Approved by: Executive Policy Number 05-18/19 Effective Date: July 11, 2019 Abby Brennan, Mayor TITLE: Mandatory Ethics Training (State and County) PURPOSE: To set the Village's policy and procedures for providing guidelines to all appointed and elected officials regarding mandatory ethics training. POLICY STATEMENT: Florida Statute 112.3142 requires all elected municipal officers to complete 4 hours of ethics training each calendar year which addresses, at a minimum, s. 8, Art. 11 of the State Constitution, the Code of Ethics for Public Officers and Employees, and the public records and public meetings laws of this state. This requirement may be satisfied by completion of a continuing legal education class or other continuing professional education class, seminar, or presentation if the required subjects are covered. Additionally, Palm Beach County Code of Ethics §2-446(a), requires appointed and elected officials to be informed of their ethical responsibilities at the start of their elected term, and to receive updates and training materials throughout the span of their service. The Village is required to establish a training schedule for all appointed and elected officials, which shall include mandatory periodic follow-up sessions. PROCEDURE State Required Training 1) An elected municipal officer assuming a new office or new term of office (the date the Oath of Office is taken) on or before March 31 of the calendar year must complete the annual training on or before December 31 of the year in which the term of office began. An elected municipal officer assuming a new office or new term of office after March 31 is not required to complete ethics training for the calendar year in which the term of office began. 2) This training may consist of live training with the Palm Beach County Municipal League of Cities or Florida League of Cities, on-line training through the Florida State University Institute of Government (https://iog.fsu.edu/online-ethics), or any other state approved training session specific to s. 8, Art. 11 of the State Constitution, the Code of Ethics for Public Officers and Employees, and the public records and public meetings laws of this state. 3) Training certificates (if provided) should be provided to the Village Clerk for your Council file. Page 1 of 3 Page 60 of 537 Agenda Item #9. 4) Elected municipal officials will certify on their annual financial disclosure that they have completed the required ethics training. Palm Beach County Required Training 5) Village Council members and appointed officials will receive initial Palm Beach County Code of Ethics training on the first day of taking office (the date their Oath of Office is given), with a 30 -day grace period. This training may consist of live training with Palm Beach County Commission on Ethics (COE) staff, on-line training through the use of the training video available on the COE's website, or a DVD presentation by COE staff. 6) As part of the required training, Village Council Members and elected officials are required to read the Palm Beach County Code of Ethics, and their Ethics Pocket Guide, copies of which will be distributed during their Orientation and are also available at www.r)almbeachcountvethics.com 7) After the initial training, periodic mandatory follow-up training is required of all Village Council Members and appointed officials every four (4) years. The COE and the Village Clerk's office will coordinate with the Human Resources (HR) Director to provide timely and effective follow-up training. The four-year training cycle is effective August 1, 2019 and there will be a 60 -day grace period. Therefore, all Village Council Members and appointed officials who take ethics training and read the Code of Ethics between August 1 and September 30 during the cycle year will be considered trained and in compliance with this policy. 8) After completing training and having read the Code of Ethics, all Village Council Members and appointed officials shall complete the approved acknowledgment form provided by the Village Clerk (also available at http://www.palmbeachcountVethics.com/forms.htm.), indicating that they attended a live COE training session or viewed the appropriate web -video or approved DVD provided by the COE. The training acknowledgment form must be signed by the Village Council Member and submitted to the Village Clerk's Office for inclusion in their Council file. 9) The HR Director is designated as the liaison between the Village and the COE. Working with the HR Director, the Village Clerk will coordinate all mandated training with elected and appointed officials and provide all required data to inform compliance audits with the COE for appointed officials and Village Council Members. 10) Periodically, the COE will recommend changes, modifications or updates to this ethics training policy. The Village Manager and the Village Clerk will review with the assistance of Page 2 of 3 Page 61 of 537 Agenda Item #9. the HR Director, and provide such recommended changes, modifications or updates to the Village Council for review and approval as necessary.
