Subject: Lot Split, Lot 77-78, 303 River Drive
Resolution 8-09
Robert M. Steel Trust, Nancy Steel, Trustee, request that the Village Council
consider a Lot Split of lot 77/78, 303 River Drive. Lot 77 and 78 were originally
platted separately, on the Plat of Tequesta, in Plat Book 25, Page 14 of the Public
Records of Palm Beach County. Both lots were under separate ownership.
Subsequently, the owner of Lot 78 Robert Steel purchased Lot 77. A building
permit was issued to Mr. Steel on 7-31-74, on Lot 77 for a swimming pool and patio.
If the lots were separated the pool and patio and the greenhouse located on Lot 77
would be in violation of the VOT Code of Ordinances, as there would be no
principal structure located on the same lot (Sec. 78-4 Definitions. Accessory
structure.) and they are partially constructed within the building set back line of
Lot 77 (Sec. 78-143. Schedule of site requirements). The chain link fence on Lot 77
and 78, located in the front yard should also be removed as fences are not permitted
forward of the building front (Sec. 78-284. Walls and fences. )
If the Lot Split is approved, the owner of Lot 77 and 78 should deposit with the
Village, a certified check in the amount of 110% of the cost of demolition of the
Code Violations in accordance with (Sec. 66-72. Procedure following tentative
approval; final approval and recording). A permit to remove the violations should
be secured and the deposit returned when the work is complete and approved by the
Building Department.
RESOLUTION NO. 8-09
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, APPROVING THE REQUEST OF NANCY
STEEL, TRUSTEE AND THE ROBERT M. STEEL TRUST TO RE-SPLIT
LOT 77 INTO LOTS 77 AND 78 AS SHOWN ON THE PLAT OF
TEQUESTA; PROVIDING THAT THE DIRECTOR OF COMMUNITY
DEVELOPMENT SHALL DO ALL THINGS NECESSARY TO
EFFECTUATE SAID LOT SPLIT; PROVIDING AN EFFECTIVE DATE
AND FOR OTHER PURPOSES.
WHEREAS, Lots 77 and 78 of the Plat of Tequesta, as depicted in Plat Book 25 Page 14
of the Public Records of Palm Beach County are currently considered one lot of record (Lot 77)
by the Palm Beach County property Appraiser and Tax Collector; and
WHEREAS, Nancy Steel, Trustee and the Robert M. Steel Trust ("Applicant"), owners
of said lot, desire, and have applied to the Village to re-split said lot into Lots 77 and 78 as
depicted on the Plat of Tequesta; and;
WHEREAS, Chapter 66 of the Code of Ordinances of The Village of Tequesta requires
that a request for a lot split be approved by the Village Council pursuant to the procedures for
plat approval; and
WHEREAS, the Applicant has complied with all requirements of Chapter 66 to
effectuate a lot split of Lot 77 of the Plat of Tequesta into Lots 77 and 78, and the Village
Council believes that approval said request will be in the best interests of the Village of
Tequesta.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta, a municipal corporation,
hereby approves the request of Nancy Steel, Trustee and the Robert M. Steel Trust to re-split Lot
77 into Lots 77 and 78 as depicted on the Plat of Tequesta, recorded in Plat Book 25 Page 14 of
the Public Records of Palm Beach County.
Section 2: The Director of Community Development shall work with the Applicant
to do all things necessary and appropriate to effectuate and finalize the requested lot split.
Section 3: This Resolution shall take effect immediately upon its adoption by

Please accept the attached application and fee as a request on behalf of Mr. Nancy Steel, Trustee, and the Steel Trust to
re-split Lot 77 of Tequesta into the original two lots, Lot 77 and Lot 78 Tequesta. As we discussed over the past few
weeks, the current plat of Tequesta on record shows both lots, however the Palm Beach County Tax Assessor combined
the lots in the tax records only without modification to the recorded plat,
It is our opinion that since the most current plat on record by the Village and Palm Beach County indicates two lots; this
request is to confirm the IoCsplit which is necessary to provide proper notice to the Tax office to again indicate two tax
property control numbers.
Therefore on behalf of the Steel Trusts we request a re-confirmation by the Village Council to spilt lot 77 into two lots to
be consistent with the current recorded plaf and deeds for the both lots. You will see by the attached documents that the
lots in there split condition will meet the Village's lot dimensions, width and all setbacks. We also ensure the Village that
the improvements indicated on Lot 77 will be removed prior to any building permits being issued for said lot or within
ninety days from the date of approval of the lot split. ,

rights in the subject real property which gives him a beneficial interest for his life which can be
considered to be an "equitable title to real estate", as that tem is emplcyed in Section 6, Articio 7

Additional Just cation
25 February 2009
1. The subject request does not meet the definition of subdivision as
stipulated in Article 1-General of the ~/lage of Tequesta's subdivision
ordinance because the lot is not being split into three or more lots
pursuant to Section 66.3, The current recorded plat on record for the
Village has not been amended and currently indicates that the land area
owned by The Steel Trust is subdivided into two lots know as Lot 77
and Lot 78 of the Tequesta Plaf, recorded in the records of Palm Beach
County, a copy attached hereto.
2. A search of the public records indicates no evidence of a unity of title or
re-p/at of the parcel and or the Tequesta Plat
3. The last recorded deed on the property continues to indicate a legal
description as Lot 77 and Lot 78, Tequesta Plat, Palm Beach County
Florida.
4. The lots as split in this request meet the previous lot configurations,
sizes and location of the current approved Plat. The lots also as
configured will not violate any land development regulations with the
removal of a pool, concrete slab and small storage structure on Lot 77.
The Owner has agreed to remove said items to ensure the lot will
conform within thirty (30) days of approval by the Village Council of the
re-split of the lot. They will also provide the Village with a surety of
110•/ of the certified cost of removal of the improvements. The Village
shall hold this surety until said improvements are removed.
5. The lots both have access fo a// utilities including water, sewer, electric
phone and cable TV. The re-split of the lot will not create additional
density than previously approved by the Village with the approval and
subsequent recording in the records of Palm Beach County the Plat of
Tequesta. Lot 77 and Lot 78 will be used for one (1) residential unit each
and the existing home and the proposed future home to be built on lot
77 shall meet all the building and land development regulations of the
Village. Traffic for the two lots have been used as background traffic in
previous studies for the Village as well as the one lot created by the re-
split will not impact local roads within the parameters established by
Palm Beach County and adopted by the Village of Tequesta.
6. The Palm Beach County Tax Assessor has indicated that with a written
reaffirmation of the two original lots, lot 77 and lot 78, they wi/I provide
two separate property control numbers as previously assigned when
the Tequesta Plat was originally recorded in the records of Palm Beach
County.
