size and expense have been and �'ill continue to be constructed along the river. Further, the actual proposed lot coverage remains w�ll below the nlaximum permitted under the code.
