Couzzo, Jr., Village Managery~ From: Gary Preston, Director of Public Works ~'°' Date: October 7, 2005 Subject: Village Council Agenda Item for October 11, 2005; Nichols Sanitation Residential Curbside Collection for FY 2006 in the Amount of $264,314.88 On March 4, 1999, the Tequesta Village Council approved an eight year contract extension with Nichols Sanitation. In accordance with this contract, Nichols Sanitation is entitled to a 3.5% CPI increase for FY 2006. The Village residential house count on October 1, 2005, was 2,868 units. Consumer Price Indic ratie adjustment and pursuant to Section 17.5 of the Franchise Agreement for Solid Waste and Recyclable Materials Collection Services between the Vllage of Tequesta and Nichols Sanitation Waste Management, Inc. of Florida, the residential collection rates* will be increased 3.5°k, from $7.43 to $7.69 per unit per month effective October 1~, 2005. The change of rates is reflected by the measurement and fluctuation of itxlices annually. The descriptions of the rates are as follows: 2004-2005 2005-2006 Garbage $3.73 $3.85 Yard waste $1.28 $1.34 Recycling 2.42 2.50 Total $7.43 $7.69 The new collection rate will apply to the residential dwelling units and businesses within the Town limits and will be invoiced monthly per our agreement. We do not anticipate a d~ange in the disposal fee. ,~ 7 • RESOLUTION NO. 18-98199 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING AN E%TENSION OF NICHOLS SANITATION, INC.'S RE~IDENTTpT. CURBSIDE RECYCLING FRANCHISE AND GARBAGE, YARD AND OTHER TRASH FRANCHISE AND AMENDING SAID FRANCHISES BY ADOPTION OF A SOLID WASTE AND RECYCLABLE COLLECTION SERVICES AGREEMENT AND AUTHORIZING THE VILLAGE MANAGER TO EXECOTE THE SAME ON BEHALF OF THE VILLAGE OF TEQIIESTA. WHEREAS, the Village has granted to Nichols Sanitation, Inc. a :franchise for the collection of Residential Curbside Recyclables 'and a franchise for the collection of Garbage, Yard and Other Trash; and WHEREAS, the Village and Nichols Sanitation, Inc. have negotiated `an extension of the aforesaid franchises and other amendments to he terms; and I ~~-Z 1 ., i i i t t i r i s :WHEREAS, the Village has determined that it is in the best interests of the Village to continue its franchises with Nichols Sanitation, Inc., as amended. • NOW THE BEFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQIIESTA, PALM BEACH COUNTY, FLORIDA AS FOLLOWS: Section 1. The attached Solid Waste and Recyclable Collection Services Agreement with Nichols Sanitation Waste Management attached hereto and marked as Exhibit "A" is hereby approved and the Village Manager is authorized to execute the same on behalf of the Village of Tequesta. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember Hansen who moved its adoption. As always, feel free to call me if you leave any questions or concerns. cc: Craig Ahal JLS ~; { • • REFUSE, MULTI-MATERIAL RECYCLING AND VEGETATIVE WASTE COLLECTION AGREEMENT THlS AGREEMENT ("Agreement" j ~ made as of this day of - • • , 1999, by and between the Village of Tequesta, Florida, hereinaffer referred to as "Village", and Nichols- Sanitation, Inc, of Hobe Sound, a Division of Waste Management, Inc. of Florida, hereinaffer referred to as "Contractor", with its principal place of business at 7700 S.E. Bridge Road, Hobe Sound, Flor~la 33455. WHEREAS, the Village has authored negotiation of the restatement and extension of the existing refuse collection agreement that is scheduled to terminate September 30, 1999. NOW, THEREFORE, FOR AND IN CONSIDERATION of the respective covenants herein contained, the parties agree as follows: ARTICLE GENERAL INFORMATION • 1. LIAISON BETWEEN VILLAGE AND CONTRACTOR All dealings, contracts, notice and payments between the Contractor and the Village shall be directed by the Contractor to the Village Manager or his/her designee. 1.1 Filing of Commercial Fee Rate Schedule The Contractor shall file a Commercial Fee Rate Schedule which shall be continuously maintained in the office of the Village for inspection. The initial commercial_ Fee Rate Schedule shall be filed with the Village Manager a minimum of seven days prior to the effective date hereof, and any subsequent amendments thereto shall be filed with the Village Manager a minimum of 15 days prior to the effective date of such amendment. 2. COMMENCEMENT OF WORK The work outlined in these specifications shall commence on October 1, • 1999. i • 3. TERM 3.1 The term of the Contract shall be for a period of eight years beginn'mg October 1, 1999 and terminating September 30, 2007. -~' • ~.2 The Contract may be' renewed by mutual agreement for additional five (5) year periods. The Contractor -must notify the Vllage of its desire to -extend the contract on or before February 1, 2007. The Village will respond to the request for extens'~on no later than April 1,2007. 4. DEFINITION OF-TERMS 4.1 Authorized Rerxesentative: Shall mean the employee or employees designated in writing by the Village Manager to represent the ~Ilage in the administration and supervision of the Contract. 4.2 Biohazardous Waste: Shall mean any solid waste or liquid waste which may present a threat of infection or disease to humans or may reasonably be suspected of harboring pathogenic organisms. The term includes, but is not limited to, non-liquid human tissue and body parts; laboratory and veterinary • waste which contain human-disease-causing agents; used disposable sharps, human blood, and human blood products and body fluids; and other materials which in the opinion of the Department of Health and Rehabilitative Services represent a significant risk of infection to persons outside the generating facility. 4.3 Biological Waste: Shall mean solid waste that causes or has the capability of causing disease or infection and includes, but is not limited to, Biohazardous waste, diseased or dead animals, and other waste capable of transmitting pathogens to humans or animals. 4.4 Bulk Trash: Shall mean any non-vegetative item which cannot be containerized, bagged or bundled; including, but not limited to, inoperative and discarded refrigerators, ranges, toilets, washers, dryers, bath tubs, water heaters, sinks, bicycles, and other similar appliances, household goods, minor "do it yourself' projects construction debris, and furniture and all of the above shall not be commingled with Vegetative Waste. 4.5 Village: Village of Tequesta, Florida. • 2
