Regular Council STAFF MEMO Meeting: Regular Council - Aug 08 2019 Staff Contact: Jeremy Allen, Village Manager Department: Manager RESOLUTION NO. 37-19, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ADOPTING A REVISED LAND DEVELOPMENT FEE SCHEDULE AS PROVIDED BY SEC. 62-181 OF THE VILLAGE CODE OF ORDINANCES; PROVIDING THAT THIS SCHEDULE OF FEES AND CHARGES SHALL BE AVAILABLE FOR INSPECTION AT ALL TIMES AT THE VILLAGE HALL DURING REGULAR BUSINESS HOURS. Revisions to both the building department fees and the community development fees. The proposed amendments are intended to balance out the fees paid for these activities, and simultaneously afford some potential amount of cost savings to applicants. Currently, the Village is collecting excess building fees and insufficient land development fees. This proposal is meant to bring these fees into balance. These revised fee schedules also incorporate the 50% reduction for 501(c)(3) not for profit organizations as previously directed by Council. RESOLUTION NO. 37-19 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ADOPTING A REVISED LAND DEVELOPMENT FEE SCHEDULE AS PROVIDED BY SEC. 62-181 OF THE VILLAGE CODE OF ORDINANCES; PROVIDING THAT THIS SCHEDULE OF FEES AND CHARGES SHALL BE AVAILABLE FOR INSPECTION AT ALL TIMES AT THE VILLAGE HALL DURING REGULAR BUSINESS HOURS; PROVIDING FOR PUBLICATION OF THIS SCHEDULE OF FEES AND CHARGES IN APPENDDC D. OF THE VILLAGE'S CODE OF ORDINANCES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village Council of the Village of Tequesta, Florida, desires to adopt a revised land development fee schedule for all land development activities in the Village for the citizens of the Village of Tequesta and for other members of the public; and WHEREAS, the Village Council desires to provide for a waiver provision to allow the Village Council, based on conditions beyond the control of the applicant, to reduce or waive certain fees under certain circumstances; and WHEREAS, the Village Council desires to incorporate all such fees and charges adopted in accordance with Section 62-181 of the Code of Ordinances into one comprehensive fee schedule; and WHEREAS, the Village Council desires to make certain the schedule of fees and charges is available for inspection such that any member of the public may be aware of the cost of land development activity within the Village. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1: The Village Council of the Village of Tequesta, Florida, hereby adopts the revised Schedule of Fees and Charges attached hereto as Exhibit A and made part hereof as if fully set forth herein. Section 2: This duly adopted Schedule of Fees and Charges shall be available at the Village Hall for inspection by the public during normal business hours, and shall further be published in Appendix D of the Village's Code of Ordinances. Reduction or Waiver of Certain Fees by the Village Council: ',;otwithstanding the above provisions of this Fee Schedule, the Village -ouncil may, from time to time, upon written request of the applicant, -educe or waive applicable fees for application resubmittals to either the tanning & Zoning Board or the Village Council, or for requests for levelopment order time extensions when extenuating circumstances exist, which were not caused by action or inaction of the applicant, and that warrant the granting of relief in the sole discretion of the Village Council. All such requests shall be reviewed on a case-by-case basis. Any relief granted by the Village Council pursuant to this provision may be up to full of the applicable fee or any fraction thereof, in the sole discretion of Lmount h Village Council. e Page 69 of 182
