The regular monthly meeting of the Councilmen of the Village
of Tequesta was held Tuesday, Septem~r 13, 1966 at 8:00 P.M. at the
Village Hall. Councilmen present were: Messrs. Bowden, vylveater,
Cornelius and Valier. Also present ~..*ere Robert Ila,rp, Village Manager
and Cler?~ and trJilliam A. Lord., Village AtL'orney.
The Meeting was opened frith prayer and the pledge of alle-
giance to the f]ag by Vil.].a.ge Manager Robert Harp. A minute of sil.~t
prayer was observed for the Iate ~'•. Douglas Murphy trho had been a
member of the Zoning Board of Adjustment since 1962 and an election
Off°icial at e<a.ch Village 1;lection since 1962.
• The Ati.nutes of the previous meeting here read and approved
upon motion by Valier, second 'oy Sylvester and. passed.
Valier moved, second by Cornelius and passed that the de-
ts.iled reading of the financial report for August, 1966 be waived.
The Village Clerk recapped the Treasux~rs SepQrt. The report and dis-
bursements ~`or the month of August were approved upon motion by
Valier, second by aylvester and passed. :valances oa Hang at August 31,
1966 here as follows:

The Sintcing Fund balance liras $18,~05.~r2. The Village Clerl{
advised that the first seven (7,~ bonds issued for construction of
the Village Ha11 would be redeemed prior to October 1.
The Village Manager's b sport for the month or" August wa.s
read and approved. The report shotred:
1. Fi'l'e hydrant had 'peen installed at ~'equesta Dr~.ve and
Sevilla Road by Tequesta ~Tater Co.
2. Edges of roads and holes iri roads had been patched.
3. :tegular fogging for mosquito had been done.
~'r. Additional improvements had been made to entrances at
U.v. #1 and Tequesta Drive including signs designating
"Tequesta Drive" placed on stonesy painting island curd
t~rhite and. ne~•r plantinbs around pip house.
5. Maintenance men had started repainta.ng and re-lettering
all street sign posts.

PoLi.ce Chief Dusenberg presented the Police I~partment
Deport for the month of August and the Civil Defense Report and both
were approved.
C~unci]~man Valier reported tha'c tmrk ~,ra,s progressing for
an area United Fund but the organization tras an need of a leader to
assure its success.
Couiaeilmaa Cornelaus reported that t-~ro (2) bids had been
amide ~, to locate a post oix^ice in the ®iI]ag®. One bid was by A~Ir. George
t~. Ogfutt, III to locate it in the ~il]age Square Shopping Center and
the other eras from the o~mers of ~equesta P]aza to locate it in their
shoppia.g center. He further reported that fund's have been made avail-
able;in the 19G6-1967 Eudget to provide for 2a hour operation of the
police desk.
Cotmbillnan 3ylvest-er reported that there is no further pro-
grebs oh the location of the nett bridge across the Intracoastal ,;Tater-
• way at State F.oad 707. Plans are being dratm for tlae structure. I3e
Enricher reported that it appears it trill 'oe located at some place
tirhich t•~oulc require a very minimum, if any, amount of right-oF tra,g* to
be purchases.
Council Sylvester reported no Further action on a pillage
beach. lYe stated that it eras available to be purchased but a price
to make it prohibitive for the ta;.payera of the gillage. Yle Brill
refer the matter to the Citizens Commit'cee for an additional report.
~1iLlage Manager i~'arp reported for Counci]man ~3ledsoe on
possible additional improvements to the island at U.S. Y•1o. 1 and
~equesta ~7riv® by removing present trees and re-pla.n'cing frith all
the same type tree of a kind that could be cut to shape. 'b'he Coun-
cilmen stated they believed the island to looPc very good as it is notr.
the possibility of changing the sign to conform to the Tillage hall
sign ~•ras mentioned. ~'he possibilit-y of placing a lighted ~~a.ter ~°oun-
tain in the island t,ra,s also mentioned.
Nlr. Robert ~. O~~en of Lrocktray, Ovon and Anderson engineers,
Inc. appeared before the Council and explaira~d the scope of 1,rork they
t-ould perform is a drainage survey for the Tillage area . Ile stated
they trould perform a lot of field worlc and the stL~dy lrould require
about two months to complete. 3'he Fin3.shed report taould point out
drainage problems, solutions, possible financing methods, etc.
• Cornelius moved, second by Sylvester and passed that the Mayor and
Clert_ be authorized to en'cer into an agreement with Eroc~~,ray, Owen
anc Anderson Engineers, Inc. to make a Drainage Survey for the pillage
at a cost of $2,000.00.

Mr. Pat Bnot~, representing the Bexmuda Terrace Association,
appeared before the Counc~:l to discuss the proposed annera.tion of that
area to ~~.he Tillage of Tequesta . IIe stated their residents had 'assn
made aware of var.~vus advantages and disadvantages to the-annexation
and he believed that the residents of Bermuda Terrace zioul,oi approve tine
annexation by the required percentage ~~ an election should 'ue held
for this purpose. The T_lla,ge Attorney stated that an election would
have to be held for the voters of bo'ch the Ti]Llage and Beaauda Terrace,
a separate election for each eras,, anti 2/3 of the voters in each area
ac'cus,lly voting oa the issue must vote in favor of the axmexatioa.
The Tillage Attorney tree instructed to prepare an Ordinance of Intent
to Annex Bermuda Terrace to the Tillage of ~'equesta and 'the Co>"mcilmen
tsould have a Bpeci al Pieeting on Y~'riday, September 16, 1966 to act
upon the Ordinance. The Co~mci]men approved Tuesday, October I8, 1966
as the ,date of 'the Blection and the Tillage Attorney ~r.~ll trork out
the details of the election.
The ®illage Council instructed the Tillage manager to pre-
pare a I'.esolution of sympathy and appreciation for the family of the
late A. Douglas I~u~'nhy.
The Tillage Attorney read an ordiaanee to annex proper'y en
Jupiter Islancr owned by Forrest t°.. Smith to L-he Tillage of Tequesta.
A petition reques~irig this annexation haci been rec~ivad frotpi l~r. Smith.

The Ti~.lage ~=ttorrley read an ox~.~ance to annex. property on
the west side of :eabroolc Road otrned by Joh$ P. Rodericl{ to the Village
®i° Tequesta. A petition requesting this annexation had been received
from Mr. ~ Mrs. L'~odericl~. Cornelius taoved, second 'oyy uylvester anti
passed that the first reading be approved.
Ms.yar Bot~rden reported on a recent meeting he and the Tillage
Manager had with 1~Yr. Thomas ?ledger of Burnup and Dims, Inc. to dis-
cuss a CFTV Franchise bettiaeen 'chew and the Tillage. IIe re~rted Burnup
and Bites were agreeable to a 20 year non-e:~clusive franchise with
provi saons for e,--tensions provisions ror perfom~a•nce bond for removal
of syste~a if it is not a satisfactory operation after its start; pro-
visions for pro'cection of races to be charged to subscribers; fran-
chise fee to Village to 'oe on sliding scale - 2~ up to 500 subscribers;
501-1000 subscribers; ~r~ 2001 anti over; any cable serva.ce would
be available to subscribers at monthly rate and other usual franchise
agreement ~,rovisions. Cornelius moved, second 'ag Valier and passed
that the Tillage enter into a franchise agreement t~it:h Burnup anti
Biros, Inc. for CATV 5erv± ce for the Til7,age. The Tillage Attorney
is to prep~.re a franchise agreement for this purpose.
Councilman Cornelius discussec- the possibility of the
Tillage asking the yoard of County Comr~ssioners of Palm Beach County
to assure the maintenance of Tequesta ~i^ive Ei~n II.B. IAightray BIo. 1
to Oatuitry Club Drive anti Country Club Drive to the Martin Countlr sine
since these roads are noia carrying traffic t•~hich formerly used the

the proper County Officials and Village Officials to discuss this
matter further.
Cornelius moved, second 'oy Valier and passed that the appoint-
ment by Mayor Bowden of Broclaaay, Otiaen and And®rson yngineers, Inc. to
act as engineers in con,~unction with the Village's proposed purchase
of the Tequesta Mater Co., Inc. and Plantreat, anc., be approved.
The Village ~sttorney discussed several items on which his
opinion hacl been asked. A latter yrom the Tequesics, Country Club
Cammtmity E~ssociation, Inc. asking that the residents of several places
in the Cotr~,~,; ty be advised that clothes lines were not pernitted to
be conspicuous and that boats Caere not permitted to be parlaed in
drivet~~.ys t~a,s read and had boen brougk,t to the Attorneys s s,tteation.
It tans the Attorneys opinion that the Village Judge tiaould have to
determine if a clothes line eras conspicuous or apt. The letter ?s to
be turned ov@r to t?a0 Police Department as a basis for w complaint
oa t~Ce matter for police investigation: The Village does not have-
an ordinance relating to the place trhere boats can be parked on resi=
dent3,e,1 homesites. Cornelius coved, second bye Valier and passed tt:at
the Village Attorney prepare an ordinance to provide that boats, 'coat
trailers,- trucks, house trailers, campers, etc. must 'ae kept in carte

Islanc. to the Village of Tequesta and he tra,ated to know zrhat type

Chief Dusenoery advised of the proposed protection and Mr. lord will
so advise Mr. field.

Attorney Lord again advised the Council that any items
for State Legislature Action should be ready to be ~aresented in Y~larch.

Tam Assessor Cornelius aslted the Village Clerl; to report on
the properties of Mrs. John `Ziegler and P~Irs. John Ziegler, ~ecutrix

the assessed valuation pn both properties bad been 'cabled at the

2 mills.

is going to lool; over several possible sites for tho location of a
school in the ~equesta area . lie stated he had receiver'. corapla,a.nts

Ordinances is gives to otrners of offending dogs as soon as complaints
are received. Ike sta'~ed; that some citizens had questioned ~ahy the

the Council tras advised that the ^.ailroad Company had advised that they

A lector from Mr. John Alm]ie, Choral D3.reetor, of the
Jupiter High School, in response to a letter from the Police Depart-
ment which had advised of restrictions on house to house canvassing
under the terms of Ordinance Pdo. 111 eras read. The letter requested
a "second chance'.' to solicit for a contribution from the pillage.
Valier moved, second by Cornelius and ~a,ssed that the request of the
Jupiter School Choral Group for a permit for a house to house sale of
chocolates for the Choral Group be denied, but that solicitation could.

Palm Eeach ~,ounty, Inc. requesting tha'c the Village participate in
under~ariting the tournament to be held at the pGA Pdational Goli° Club

Mr. Robert Meyer, President of the Jupiter-Tequeata Juna.or
Citizens, Ice. reported to the Council that the organization eras
having some difrieulties in its operations due to lack of continuity
of supervision and general lacl: of interest. Ae stated that there

Music Casters in Riviera Beach, who would operate it in a similar
~~ mann@r. Under present zoning, a strictly commercial vesture would
be out since the area is zoned R-1 and any corranercial use wou]:d ra-
quire a ehasge in zoning follotrlag a Public Hearing on the requested
change. Mr. Maine spoke at some length stating his thoughts oa such
a program and hots it probably ~,rould 'oe operated. At this time, he
had not made a definite arrangcsnent znth tho JTJC and the Councilmen
suggested that a proposed aiprang®nent be sut~oa.tted to them for consi-
dera,tioa.
Mr. TJilliam Small~,rood spoke on the progress of the Ambulance
Fund stating they had made 55 ca11s since going in'co operation May 15,
196G; had 25 approved personnel; had received do~a,tions of .~u10,366.
and had a loan balance o~c approz3r~ately $5, 300. ~Ie emphasised that
coatributions are still needed nor tho successful operation of this
necessary service.
