Dear Mr. Loduca:
This letter is to confirm the action of the Village of Tequesta Board of Adjustment at their June 17,
2002, Public Hearing approving, as submitted, your application for variance to allow the completion of
a permitted 516 square foot addition with the finish floor elevation at 8.82' above mean sea level and
16.56" above the crown of road to match the existing house floor elevation, in lieu of minimum finish
first floor elevation above mean sea level for all new construction, addition, and substantial
improvement to existing structures being 8.5' MSL or 18" above the crown of the road, cul-de-sac or
highway or meet the requirements of Section XV, Flood Hazard Areas, whichever is more stringent, as
required by the Zoning Ordinance.
This approval is subject to the proper execution and recordation, by the applicant, of the attached
General Release and Hold Harmless Agreement with the Palm Beach County Clerk of the Court.
Please be advised that this variance shall expire within six (6) months from the date of grant, unless a
building permit based upon, incorporating the variance is issued within the aforesaid six-month period,
and construction has begun there under. The action of this Board has no bearing or relationship to any
other approvals or permits which may be required.

Project:
Master Bedroom Addition, Dining Room Extension, Front Porch Addition
and Alterations comprising of 516 square feet of new Air Conditioned Space and
137 square feet of New Porch. The existing residence was built in 1968 and is
comprised of approximately 2,300 square feet of air- conditioned space and 1033
square feet of existing garage and covered porches. The applicant purchased the
residence in 1992.
The new air-conditioned space will comprise approximately 18% of the total living
areas when completed.
The existing Finish Floor Elevation as determined by a recent survey (4-24-02) is
8.82'. The elevation stated is at the top of the Existing tile or Finished Floor. The
flooring material is comprised of a masonry set marble and is .12' thick (1-1/2").
The Flooring to be installed in the added space is to be the same as the existing.
The property is located on River Road. The road was recently removed and
replaced as part of the project to install new sewer and water service to the
neighborhood. Currently the elevations of the newly finished road are 7.61' at the
NW corner of the Lot, 7.34' at the SE corner of the Lot and 7.44' at the center of
the Lot. The Building Officials have determined that the crown of road elevation
used to determine the Finish Floor Elevation for the Master Bedroom Addition
would be 7.44' at the center of the lot.
Using the requirement that the Finish Floor be at an elevation 18" (1.5') above the
crown of the road would require that the Finish Floor Elevation of the Master
Bedroom Addition be at 8.94'. This is .12' or 1-1/2" higher than the existing
flooring. To complicate the issue further, the Building Official has determined
that the elevation for the Finish Floor be at the Top of Slab not the Top of the
Finish Floor. This would put the New Finish Floor at 9.06' or 3" higher than the
Existing Finish Floor.
It was obviously our intent for the new flooring to be flush with the existing
flooring.
We are requesting that a variance be granted to allow us to pour the concrete
slab at an elevation of 8.70' and install masonry set marble flooring at an
elevation of 8.82' to match the existing flooring. If the lower elevation of the road
were used (7.34') and the top of the Finish Flooring were used, the new floor
elevation would be only 2 one hundredths of a foot (1/4") lower than required.
Using the road elevation of 7.44' and the top of slab as finish floor would require
a variance of 24 one hundredths of a foot (3").
We believe that the new asphalt surface on River Drive is what has caused us to
have to apply for this variance. We can only assume that the original road
surface was lower than it is currently.
The following is to address the six criteria of the Zoning Code SectionXlll (E) (1)
(b) #1 - 6 as listed on the Application for Variance
1. We believe that the special conditions or circumstances that exist are as a
result of the new road surface and that the existing house was built to
conform to the requirements as they were in 1968.
2. These special conditions do not result from any actions of the applicant.
3. Granting the Variance will not confer any special privilege other than allowing
the new floor to be flush with the existing flooring.
4. Literal interpretation of the provision would require that a 3" step be required
between the existing residence and the added space.
5. The variance would only be as required to match the existing floor elevation.
6. We believe that the intent of the ordinance is to set a minimum elevation as it
relates to flooding. 82% of the total space is existing at the lower elevation.
The residence is located on the North Branch of the Loxahatchee River. The
mean high water elevation of the river is 1.9' or 5.54' lower than the crown of
the road and 6.92' lower than the existing Finish Floor and any rain or water
run off would first run into the river.

(a) No time-sharing uses of any nature as defined by this
ordinance shall be permitted anywhere within the village.
(7) Manufactured housing:
(a) Except as may be permitted as temporary facilities,
manufactured housing is prohibited throughout the vil-
lage.
(8) Floor elevation above sea level:
(a) Minimum finish first floor elevation above mean sea level
(MSL) for all new construction, additions and substantial
improvements to existing structures shall be eight and
one-half (8.5) feet (MSL), eighteen (18) inches above the
crown of any road, street, cul-de-sac or highway or meet
the requirements of Section XV, Flood Hazard Areas, which-
ever is more stringent.

GENERAL RELEASE AND HOLD HARMLESS AGREEMENT
WHEREAS, the Board of Adjustment of the Village of Tequesta, Florida, at the Public
Hearing held on, , conditionally approved a Flood
Insurance Variance No. , authorizing construction of: (detail activity)

WHEREAS, said variance would allow the floor elevation of such new construction to be
placed at elevation feet above mean sea level, and feet above the
crown of road, in lieu of all new construction, additions, and substantial improvements to existing
structures being 8.5' M5L or 18" above the crown of the road, cul-de-sac or highway or meet
the requirements of Section XV, Flood Hazard Areas, whichever is more stringent.
WHEREAS, the condition of said approval imposed by the Board of Adjustment requires
the property owner to enter into a Hold harmless Agreement with the Village indemnifying the
Village in the event of damage to the building as a result of flooding.
NOT, THEREFORE, it is agreed as follows:
1. This General Release and Hold Harmless Agreement is given to the Village of Tequesta
(hereinafter referred to as the "Village") by , (hereinafter
referred to as the "Owner", his representatives, heirs, successors and assigns) in consideration
for the Village granting the above referenced variance to owner. This variance refers to the
property located at , Tequesta, Florida, and
more particularly described as follows: (legal description)
2. The Owner hereby remises, releases, acquits, satisfies and forever discharges the
Village of and from, all and any manner of action or actions, cause and causes of action,
reckonings, controversies, damages, judgments, executions, claims and demands whatsoever in
law or in equity, which the Owner ever had, now had, or any personal representative, successor,
heir or assign of the Owner, hereinafter, can, shall, or may have against the Village, for upon, or
by reason of any cause arising out of or in the event of damage to the building as a result of
flooding due to the fact that the elevation of said building be at feet above
mean sea level, and feet above the crown of road. This agreement shall run with
the land.
IN WITNESS WHEREOF, the undersigned has caused these presents to be executed as
