VARIANCE AGREEMENT
THIS AGREEMENT, made and entered into this day of
November, 1993, between JOSEPH ALOE and FAUSTA RLOBI his wifet
hereinafter referred to as "Owner"t and the VILLAGE OF TEQUESTA,
Palm Beach County, Florida, hereinafter referred to as "Village".
W I T N E S S E T H ;
WHEREAS, Owner owns a residence in the Village of Teguesta,
Palm Beach County, Florida, situate at 356 Church Road, Tequesta,
Florida, and more particularly described as follows:
'WHEREAS, Owner has applied to the village Council of -the
Village of Tequestar for a variance to permit the construction of
a 326 square foot addition that will cause the subject property to
exceed the maximum allowable lot coverage under the zoning code and
-which addition will contain a kitchen, all of which is for the use
of owners family and bonafide guests.
WHEREAS ' the Village Council of the Village -of Tequesta has
approved said variance request upon certain conditions hereinafter
set forth which said conditions are acceptable to Owner.
NOWr THEREFOREo in consideration of the premises, it is agreed
by and,between the parties as follows:
1 ) Upon the happening of any one of the following
eventst the kitchen to be installed pursuant to the
variance # , shall be mandatorily removed at the
expense of the Owner or his heirs, successors or assigns,
to wit:
a) Upon the said kitchen facilities being
used for purposes other than for the use of
memb , ers of Owner's family and his bona bide
guests.
b) Upon the premises being sold without the
purchaser of the premises applying for, and
being granted, a renewal of this Variance
# , and agreeing to be bound by the terms
and conditions imposed thereon by the Village.

2) Upon the failure of the Owner or someone in his
behalf to comply with the 'requirements of Paragraph 1
above, Village shall have full Tight and authority to
enter the above described premises, remove the kitchen
facilities and assess the cost thereof against the lands
hereinabove described regardless of the ownership of said
lands at the time of the removal of said kitchen
facilities.
3) The Owner does hereby, agree that the proper Village
officials may inspect the property to ascertain
continuing single family use should any question arise as
to this use andr further, the Owner will send to the Town
an annual written statement to confirm that said single
family use of the property is continuing and there is a
need for the aforesaid ser—A vl'+- 1�

4) This Agreement shall be recorded in the public
records of Palm Beach Countyf Florida, and shall
constitute notice to all persons whomsoever of the terms
and provisions hereinabQve set forth.
