Dear Property Owner:
As the owner of the property at 121 Intracoastal Circle, in the Village of Tequesta,
Florida, located within 300 feet of the referenced property, Public Notice is hereby given
that the Village Council of the Village of Tequesta, Florida, will hold a Board of
Adjustment Meeting on Monday, January 22, 2007, at 7:00 P.M., in the Village of
Tequesta Council Chambers, 345 Tequesta Drive, Tequesta, Florida, to consider:
An application for a Variance requesting the northside setback to be
reduced to 15 feet to enable a retrofit installation of an elevator
for handicap accessibility.
At such time and place, the Board of Adjustment will hear all the evidence in support of
or in opposition to this application. You are advised that if any person decides to appeal
any decision made by the Board of Adjustment with respect to any matter considered at
the Meeting, he/she will need a record of the proceedings, and for such purpose, he/she
may need to ensure that a verbatim record of the proceedings is made, which record
includes the testimony upon which the appeal is to be based.

JUSTIFICATION OF VARIANCE:' Please address the six criteria of the Toning Code Section XHI
(E)(1)(b) I-6 which are listed on the back page of this application. If your variance request is related to
the public waters of the State of Florida, comprising the Loxahatchee River and the Intracoastal' Waterway
including all creeks, canals or tributaries therewith, you must also address the ten criteria listed in the
attached Zoning Code Section XVI (G)(2) a j:
NOTE: Applicant shall include the following items with this application:
1) Current survey of property showing all structures and setbacks.
2) Drawings to scale of proposed improvements.
3) Written approval from property owner, if other than applicant.
4) Any other documentation pertinent to this application.
5) Copies of all submittals as follows:

Re: JUSTIFICATION OF VARIANCE
A: Special conditions and circumstances: The special condition affecting
the property is that it is an existing structure built in a zero lot line
development with minimal set backs. The houses in the development were
designed to occupy most of the developable land in each lot. Thus, the
required modification, a medically needed elevator, must be placed in a way
that will encroach on the set backs. We are not aware of any other house
within this development or within the zoning district that requires an
elevator for medical purposes, and that is required by existing structures to
place the elevator within the lot setback.
B: The special conditions and circumstances affecting the applicant do not
result from the actions of the applicant. The applicant did not build the
property and was not afflicted by the medical condition at the time that the
property was purchased.
C: Granting the variance will not confer on the applicant any special
privilege. The encroaching improvement will be set in a way to be minimally
invasive and the variance is only required as a result of a medical necessity.
D: The literal interpretation of the provisions of the zoning code would
deprive the applicant of the right to quiet enjoyment of her property, which
right is enjoyed by other property owners in the same zoning district and
would work an unnecessary and undue hardship on the applicant by forcing
her to sell her home and relocate.
E: The variance requested is the minimum variance that will enable the
construction of an elevator large enough to accommodate the applicant and,
thus, enable the applicant to make reasonable use of her residence.
F: The grant of the variance will be in harmony with the general intent and
purpose of the zoning code, which is to ensure comprehensive planning and
consistent use within each zoning district. The variance will not change the
use of its structure from its residential nature and is only requested to
enable the applicant to make the full use of her residence and be placed in a
similar situation to her neighbors, who are physically capable of enjoying
the full residential structure.

Mrs. Jeanette L. Williams, 121 Intracoastal Circle, Tequesta,
Florida 33469 (561.747.6085), has Inclusion Body Myositis, a
muscle disease in the ALS family. She was diagnosed three
years ago by Dr. Devon Rubin, M.D., Neurology, Mayo Clinic,
4500 San Pablo Road, Jacksonville, FL 32224 (904.953.7104).
She has continued treatment with Dr. Rubin since she was
diagnosed, as well as with the Family Medical Center in Palm
Beach Gardens, Florida.
Inclusion Body Myositis is a degenerative incurable muscle
disease. It is increasingly difficult for Mrs. Williams to climb
and descend stairs. It is also dangerous because her muscle
weakness has increased her vulnerability to falling. It is not
known at this time how much longer she will have the ability
to climb stairs.
Because of this, I strongly believe that installing an elevator in
the Williams household will lessen the danger of falling,
improve her safety, and substantially increase the length of
time Mrs. Williams can remain in the house.
