Sec. 78-298 currently allows for such sale only at a 1,000 foot radius or greater from any church, school or youth center. The property owner is La Via Di Dio LLC. The notice of hearing was advertised on March 4, 2018. The public notices of the Village Council hearing were mailed to all property owners located within a 300-foot radius of the subject property. If additional space is needed,please attach extra pages to this application. If your variance request is related to the public waters of the state comprising the Loxahatchee River and the Intracoastal Waterway and all creeks, canals or waterways or tributaries connected therewith,located within the geographical boundaries of the Village,you must also address the ten criteria listed in the Sec.�6-7(next page). 1. Special conditions and circumstances exist which are peculiar to the land,structure,or building involved and which are not applicable to other lands,structures or buildings in the same zoning district. Commercial space on which we intend to open a restaurant is located on a plaia were other tenants have obtained a variance and cuRently selt intoxicating beverages. 2 The special conditions and circumstances do not result from the actions of the applicant. Limitation is due to having church and school within 1,000 feet from the commercial space. Other tenants located on the same plaza obtained a variance and are currently offerin intoxicatinq bevera es to patrons. 3 Granting the variance requested will not confer on the applicant any special privilege that is denied by this chapter to other lands, buildings or structures in the same zoning district. Various current and past business operators within the boundaries of the C-1 zoned district have obtained variance from Sec. 78-298. 4 Literal interpretation of the provisions of this chapter would deprive the applicant of righu commo�ly enjoyed by other properties in the same zoning district under the terms of this chapter and would work unnecessary and undue hardship on the applicant. We wish to open a competitive business in the Villaqe. Not havinq a wine and beer license would put us at a disadvantaQe to other business located within the district. 5 The variance granted is the minimum variance that will make possible the reasonable use of the land,building or structure. No additional variances will be required for us to be able to operate as a restaurant and offer wine and beer for on-site consumption. 6 The grant of the variance will be in harmony with the general intent and purpose of this chapter and such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. The Applicant intends to occupy the commercial space located on 381 N. Tequesta Drive, lupiter FL 33469 ("Subject Property"). Neighbors within a 1,000 feet from the Subject Property include: Church of the Good Shepard and Good Shepard Episcopal School, Lighthouse Art Center School of Art and the Tequesta First Baptist Church. The Subject Property is located on a C-1 zoned district. Section 78-176 "C-1 neighborhood commercial district" of the Village of Tequesta Code of Ordinances ("Code"), provides for a restaurant to be a permitted use. The Applicant plans to operate a restaurant on the Subject Property. However, the Applicant intends to offer intoxicating beverages (Beer and Wine) to patrons for on- premises consumption. As such, Applicant wishes to apply for a 2COP license to sell wine and beer for on-site consumption from the State of Florida. Given the limitations imposed by Sec. 78-298 of the Code, which precludes the sale of intoxicating beverages for on- premises consumption at an establishment located within 1,000 feet of any church,school or youth center, the Applicant is required to submit an Application for Variance from Sec.78-298. The Tenant intents to rent said commercial space, and operate a restaurant that will offer intoxicating beverages (beer and wine)for on-site consumption. I understand, that in order for the tenant to be able to provide such goods for sale,they need to apply for a 2C0 license(wine and beer license)from the State of Florida. I also understand that, in order for such license to be granted, the applicant first needs to receive approval from the Village of Tequesta. As such, the applicant is submitting and Application for Variance. I agree with the Tenant's intent of selling wine and beer for on-site consumption,and as such, I am in favor of granting approval of the requested variance.
