Regular Council STAFF MEMO Meeting: Regular Council - Jun 13 2019 Staff Contact: Merlene Reid Department: HR Approve Memorandum of Understanding between the Village of Tequesta and CWA Wages Article Amendment The current Wages article in the 2016-2019 collective bargaining agreement required the Village and the CWA to negotiate minimum and maximum pay ranges. Human Resources provided preliminary range recommendations to the CWA based on an analysis of the 2019 Public Employers study, and data from a 2018 study prepared by HR Compensation consultants. Both parties worked together to ensure that the job descriptions were up-to-date and reflective of the regularly performed duties and the CWA ratified the MOU on May 29, 2019. The total cost to effect the range changes across four departments and eight employees to the end of FY2018/19, is $3,812.74. The attached Memorandum of Understanding (Appendix A) represents the conclusion of negotiations in respect of amendments to this Article. Page 41 of 94 Agginda Item #5. 7, MEMORANDUM OF UNDERSTANDING ("MOU") WITH REGARD TO ALL FULL­ TIME PERSONNEL EMPLOYED BY THE VILLAGE OF TEQUESTA REPRESENTED BY THE COMMUNICATIONS WORKERS OF AMERICA (CWA), WITHIN PERC BARGAINING UNIT NUMBERED 1080 AND PERTAINING TO MINIMUM AND MAXIMUM PAY RANGES THE VILLAGE OF TEQUESTA, FLORIDA (hereinafter referred to as the "VILLAGE") and THE COMMUNICATIONS WORKERS OF AMERICA, (hereinafter referred to as the "CWA") agree as follows: ARTICLE 9 WAGES Section 1. The 2016-2019 Collective Bargaining Agreement (CBA) required the Village and the CWA to negotiate minimum and maximum pay ranges for the positions within the bargaining unit. Section 2. The mutually agreed-upon ranges are outlined in Table 1. Both parties also agreed to the following range -related modifications: a.) For the limited purposes of this MOU only, any employee currently below the new minimum of his/her range, will be moved to the bottom of the new range and all employees holding the same job title will receive an equivalent percentage increase. b.) For the limited purposes of this MOU only, in order to provide opportunities for knowledge expansion and career advancement, the positions of Building Permit Coordinator, Code Compliance Officer and Administrative Assistant have expanded to include two levels as currently exist with other CWA positions, example Accounting Clerk I & 11 and Maintenance Worker I & 11. Bargaining members will be promoted to level 11 when they are in compliance with written criteria established by the Village which may require negotiation with the union. c.) For the limited purposes of this MOU only, where the minimum and/or maximum of the new proposed pay range is below the current range, the current range will prevail pending further negotiations. The nine affected positions are highlighted in Table 1. Village and the CWA Agree Further: 1. That this MOU shall be effective on the first payroll run after its full execution; and, 2. That the Parties have full legal authority to enter into this MOU. IN WITNESS THEREOF, the Parties have caused this MOU to be signed by their duly authorized representatives on this - day of 2019.
