ORDER FINDING VIOLATION Case No. E190024 HAROLD A. ROWLEY IV & MYLES E. ROWLEY, Respondents. RE: Violation of Chapter 78, Article IX, Section 78-303; Chapter 14, Article VI, Section 14152 and 14-157; and Chapter 14, Article 11, Section 14-32 Sub Section 105.1 of the Code of Ordinances of the Village of Tcquesta. Address: 8 Country Club Circle Tequesta, Florida 33469 Legal Description: COUNTRY CLUB POINT LT 12 BLK I PCN: 60-42-40-25-12-001-0120 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the 14" day of May, 2019, and based on the evidence and testimony presented, enters an Order Finding Violation. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT I The Respondents were represented at the hearing by HAROLD A. ROWLEY TV; there was also a finding of proper notice. 2. Code Enforcement Officer Michael Filipkowski provided testimony and evidence of the violations, as contained in the Village's evidentiary case file which was accepted into evidence. Building Official Jose Rodriguez also presented testimony of the violations. Additionally, neighbor complainants David Becker, Gigi Dube and Richard Burube offered testimony and evidence concerning the violations. I As of the hearing on May 14, 2019, based on testimony presented by code enforcement officer, the property was not in compliance with Chapter 78, Article IX, Section 78-303; Chapter 14, Article VI, Section 14-152 and 14-157; and Chapter 14, Article 11, Section 14-32 Sub Section 105.1 of the Code of Ordinances of the Village of Tequesta. Page 1 of 2 CONCLUSIONS OF LAW The above -stated facts constitute a violation of Chapter 78, Article IX, Section 78-303; Chapter 14, Article VI, Section 14-152 and 14-157; and Chapter 14, Article 11, Section 14-32 Sub Section 105.1 of the Code of Ordinances of the Village of Tequesta. ORDER The Respondents are hereby ordered to comply with Chapter 78, Article IX, Section 78303; Chapter 14, Article VI, Section 14-152 and 14-157; and Chapter 14, Article II, Section 14-32 Sub Section 105.1 of the Code of Ordinances of the Village of Tequesta within fourteen (14) days, by May 28, 2019. If the Respondents fail to achieve compliance within fourteen (14) days, by May 28, 2019, a daily Fine of Twenty -Five Dollars ($25.00) per day may be imposed for each day the violation continues to exist. The Respondents are hereby assessed $190.46 for administrative costs incurred by the Village for the May 14, 2019 hearing. Please take notice that you must appear at the Fine Assessment Hearing which will be held on the 111 day of June, 2019 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469, unless the Code Enforcement Officer certifies that you have timely brought your property into compliance. Should you violate the same Section of the Code again, you may be subject to a fine of up to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the Code Inspector is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. Upon complying in any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768-0519 to request a reinspection of the property.
