Dear Mr. & Mrs. Gordon:
This letter is to confirm the action of the Village of Tequesta Board of Adjustment at their January 22,
2001, Public Hearing approving as submitted your application for a variance to the terms of the Official
Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section
X, Supplemental Regulations, Subsection (A), General Provisions, Paragraph (8), Floor elevation above
sea level, to allow the construction of an addition to the existing house to match the existing finish floor
elevation of 8.36, in lieu of a minimum finish floor elevation above mean sea level (MSL) for all new
construction, additions and substantial improvements to existing structures being 8.5' MSL or 18" above
the crown of the road, whichever is more stringent, all as required by the Zoning Code. This approval is
subject to the proper execution and recordation, by the applicant, of the attached General Release and
Hold Harmless Agreement with the Palm Beach County Clerk of the Court.
Please note that this variance shall expire within six (6) months from the date of grant, unless a building
permit based upon and incorporating the variance is issued within the aforesaid six-month period and
construction has begun thereunder. The action of this Board has no bearing or relationship to any other
approvals or permits which may be required. If you have any questions regarding this matter, please feel

BOARD OF ADJUSTMENT
Public Notice is hereby given that the Village of Tequesta Board of Adjustment will hold a Public
Hearing at 7:30 P.M., Monday, January 22, 2001, in the Village Hall, 357 Tequesta Drive, Tequesta,
Florida, to consider:
An application from Stephen N. and Joanne Gordon, owners of the property located at 10 Yacht
Club Place, Lot 606, Tequesta Subdivision, requesting a variance to the terms of the Official
Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended,
Section X, Supplemental Regulations, Subsection (A), General Provisions, Paragraph (8), Floor
elevation above sea level, to allow the construction of an addition to the existing house to
match the existing finish floor elevation of 8.36, in lieu of a minimum finish floor elevation
above mean sea level (MSL) for all new construction, additions and substantial improvements to
existing structures being 8.5' MSL or 18" above the crown of the road, whichever is more
stringent, all as required by the Zoning Code.
At such time and place, the Board of Adjustment will hear all evidence in support of or in opposition to
this application.
You are advised that if any person decides to appeal any decision made by the Board of Adjustment
with respect to any matter considered at the Public Hearing, he will need a record of the proceedings,
and for such purpose he may need to ensure that a verbatim record of the proceedings is made, which
record includes the testimony upon which the appeal is to be based. PLEASE GOVERN

(E) Powers and duties .o f the Roar?d of Adjustment and the Village
Council.
(1) The board .of adjustment and the village council shall have
the following powers in regard to appeals and variances within
their jurisdiction as defined under subsection (A) of this - ordi-
nance:
(a) lb hear and decide appeals where itis alleged there is error
in any order, requirement, decision or determination made
by an administrative official in the enforcement of this
section or of any ordinance adopted pursuant thereto.
(b) To authorize upon .appeal in specific cases such variance
from the -terms of the ordinance as will not be contrary to
the public interest, where, owing to special conditions, a
literal enforcement of the provisions of the ordinance will
result in unnecessary hardship. The power to grant any
such variance shall be limited by and contingent upon a
finding by the board or council:
1. That special conditions and circumstances exist which
are peculiar to the land, structure, or building involved
and which are not applicable to other lands, structures
or buildings in the same zoning district;
2. That the special conditions and. circumstances do not
result from the actions of the applicant; .
3. That granting the variance requested will not confer
on the applicant any special privilege that is denied by
this ordinance to other lands, buildings or structures
in the same zoning -district;
4. That literal interpretation of the provisions of the
ordinance would deprive the applicant of rights com
motly enjoyed by other properties in the same zoning
district under the terms of the ordinance and would
work unnecessary and undue hardship on the appli-
cant;
5. That the variance granted is the minimum variance
that will make possible the reasonable use. of the land,
building or structure;
6. That the grant of the variance will be in harmony with
the general intent and purpose of the ordinance and
that such variance will not be injurious to the. area
involved or otherwise detrimental to the public wel-
fare.
ADDENDUM "A"
1. The height of the finished floor of the existing structure is 8.36' (100.33") above MSL.
Current code calls for a minimum 8.5' (102"). These conditions exist peculiar to this
structure as it was built in 1977 and met the codes and height requirements in effect at
the time it was constructed.
2. The applicant was not a party to the deficiency. Title to the property was transfered
to the applicant in 1996.
3. The granting of this variance request will not confer any special privileges that have
been denied to other similar requests. To the contrary, the applicant is aware of
other requests for minimum floor height reductions having been previously granted.
4. The literal interpretation of the provisions of the ordinance would create an
unnecessary, undue hardship upon the applicant. Denial of the requested variance
would require the proposed addition to be built with slanted floors or ramps, and
different elevations of the new and old windows, soffits, facia, masonry details, roofing
intersections and ridges; all visible to the street. It is the desire of the applicant that
the proposed addition not look like an addition, but instead, blend into the existing
structure.
5. This request is for the minimum variance in floor height reduction (1.67") that would
allow the deficiencies outlined in #4 above to be avoided and the proposed addition to
architectually match the existing structure.
6. The granting of this request for variance will not violate the intent or purpose of the
ordinance. We are aware that we will be required to execute a "Hold Harmless"
agreement that will run with the deed to the property. This agreement insulates the
public from any liability incurred in possible future claims of damage as a result of the
granting of this request.
